CHAPTER I - THE MANUAL

1-000/000 – THE POST MANUAL

A. The official policy and procedures manual of the West Bend Police Explorer Post #9911 is hereby established, and is titled "POST MANUAL" and referred to as the “Manual”

B. The Post Manual shall be prepared and distributed by the Explorer Advisor.

C. This manual is the property of the West Bend Police Explorer Post, and shall be turned in whenever a member leaves the Post or is terminated.

1-000/005 – Manual Defined

A. The official Post Manual of the West Bend Police Explorer Post, is a consolidation of orders and manuals, which are now in existence within the West Bend Police Department. This Post Manual supercedes all previous versions of Post Guidelines, Rules and Regulations, etc. The West Bend Police Department Policy Manual takes precedence in the event of a conflict between the two.

1-000/010 – Validity of Manual Content

A. Any statements in this Manual found to be illegal, incorrect or inapplicable shall NOT affect the validity of the remaining content.

B. Titles in the Manual shall NOT govern, limit, modify or affect the scope, meaning or intent of any Chapter, Section or Subsection of the Manual.

1-005/000 – ORGANIZATION OF THE MANUAL

A. The organization of the Manual is described in the subsections, which follow.

1-005/005 – Subdivisions

A. This Manual is divided as follows: Chapters, Sections and Subsections as follows:

a. 1 – Chapter.

b. 000/ Section.

c. /000 Subsection.

1-005/020 – Grammatical Construction

A. The content of the Manual shall be interpreted in accordance with the following grammatical rules:

1. Tense - The present tense shall also include the past and future.

2. Gender - The masculine gender also includes the feminine.

3. Singular and Plural - The singular also includes the plural.

4. 4. Mandatory and Permissive - "Shall" is mandatory --- "May" is permissive.

5. Membership - Unless specifically addressed, the term Explorer applies to Explorers and Cadets.

1-015/000 – REVISIONS TO THE MANUAL

A. Revisions to the Manual are any changes in existing content. They may consist of any additions to, revisions of, or deletions from, the existing sections, subsections, or paragraphs, or any change in the wording of such content.

B. Requests for Manual Revision

1. Members of the Explorer Post or of the Police Department, who wish to suggest additions or revisions to the Manual shall prepare a request for said change and submit it through channels to the Explorer Advisor. The request shall include the following:

a. The number location of the Section or Subsection to be added or revised.

b. The suggested addition or revision.

c. The reason for the addition or revision.

d. The name of the person to be contacted should further information be necessary.

C. Advisors shall review the Manual on an annual basis.

CHAPTER II – GENERAL POLICY

2-000/000 – RIDE-ALONG POLICIES OF THE EXPLORER POST

2-000/005 – Intent and Vision of Ride-Along Program: The main emphasis for Explorers and Cadets is to ride-along with officers on patrol and to spend observation time in the Communications Center. It is imperative that Explorers have a basic working knowledge of radio procedures prior to riding with officers on patrol. The following prerequisites and guidelines have been established for the safety of the members of the Explorer Post.

2-000/010 – Prerequisites Required prior to Communications Center Observation

A. The following requirements must be met prior to performing an Observation in the Communications Center:

1. Received a copy of the 10 codes.

2. Received a copy of the phonetic alphabet.

3. Completed CIB training and passed test.

4. Fingerprints and photograph entered in WBPD systems.

5. Turned in the Background Waiver, Participation Waiver, Media Waiver, and Hepatitis B Vaccine Declination.

6. Be a member in good standing.

7. Wear a Class A Uniform (if issued) or appropriate civilian clothing.

2-000/015 – Prerequisites Required prior to a Patrol Ride-Along

A. In addition to the requirements listed above, the following requirements must also be met prior to performing a Ride-Along on Patrol:

1. Complete a total of 8 hours Observation in the Communications Center. This is usually completed in two (2) four (4) hour shifts.

2. Completed basic CPR certification.

3. Pass a written examination.

4. Have a complete Explorer Class A Uniform.

5. Must complete the 90-day probationary period.

2-000/020 – Ride-along Guidelines for Explorers and Cadets (Patrol and Radio Room)

A. Explorers under the age of 18 shall not ride-along between 2400 – 0600 hours.

B. Explorers 18 and older are permitted to ride-along during any shift.

C. All ride-alongs are limited to four (4) hours in length.

D. Only one Explorer per shift may ride-along.

E. Within one week, (Sunday through Saturday), the maximum number of Explorers is three (3) per shift, in the radio room or as patrol ride-alongs, as staffing permits.

F. Explorers must sign up for a ride-along at least 24 hours in advance.

G. Explorers are required to sign-in, in the Explorer Binder in the radio room, and check in with the Watch Commander for their squad assignment.

H. Explorers shall not attend standard shift briefings.

I. A complete Class A Uniform must be worn during all ride-alongs in a marked squad car and the Explorer shall have a pen and pocket notebook. The uniform shall be clean and pressed.

J. Explorers are required to complete the appropriate Observation Report or Activity Report during their ride-along.

K. Explorers must remain with their assigned officer at all times. If the officer becomes involved in a major or sensitive case, the Explorer shall report to the radio room pending re-assignment by the Watch Commander.

L. Explorers shall not use any computer systems, look through any binders, books or files, unless specifically directed by the officer to whom they have been assigned.

M. Explorers shall not possess or use any of the following items during patrol ride-alongs: Firearms, chemical sprays, baton and handcuffs or any other offensive/defensive weapon.

N. Explorers shall not ride-along with officers on probation.

O. Form WBPD-125 Waiver of Liability (Ride-alongs) must be completed by the Explorer for each Patrol Ride-Along.

P. The Watch Commander must approve any exceptions to these guidelines.

2-000/025 – Ride-Along Guidelines for Sworn Police Officers

A. Explorers are prohibited from performing a ride-along with Police Officers who are still in a training status or probationary status.

