MINUTES

I. Mrs. Mary Bennett, P.T. called the meeting to order at 10:10 a.m. in Room W064 of the Indiana Professional Licensing Agency, Indiana Government Center South, 402 W. Washington Street, Indianapolis, IN 46204. A quorum was established.

II. ADOPTION OF THE AGENDA

A motion was made and seconded to adopt the Agenda, as amended.

III. ADOPTION OF THE MINUTES FROM THE MAY 15, 2013 MEETING OF THE COMMITTEE

A motion was mad and seconded to adopt the Minutes from the May 15, 2013 meeting of the Committee, as amended.

IV. PROBATION PERSONAL APPEARANCES

A. Kelly Jo Evert did personally appear before the Committee as per the terms of her probationary order. She has submitted a signed copy of her personal statement and supervisory order as required. She is back to work as of July 15, 2013, and things are going well. IU and Riley Hospital have set out a very thorough action plan for supervision, and she is not doing any home health care.

V. PERSONAL APPEARANCES

A. William King did personally appear before the Committee to discuss his positive response application for certification as a PTA. He reported that he was arrested for DUI in 2010 and completed court ordered counseling along with 100 hours of community service; he still owes on his fine. According to the paperwork submitted he has not fulfilled the terms of his criminal probation in Illinois.

A motion was made and seconded to approve his application to sit for the exam; however upon successful completion of the exam he will need to reappear at the next meeting and bring proof of completion of probation, counseling, payment of fine, and attendance at support group as recommended by the addiction counseling. The temporary permit is denied.

Case Summary: On February 29, 2012 the Committee filed an administrative complaint against the Respondent which indicated that she had engaged in fraud or material deception by signing documents for patients that she did not see, using other employees’ log-in information.

Resolution: After hearing testimony and reviewing the file a motion was made and seconded to terminate probation and issue the license unencumbered.

Case Summary: On February 14, 2012 the Committee filed an administrative complaint against the Respondent’s license which indicated that he shared recalled NPTE test questions, which were likely to be reused on the NPTE, with other individuals who were preparing to sit for the NPTE.

Resolution: After hearing testimony and reviewing the file a motion was made and seconded to terminate probation and issue the license unencumbered.

VIII. DISCUSSION ITEMS

A. Probation Report by Megan Certo: Megan reported on the probationers, all probationers are in compliance with the exception of the following:

Larry Hall: has not submitted a signed order from current employer. He requested to terminate his probation and the committee instructed Tasha Coleman to send him a letter denying his request.

Elizabeth Crabtree: began working in March 2013, did not receive a supervisor’s report from May. Committee asked that we send her a personal appearance letter for November to remind her that her letters must be sent on time and on letterhead.

Patricia Mowbry: supervisor reports are not on letterhead and not addressing issues addressed in her probationary order. Send letter for personal appearance for the next meeting and remind her that supervisor letter must be received in advance of the meeting and must be on letterhead and address supervision.

B. Direct Access Rule: The Committee looked at the direct access statute and have begun the process of writing the rule.

C. Meeting dates: Debbie Reed will not be able to attend the November 2013 meeting; all other members must be present to insure a quorum.

The meeting dates are as follows: February 6, May 14, August 6, and October 29, 2014.

D. FAQ for Continuing Competence Rule: The Indiana APTA has posted FAQs on their website regarding the new CC rule.

IX. ADJOURNMENT

There being no further business, and having completed its duties, the meeting of the Indiana Physical Therapy Committee adjourned at 1:00 p.m.