B. Explorer will not respond with officers who are responding to a high-risk situation

1. High-risk situations referred to in this section would be any life threatening situation that the civilian ride-along would be exposed to. Examples of these situations may be, but are not limited to, pursuits or a violent crime in progress.

2-000/030 – Options Available When Terminating Explorer Participation Due to Shift Activity

A. Upon receiving the call, the officer may direct the Explorer to remain in the vehicle to provide communication assistance or call for backup as necessary.

B. Upon receiving the call, the officer pulls over to a safe location and radios the position of the Explorer to the Communications Center. The dispatcher will then dispatch a unit to pickup the Explorer and return them to the Communications Center, pending reassignment to another officer by the Watch Commander.

C. The Explorer may also use their personal cell phone and call a family member for a ride. The Explorer shall notify dispatch as the earliest convenience that they have been picked up.

CHAPTER III - RULES OF CONDUCT

3-000/000 – GENERAL BEHAVIOR

A. In setting forth the following general rules, it must be emphasized that it is not feasible to enumerate all offenses for which the Chief of Police or Explorer Advisor may take disciplinary action. Members of the Explorer Post are encouraged at all times to act with prudence and good judgment.

3-005/000 – VIOLATIONS

A. Any violation of the rules contained herein or of other orders, either written or verbal, shall be sufficient cause for the Chief of Police or Explorer Advisor to take disciplinary action.

3-010/000 – CONDUCT UNBECOMING A MEMBER OF THE EXPLORER POST

A. A member shall not act or behave privately or officially in such a manner as to bring discredit upon himself, the Explorer Post or the West Bend Police Department.

3-010/005 – Obedience to Law, Regulations and Orders

A. Members shall report any and all arrests or contacts with any police agency to the Explorer Advisor in writing.

B. Members shall not violate any Federal Statute, State law or local ordinance.

C. Members shall strictly obey and properly execute any lawful order issued by any supervisor of higher rank or classification.

D. Members who violate any rules, regulations or policies of the Department shall be subject to disciplinary action. The commission or omission of any other act contrary to good order and discipline shall also be the subject of disciplinary action.

E. According to the nature of the offense, disciplinary action may consist of:

1. A verbal reprimand.

2. A written reprimand.

3. Suspension for a determined period of time.

4. Permanent removal from the Explorer Post.

F. Discipline will be imposed by the Explorer Advisor, Post Committee Chair or Chief of Police.

G. All discipline action is final.

3-010/010 – Conduct Toward Others

A. Members shall observe the following rules of conduct:

1. Members shall conduct themselves in a manner that will foster the greatest harmony and cooperation between themselves and the units of the Department.

2. Members shall not intentionally antagonize any person with whom they come in contact, and shall treat all persons in a respectful, courteous and civil manner.

3. In the presence of persons from outside the Department, members shall address other personnel by their rank and civilian personnel by their title, i.e., Mr., Mrs., or Miss.

4. Members shall not intentionally become personally involved in disputes or quarrels in their own neighborhoods or with family members.

3-010/015 – Use of Force

A. Members shall not become involved in incidents in which an officer has to use force. Police Explorers are to serve as witnesses and call for assistance if necessary.

3-010/020 – Disorderly Conduct

A. Members shall NOT be disorderly or intoxicated in a public place at any time.

3-010/025 – Use of Alcohol

A. A member shall NOT drink any kind of intoxicating liquor. The odor of an alcoholic beverage on the breath will be considered presumptive evidence.

3-010/040 – Use of Drugs or Narcotics

A. Any use of an illegal drug is grounds for immediate dismissal.

B. Members using prescribed narcotic medication shall not participate in the Patrol Ride-Along Program, the Communications Center or any other community service activities representing the WBPD or representing themselves as a Police Explorer.

3-010/045 – Smoking - Compliance with City Policy & State Statutes

A. Per City of West Bend policy, there is no smoking in any city building or vehicles.

B. Use of tobacco products by Explorers while in uniform is strictly forbidden under any circumstance.

C. Smoking is only permitted in designated smoking areas, if over 18 years of age, while not in uniform.

3-010/050 – Sleeping on Duty

A. A member shall not sleep while on a tour of duty unless specifically authorized to do so.

3-010/055 – Card Playing / Games of Chance / Gambling

A. A member shall not engage in any game of cards, in any game of chance, or in any form of gambling while in a Department office or facility or in any other quarters used for or in conjunction with the conduct of official duties.

3-010/060 – Bribes / Rewards / Loans / Gifts / Favors

A. The following rules shall apply:

1. A member shall not accept a bribe or engage in any act of extortion or other unlawful means of obtaining money or property through his position with the Department.

2. A member shall not accept, directly or indirectly, a gratuity, fee, loan or gift of any kind from:

a. Any person liable to arrest or to complain,

b. Any person in custody,

c. Any person discharged from custody, or

d. Any friend or friends of such persons.

3. Members, individually or collectively, shall not solicit or accept any reward or gratuity in conjunction with services rendered in the performance of their duties.

4. Members shall not use their positions to seek free admission to places of amusement, sporting events, etc., and shall not solicit free meals or transportation or any other favors or gratuities which would not ordinarily be accorded a private citizen.

3-010/065 – Immoral Conduct

A. Except in the performance of duty, a member shall not knowingly become engaged in any situation or enter any dwelling with the intention of engaging in immoral or unlawful conduct. If required to do so, he shall report the fact to the Explorer Advisor as soon as possible.

3-010/070 – Loitering

A. "On-duty" members shall not loiter in cafes, drive-ins, service stations or other public places.

3-015/000 – RESPONSIBILITY

3-015/015 – Care of City Property and Equipment

A. A member shall be responsible for the proper care, maintenance and serviceable condition of any City property, fixed or movable, issued or assigned to him. Loss of, damage to, or unserviceable condition of such property shall be reported to an advisor.

B. Willful or negligent abuse, mutilation or destruction of City property shall be grounds for disciplinary action.

3-015/020 – Return of City Property

A. When a member is suspended, resigns or is separated from the Explorer Post for any reason, he shall return all City property in his possession to an advisor.

3-015/025 – Property Damage

A. Members shall promptly submit a written report of any damage to real or personal property resulting from the execution of their official duties or responsibilities.

3-015/030 – Money and Property of Others

A. A member shall deliver to the proper custodian any monies or other property not his own which comes into his possession. A report shall be made of the transaction.

3-015/035 – Misappropriation of Property

A. Members shall not appropriate for their own use any City property, evidence or found or recovered property.

3-015/040 – Care of Identification Items

A. A member shall be personally responsible for the items of identification issued to him by the Department, i.e., badge, cap piece, identification card, etc. A member shall neither loan nor borrow such items. He shall immediately report the loss of such items to an advisor and prepare a written report of the circumstances leading to the loss.

3-015/045 – Tampering with Evidence

A. Members shall not fabricate, withhold or destroy evidence of any kind.

3-015/050 – False Statements

A. Members shall not make false statements when questioned or interviewed or in reports submitted.

3-015/055 – Statements During Departmental Investigations

A. If requested to make a statement in the course of an official Departmental investigation, members shall make full, complete and truthful statements.

3-015/060 – Reporting Information

A. A member shall properly report any information given him in good faith that might indicate the need for action by the Department.

3-015/065 – Confidential Information

A. The official business of the Department is CONFIDENTIAL. Members shall only discuss or give official information:

1. To persons for whom the information is intended.

2. As directed by their superior Officers, advisors, or

3. Under due process of law.

4. WHAT YOU SEE HERE or HEAR HERE, STAYS HERE WHEN YOU LEAVE HERE!!!

B. Members shall divulge the content of any directive they may receive only when required to do so by the nature of the directive. The content of any criminal record filed in the Department shall be shown or divulged only to authorized persons.

3-015/085 – Punctuality

A. A member shall be punctual in reporting for duty at the time and place designated by an advisor. Failure to report promptly at the specified time shall be deemed neglect of duty.

3-015/095 – Personal Information

A. A member shall provide the Explorer Post with personal data such as his correct name, address, telephone number, parents name and phone number, marital status and the name of the person to be notified in case of emergency. Any change in personal data is to be reported to an advisor.

3-020/000 – WORK RULES - GENERAL

3-020/005 – Performance on Duty

A. While on duty, members shall be governed by the following rules:

1. Members shall devote their time and attention to the service of the City and the Department, and shall direct and coordinate their efforts in a manner, which will establish and maintain the highest standard of efficiency.

2. Uniformed members shall maintain a soldierly bearing and perform their duties in a calm and firm manner, acting together to assist and protect each other in maintaining law and order.

3. Members shall serve the Department loyally and discreetly, and shall not display cowardice or fail to support their fellow members in the performance of duty.

3-020/010 – Personal Cell Phones

A. Explorers may carry personal cell phones while at Explorer meetings, Explorer events and while on ride-alongs, both on patrol and while observing in the radio room, with the following restrictions:

1. Phones shall be on vibrate or off.

2. Making unnecessary calls or sending unnecessary text messages is prohibited.

3. Phones will only be used during activities to make arrangements for transportation or for emergency circumstances.

4. When using a cell phone, all efforts will be made to the use of the phone is not a distraction to other events that may be taking place.

3-020/015 – Social Networking and Social Media

A. Purpose - The purpose of this policy is to give Explorers guidance regarding their use of social media and social networking both on duty and off duty if it relates to their position at the City of West Bend Police Department.

B. Definitions

1. Social Media - Is a variety of on-line sources that allow people to communicate, share information, photos, videos, audio and exchange of text and other multimedia files with others via some form of on-line or cellular network platform.

2. Social Networking - Is using such internet or mobile formats as Facebook, Twitter, MySpace, LinkedIn, FourSquare, Gowalla Police Pulse, The Squad Room, Usenet Groups, online forums, message boards or bulletin boards, blogs, and other similarly developed formats to communicate with others using the same groups while also networking with other users based upon similar interests, geographical location, skills, occupation, ideology, beliefs, etc.

C. Restrictions

1. No Department Social Media sites or pages will be created or maintained without the approval of the Chief of Police.

2. Explorers are prohibited from posting images, photos, videos, badges, patches, or logos obtained in the course of their official duties without approval of the Chief of Police.

3. Explorers are prohibited from posting comments, photos or images which:

a. Would portray the Department in a negative manner or undermines the public’s trust and/or confidence in the Department.

b. Are of a sexually explicit nature posted without consent of both parties on any area where it can be viewed by any other person.

c. Could be construed as discriminatory based on the reader’s age, sex, race, national origin, religion, or sexual orientation.

d. Indicates personal views or beliefs regarding crime victims or victimization which are inconsistent with the mission and policies of the Department.

e. Could serve to identify the official law enforcement activities of the agency; the identity of offenders, suspects, victims or contacts; the identification of specific incidents or locations.

f. Reveals or tends to reveal any other information learned in the course of employment which is not available to the general public.

g. Could be considered harassing or threatening to any individual.

h. Condones or promotes the use of illegal drugs or illegal activity.

i. Shows weaponry owned by this department or weaponry owned personally or privately that displays, depicts, or promotes violence.

j. Are in contradiction with the department’s mission or value statements.

4. Use of Social Media or Social Networks on duty is prohibited unless authorized by the Chief of Police.

5. Any Explorer using Social Media or Social Networks during work time has no expectation of privacy.

6. Social Media and Social Network posts may be subject to discovery under the Freedom of Information Act and/or the Wisconsin Open Records Act, WI §19.35, as well as all other litigation-related and non-litigation related discovery devices.

7. Any comments, photos, or images that are prohibited in this policy that are posted by others to an Explorer’s Social Media or Social Networking site shall be immediately removed by the Explorer.

8. Explorers under investigation related to any violation of departmental rules may be ordered to provide access to the Social Media and Social Networking platforms in which they participate or maintain.

3-025/000 – COURTESY AND DEPARTMENT FORMAL

3-025/010 – Patriotic Courtesy

A. On approach of the US flag, uniformed personnel shall face the flag and render a military salute. (Uniform caps shall not be removed.) Personnel in civilian clothes shall stand at attention, remove his hat and place it over the left breast.

1. Exception: None of the above shall apply when a member is performing Police duty requiring immediate attention.

3-030/000 – SUPERVISION

3-030/005 – Rank

A. As Police Explorers, certain members of the Department have a special responsibility to act or take command in situations calling for law enforcement action. These situations may be regular operations, such as the command of a unit, or might be emergency situations, such as a disaster.

B. Police personnel are distinguished by rank, which is assigned in terms of level of responsibility within the chain of command. The descending order of rank in the Department is as follows:

1. Chief of Police

2. Captain

3. Lieutenant

4. Sergeant

5. Detective

6. Police Officer

C. Police Explorers shall follow the direction, guidance or orders given to them by any sworn officer, keeping in mind that they must also follow the chain of command, and act accordingly to the highest level which an order has generated from.

3-035/000 – ETHICAL CONDUCT

3-035/005 – The Law Enforcement Code of Ethics

A. As a law enforcement Officer, my fundamental duty is to serve mankind; to safeguard lives and property; to protect the innocent against deception; the weak against oppression or intimidation; and the peaceful against violence or disorder; and to respect the Constitutional Rights of all men to liberty, equality and justice.

B. I will keep my private life unsullied as an example to all; maintain courageous calm in the face of danger, scorn or ridicule; develop self-restraint; and be constantly mindful of the welfare of others. Honest in thought and deed in both my personal and official life; I will be exemplary in obeying the laws of the land and the regulations of my Department. Whatever I see or hear of a confidential nature or that is confided to me in my official capacity, will be kept ever secret unless revelation is necessary in the performance of my duty.

C. I will never act officiously or permit personal feelings, prejudices, animosities or friendships to influence my decisions. With no compromise for crime and with relentless prosecution of criminals, I will enforce the law courteously and appropriately without fear or favor, malice or ill will, never employing unnecessary force or violence and never accepting gratuities.

D. I recognize the badge of my office as a symbol of public faith, and I accept it, as a public trust to be held so long as I am true to the ethics of the Police service. I will constantly strive to achieve these objectives and ideals, dedicating myself before God to my chosen profession --- law enforcement.

3-040/000 – RE-INSTATEMENT

A. After being suspended for a specified period of time, the Explorer will remain in a suspended status, until they submit a memo in writing, requesting that they be re-instated to the Post.

CHAPTER IV - ORGANIZATION AND FUNCTIONS

4-000/000 – DUTIES OF THE EXPLORER POST

A. The duties of the Explorer Post are as follows:

1. It is hereby made the duty of the Explorer Post, and the members thereof are specially authorized within the City, to:

a. Observe within the Communications Center.

b. Ride-along with officers on patrol.

c. Direct traffic.

d. Assist with parades and other public functions.

e. Assist with non-criminal fingerprinting.

f. Other duties as directed by an advisor, sworn officer, or employee of the Police Department.

4-005/000 – ORGANIZATION OF THE POST

A. The sections, which follow, contain information of a general nature.

4-010/000 – ADMINISTRATIVE PRINCIPLES

4-010/020 – Chain of Command

A. The chain of command shall be respected in all matters. Information and communications shall move up and down through channels. It shall be the responsibility of each echelon to forward information and communications to the next higher or lower echelon together with approval, disapproval or recommendation.

4-010/025 – Unity of Command

A. Each individual, unit and situation is under the immediate control of one, and only one, person. The principle of command responsibility is in effect, i.e., each executive and supervisor is responsible for the acts of his subordinates.

4-020/000 – POST ADVISORS

4-020/005 – Adult Leader Positions

A. Adult leaders within the Explorer Post must be at least 21 years old.

B. Sworn Officers are preferred as advisors.

C. BSA policy mandates that each Explorer Post have a minimum of five (5) adult leaders, in any of the following positions.

1. Executive Officer – One position: Per BSA policy, the Chief of Police must fill this position.

2. Committee Chairman – One position: This person oversees the Post Committee and can be held by the Executive Officer.

3. Committee Member – Two positions: Both serve on the Post Committee. These positions are filled by former advisors or sworn officers from the WBPD.

4. Explorer Advisor – One position: This position is filled by a sworn officer from the WBPD.

5. Associate Advisor(s) – No limit on the number of Associate Advisors. Associate Advisors can be sworn officers or citizens from within the community.

D. The Post Committee will be composed of the Committee Chairman, Committee Members, Explorer Advisor and Associate Advisor(s). Each member shall have one equal vote. The Executive Officer has final say on all issues.

4-025/000 – MEMBERSHIP WITHIN THE POST

4-025/005 – Membership Eligibility

A. Membership within in the Post is open to all men and women, of all races and backgrounds, between the ages of 14 and 20.

4-025/010 – Probationary Member

A. A new member of the Post is considered a Probationary Member until the background investigation has been completed.

4-025/010 – Explorer

A. To be eligible as an Explorer, an individual must meet the following qualifications:

1. Currently in high school, maintaining a GPA of 2.5 or higher (on a 4.0 scale).

2. Have an interest in pursuing a law enforcement career.

3. Explorers are eligible until they graduate high school, at which time they may qualify as a cadet.

4. Pass a background investigation.

4-025/015 – Cadet

A. To be eligible as a Cadet, an individual must meet the following qualifications:

1. A high school graduate.

2. Currently enrolled in a college or technical school, majoring in Police Science, Criminal Justice or a related field, maintaining a GPA of 2.5 or higher (on a 4.0 scale).

3. Cadets are eligible if they are under 21 at the start of the chartering year.

4. Cadets are eligible for Exploring activities through the entire charter year.

5. Pass a background investigation.

4-030/000 – OFFICER POSITIONS WITHIN THE POST

4-030/005 – Selection of Officer Positions

A. Officer positions within the post will be held for one (1) year, from January 1st through December 31st, unless otherwise noted or extended by the Advisor.

B. Applications for the Officer Positions are due by the end of the first meeting each December.

C. Applications will be made available during at the first meeting in November.

D. Explorers may apply for multiple positions on the same application.

E. A personal resume should be submitted with the leadership application.

F. To be eligible to hold an officer position, the Explorer must have already met the requirements to be eligible to perform Patrol Ride-alongs with sworn officers on patrol. The Explorer must also be in good standing with the Post. Exceptions to this requirement are at the discretion of the Explorer Advisor.

G. Interviews will be conducted to determine the leadership for the upcoming year.

4-030/010 – Captain

A. The Captain is the senior officer within the Post and acts as the “president” of the organization. The Captain reports to the advisors of the Post. The Captain is responsible for the following:

1. Acting as the chairperson for the monthly meetings.

2. Guiding the Post for upcoming events and activities.

3. Other duties as appointed by an advisor.

4-030/020 – Lieutenant

A. This position is filled on an annual basis by the outgoing Captain or at the discretion of the Explorer Advisor. The 2nd Lieutenant is the third in command of the Post and acts in an advisory role to the Captain and other officer positions within the Post. There will be only one 2nd Lieutenant in the Post as any given time.

4-030/015 – Lieutenant-Operations

A. The Lieutenant is the second in command of the Post and acts as the “vice-president” of the organization. The Lieutenant-Operations reports directly to the Captain of the Post. The 1st Lieutenant is responsible for the following:

1. Establishing the yearly training plan.

2. In the absence of the Captain, fulfills the duties of the Captain.

3. Other duties as appointed by the Captain and advisors.

4-030/025 – Lieutenant-Secretary

A. The Lieutenant-Secretary is the fourth in command of the Post and acts as the “secretary” of the organization. The Lieutenant-Secretary reports directly to the Captain of the Post. The Lieutenant-Secretary is responsible for the following:

1. Is responsible for taking and maintaining minutes and attendance of monthly meetings.

2. Works with the Lieutenant-Operations in establishing the Yearly Training Plan.

3. Works with the advisors in maintaining the Explorer personnel files.

4. Other duties as appointed by the Captain and advisors.

4-030/030 – Sergeant-Supply

A. The Sergeant-Supply is the fifth in command of the Post and serves as the Supply Sergeant. The Sergeant-Supply reports directly to the Captain of the Post. The Sergeant-Supply is responsible for the following:

1. Is responsible for working with the advisors in issuing clothing and equipment to active members.

2. Is responsible for maintain the clothing records of members.

3. Other duties as appointed by the Captain and advisors.

4-030/035 – Sergeant-Historian

A. The Sergeant-Historian is the sixth in command of the Post and serves as the Post Historian. The Sergeant-Historian reports directly to the Lieutenant-Secretary of the Post. The Sergeant-Historian is responsible for the following:

1. Is responsible for working with the advisors in preserving the history of the Post.

2. Is responsible for working with the Sergeant-Web Master in providing historical information for the Post website.

3. Other duties as appointed by the Lieutenant-Secretary and advisors.

4-030/040 – Sergeant-Web Master

A. The Staff Sergeant-Web Master is the seventh in command of the Post and serves as the Web Master. The Staff Sergeant-Web Master reports directly to the Sergeant First Class-Secretary of the Post. The Staff Sergeant-Web Master is responsible for the following:

1. Posting the Patrol Ride-Along calendar to the group web site.

2. Posting the Communications Center Ride-Along calendar to the group web site.

3. Posting meetings and other special events on the group web site.

4. Other duties as appointed by the Sergeant First Class-Secretary and advisors.

4-030/045 – Sergeant

A. The Sergeant is the eighth in command of the Post. The position is intended to recognize those Explorers who have demonstrated their leadership skills and keeps them in a leadership role.

B. This rank is awarded upon the successful completion of holding any higher ranking position.

C. This rank is also assigned to any Explorer who holds an Assistant position to another higher ranking Sergeant position.

D. This rank is also awarded to any Explorer or Cadet who attends a week long, National Police Explorer Leadership Academy, National Police Explorer Conference, or State Police Explorer Academy, without having to hold a post leadership previously.

4-035/000 – POST FINANCIAL MATTERS

4-035/005 – Tax Exempt Status

A. The Explorer Post is a nonprofit organization.

B. The Explorer Post is tax exempt, operating under the tax exempt status of the West Bend Police Department and the City of West Bend.

4-035/010 – Post Checking Account

A. The Post Committee Chair or Explorer Advisor shall maintain the Post Checking Account for all Explorer related expenses and income.

B. The Post Checking Account shall be subject to an audit by the West Bend Police Department Support Services Commander at any time.

4-035/015 – Membership Fees

A. The West Bend Police Department Explorer Post #9911 is sanctioned by the Boy Scouts of America and sponsored by the West Bend Police Department. The charter is due annually as determined by Learning for Life.

1. Members will be required to pay an Annual Fee of $30.00. This includes new members as well as renewals.

2. The Charter Fee and Membership Fees will be paid from the Post Checking Account to the BSA. The remaining money from the Annual Fees will remain within the Post Checking Account.

3. Advisor’s Membership Fees will be paid from the Post Checking Account, without any expense to the advisor.

4-035/020 – Fund-raisers

A. The Post may conduct fund-raisers as necessary to generate funds for operating expenses. The Post should have a specific goal in mind when conducting a fund-raiser, as the Explorer Post is not in the business of simply making money for the sake of making money.

B. Fund-raisers may include but are not limited to the following:

1. Parking Events

2. Traffic Direction

3. Brat Fry

4. Shirt Sales

4-035/025 – Uniform Deposit

A. In order to obtain a complete uniform, which is required to perform a patrol ride-along, members shall be required to pay a Uniform Deposit of $50.00. Upon paying the Uniform Deposit, members will be issued the following items:

1. Class A Uniform Shirt with required patches.

2. Class B Uniform Shirt with required markings.

3. Class A Multipurpose Jacket with liner and required patches.

4. Hat – Baseball Style

5. Nameplate.

6. Appropriate rank.

7. Whistle and whistle chain.

8. Any Awards that the member is entitled to wear.

9. An Explorer Binder – with Index and Tabs for meetings and training.

B. Members are responsible for the care and maintenance of their uniforms.

C. The entire $50.00 Uniform Deposit will be returned to the member after the member leaves the Post and turns in all issued equipment. All items must be returned in a clean and serviceable condition.

1. The items shall be turned over to an advisor after scheduling an appointment.

2. A service fee will be charged if the uniforms are not dry-cleaned when returned.

3. The Explorer may keep the Class B Uniform Shirt and personal awards.

D. If the equipment is not returned to the Post within 30 days of leaving the Post, the member shall forfeit the $50.00 Uniform Deposit.

E. Failure to return the post equipment within the established timeframes, a Municipal Citation may be issued with the appropriate amount of Restitution added to the bond.

F. The cost for any equipment that is not turned in clean or is unserviceable due to improper care or abuse, will be deducted from the Uniform Deposit.

CHAPTER V - PERSONNEL ADMINISTRATION

5-000/000 – MEMBERSHIP RECRUITMENT

A. The charter for the post is due annually.

5-005/000 – PROBATIONARY PERIOD

A. New members are placed on probation for the first 90 days. During this time period, the following must occur:

1. The Background Waiver, Participation Waiver, Media Waiver and Hepatitis B Vaccine Declination must be returned.

2. The background investigation will be completed.

3. The training provided at the regular meetings will include material on the written examination.

4. The new Explorer must complete the required 8 hours of Radio Room Observation.

5. By the end of the probationary period, the new member shall take the written examination at least once.

B. During the probationary period, a new Explorer may be dropped from membership for any of the following reason(s):

1. Violation(s) of the Post Manual.

2. Failing to make any effort to attend meetings.

3. Failure to complete the required 8 hours of Radio Room Observation.

4. Failing to take the written examination by the end of the probationary period.

C. Exemptions to the above requirements are at the discretion of the Explorer Advisor.

5-010/000 – EXPLORER PERSONNEL RECORDS

A. Every individual who applies to the Post for membership shall have a Personnel Record started. The record shall be maintained on all current, past and rejected applicants. The records shall be maintained for at least seven years after the member leaves the Post.

B. Each record will consist of the following:

1. Yearly membership application.

2. Current and past waivers.

3. Results of the background investigation.

4. Written tests.

5. Clothing records.

6. Reports and Daily Activity Logs completed by the member.

7. Other documents at the discretion of the Explorer Advisor.

5-015/000 – BLOODBORNE PATHOGEN POLICY

A. Purpose - To provide guidelines for members responding to situations whenever the likelihood of exposure to the body fluids of another may be present.

B. Definitions

1. Blood Borne Pathogen - Means pathogenic microorganisms that are present in human blood and can cause disease in humans. These pathogens include, but are not limited to, Hepatitis B Virus (HBV), and human immunodeficiency virus (HIV).

2. Blood - Means human blood, human blood components, and products made from human blood.

3. Other Potentially Infectious Materials (OPIM) - Means the following human bodily fluids: semen, vaginal secretion, cerebrospinal fluid, synovial fluid, pleural fluid, amniotic fluid, any body fluid contaminated with blood, and all bodily fluids in situations where it is difficult or impossible to differentiate between fluids. This definition also includes any unfixed tissue or organ (other than intact skin) from a human (living or dead) and HIV-containing culture medium or other spills; and blood, organs, or other tissue from experimental animals infected with HIV or HBV.

4. Contaminated - Means the presence or the reasonably anticipated presence of blood or OPIM on an item or surface. The quantity of blood or infectious material is not relevant.

5. Exposure Incident - Means a specific eye, mouth or other mucous membrane, intact skin, or parenteral contact with blood or OPIM that result from the performance of an employee's duties.

6. Labeled - Means labeled with orange or red biohazard label unless otherwise specified.

7. Parenteral - Means piercing mucous membranes or the skin barrier through such events as needle sticks, human bites, cuts or abrasions.

8. Regulated waste - Means liquid or semi-liquid blood or OPIM; contaminated items that would release blood or OPIM in a liquid or semi-liquid state if compressed; items that are caked with dried blood or OPIM and are capable of releasing these materials during handling; contaminated sharps; and pathological and microbiological wastes containing blood or OPIM.

C. Personal Protective Equipment (PPE) - PPE has been placed in each squad containing a minimum of the following:

1. Barrier gown.

2. Glasses.

3. Disposable latex gloves.

4. Surgical type mask.

5. Disinfectant towelettes.

6. Biohazard disposal bags.

7. Biohazard labels.

8. Shoe covers.

9. Sharps container for needles.

D. Precautions to Prevent an Exposure Incident - Personnel responding to emergencies or engaged in other activities where the employee anticipates exposure to blood or OPIM shall observe the following standard precautions:

1. Members should not use bare hands to stop bleeding – always use a protective barrier. Wear latex gloves, surgical mask, eye protection, and a gown, as necessary.

2. Treat all human blood and OPIM as if known to be infectious for HIV, HBV or other blood borne pathogens.

3. If emergency resuscitation is necessary, use a mask and one-way valve. After use, the mask shall be delivered by the using Officer, to the hospital for sterilization. The one-way valve shall be disposed of as a biohazard.

4. Wear latex gloves when handling all hypodermic needles and contaminated sharps.

5. Do not eat, drink, smoke, apply cosmetics, or handle contact lenses in areas where the likelihood of exposure to blood or OPIM is present.

6. Do not keep consumable food in refrigerators, freezers, shelves, cabinets, or on counter tops where blood or OPIM are present.

7. Wash hands, face and other exposed skin surfaces thoroughly, and immediately after contact with blood or OPIM. When gloves are worn, hands should be thoroughly washed after the gloves are removed and disposed of.

E. Cleanup Procedures - All areas, equipment and body parts contaminated with blood or OPIM will be cleaned as soon as possible in accordance with WBPD Policy #5-015/020 G.

F. Reporting Exposure - Members who believe they were exposed to blood or OPIM, including unprotected contact with contaminated equipment, or cuts and punctures sustained in handling contaminated objects, will immediately report the details of the incident to their immediate supervisor.

G. Hepatitis B Vaccinations:

1. Explorers shall have the Hepatitis B Vaccination prior to joining the Post.

2. A Hepatitis B Vaccine Declination shall be completed and maintained in the Explorer’s personnel file.

5-020/000 – SEXUAL HARASSMENT

5-020/005 – Purpose

A. To establish Department policy concerning allegations of sexual harassment.

B. To establish proper reporting procedures for reporting instances of sexual harassment; and

C. Define instances, happenings and occurrences of sexual harassment.

5-020/010 – Policy

A. It is the policy of this Post to provide a businesslike work environment, free from all forms of discrimination, including incidents of sexual harassment.

B. No member shall be subjected to unsolicited and unwelcome sexual overtures or conduct, either verbal or physical.

C. Sexual harassment will be treated as misconduct, with appropriate disciplinary sanctions.

5-020/015 – Definitions

A. Member - All members of the post, including the Explorer Advisor, Associate Advisors, Cadets and Explorers.

B. Sexual harassment - The deliberate or repeated behavior of a sexual nature by one member to another that is unwelcome, unasked for, or rebuked by the other member. The behavior can be verbal, non-verbal, or physical in nature. Examples of sexual harassment could include, but are not limited to, the following:

1. Sexual comments of a provocative or suggestive nature;

2. Jokes or innuendoes intended for and directed to another member;

3. Suggestive or demeaning looks or leering;

4. Creating an intimidating, hostile or offensive working environment;

5. Making acceptance of unwelcome sexual conduct or advances or requests for sexual favors of any nature a condition of membership or continued membership.

5-020/020 – Reporting Procedure

A. A member who believes he or she has been sexually harassed shall contact an advisor. A memo will be prepared by the Explorer Advisor and forwarded to the Chief of Police.

B. Allegations of unwelcome sexual harassment shall be reported by the member immediately.

C. Until the complaint is found to be valid, the identities of the involved shall be kept confidential.

5-020/025 – Explorer Advisor, Associate Advisors and Explorer Officer Personnel

A. Advisors and Explorer Officers shall:

1. Be responsible for reporting instances of sexual harassment.

2. Be responsible for initiating immediate disciplinary action if the situation warrants same; and

3. Take immediate action to limit the affected employees from any further work contact.

5-025/000 – FRATERNIZATION

5-025/005 – Fraternization between Explorers or Cadets and West Bend Police Department Personnel

A. Members of the Explorer Post shall not engage any type of sexual or dating type of relationship with members of the West Bend Police Department.

B. If an adult member (Explorer or Cadet) of the Explorer Post does become involved in a relationship with a member of the West Bend Police Department, the Explorer member shall immediately notify the Advisor and shall resign from the Explorer Post.

5-025/010 – Fraternization between Members of the Explorer Post

A. Members of the Explorer Post are discouraged from dating other members of the Explorer Post.

B. If members of the Explorer Post do choose to date, while in uniform or at post functions, they are prohibited from showing signs of affection, kissing, holding hands or other activities that may bring a discredit to the Explorer Post or West Bend Police Department.

5-025/015 – Reporting Fraternization

A. Advisors and members of the Explorer Post shall:

1. Be responsible for reporting instances of fraternization to the Advisor.

5-030/000 – HAZING

5-030/005 – Hazing Prohibited

A. No member of the Explorer Post or of the West Bend Police Department may haze a member of the Explorer Post for any reason.

CHAPTER VI - USE OF FORCE

6-000/000 – USE OF FORCE

A. Members are prohibited from assisting sworn officers in making a lawful arrest.

B. Members are prohibited in using or possessing handcuffs, pepper spray, batons, knifes, and firearms, while in uniform.

C. The only exception to this policy would be under an emergency situation where human life may be at stake.

D. This policy does not apply under training exercises while under the direct supervision of an advisor.

CHAPTER VII - UNIFORMS

7-000/000 – UNIFORM AND PERSONAL EQUIPMENT REGULATIONS

A. Purpose – To establish uniform and personal equipment standards for the West Bend Police Explorer Post.

7-000/005 – Maintenance and Accountability

A. Maintenance – It shall be the responsibility of the individual being issued any equipment, to exhibit due care for the upkeep and maintenance of such items. Any such items damaged or lost through negligence of the possessing individual will be repaired or replaced at his own expense.

B. Prescribed uniforms, equipment and identification items shall be maintained at all times in a clean and serviceable condition, ready for immediate use.

7-000/010 – Uniform Classification and When the Uniform Shall be Worn

A. The Class A Uniform will consist of the light blue uniform shirt, uniform pants, belt, appropriate shoes and a Class B Uniform shirt worn under the Class A shirt.

B. The Class B Uniform will consist of the dark blue uniform t-shirt, uniform pants, belt, and appropriate shoes. During Athletic Explorer Competitions, dark blue or black shorts may be worn with the Class B shirt.

C. All Explorers shall wear their Class A Uniform during all ride-alongs, while observing in the Radio Room and at special events while representing the West Bend Police Department or the Explorer Post, and as directed by an advisor.

D. The Class B Uniform may be worn as directed by an advisor.

E. The Class A shall be worn to all regularly scheduled meetings.

F. Modifications to the Class A or Class B Uniform are at the discretion of an advisor.

7-000/015 – Exemptions from Wearing the Uniform

A. Explorers on Probation who have not obtained a uniform.

B. At the discretion of an advisor.

7-000/020 – Manner of Wearing

A. Official uniforms shall be worn in a military manner.

B. Uniforms buttons shall be secured at all times, unless otherwise directed.

C. Caps or hats shall be worn squarely upon the head.

D. Nothing shall be carried in the pocket of any uniform that might produce an obvious bulge or protrusion.

E. A complete uniform shall be worn. No distinguishable part of any uniform that would identify the wearer, as a member of the Post shall be worn in public in conjunction with civilian clothes.

F. Uniforms shall only be worn in the City of West Bend while performing official duties as an Explorer or at the discretion or direction of the Advisor. The exception would be wearing the uniform from home to the department and for special events outside of the city with the approval of an advisor.

7-000/025 – Tonsorial Appearance

A. Appearance of hair:

1. All Explorers will be neatly groomed at all times. Hair will be neat and trimmed.

B. Appearance of sideburns:

1. Will not extend below the ear lobes and will not flare.

C. Appearance of mustache:

1. Mustaches will not be bushy and will be neatly trimmed.

2. Mustaches will not extend below the corners of the lower lip.

3. Handlebar mustaches are not permitted.

D. Beards:

1. Explorers will be clean-shaven.

E. Exceptions:

1. When specifically exempted by the Explorer Advisor or the Chief of Police.

7-000/030 – Jewelry

A. No unspecified article of jewelry or personal ornaments shall be worn with or on the official uniforms.

7-000/035 – Prohibited Equipment

A. Only issued and authorized items/pieces of equipment may be used or possessed while on duty.

7-005/000 – UNIFORM SPECIFICATIONS

A. Class A Uniform Shirt: Is a light blue short sleeve uniform shirt with military creases, full button front, epilates, and 2 chest pockets with flaps

B. Class B Uniform Shirt: Is a dark blue short sleeve T-shirt with “West Bend Police Explorer” on front and back as described in 7-005/005.

C. Uniform Pants: 5.11 Taclite Pro – Dark Navy.

D. Jacket: Is a dark blue jacket with a fleece liner.

E. Hat – Baseball Style: Dark blue, with City of West Bend Logo on front.

F. Hat – Watch Cap Style: Dark blue, with “EXPLORER” embroidered on front.

G. Turtleneck Sweaters and Dickeys: Optional item. If worn, they shall be dark blue in color, worn under the Class A Uniform Shirt only.

H. Belts: A standard pants belt (plain or basket weave) is authorized and will be purchased by the individual. The belt will shall be black in color.

I. Shoes: Should be black in color. Tennis shoes are permitted but should be clean, serviceable and not gaudy in appearance.

J. Gloves: Optional item. If worn they shall be black in color.

K. Nametag: Will be black plastic with white lettering, ¾” high X 3” long. A silver metal nametag with black lettering is also authorized and shall be purchased by the individual.

L. Awards: As outlined and described in the Awards Program Policy.

M. Rank: Standard military rank as described in 4-025/020.

N. Explorer Shoulder Patch: “West Bend Police Explorer” with National Law Enforcement Exploring Logo in center.

O. Explorer Chest Patch: Is a round patch with “Law Enforcement Explorer” and National Law Enforcement Exploring Logo in center.

P. Whistle and Whistle Chain: The whistle chain will be silver for the Captain and 1st Lieutenant positions and worn on the Class A Shirt. All other Explorers, Cadets, Sergeants, and the 2nd Lieutenant will wear a gold whistle chain on the Class A Shirt.

7-005/005 – Insignia and Patches on the Uniform

A. Class A Shirts shall have the following patches and insignia attached.

1. Explorer Shoulder Patch – Worn on both shoulders, centered, 1” below the shoulder seam.

2. Explorer Chest Patch – Worn above the left breast pocket, centered, 1 1/4” above the pocket seam.

3. Rank – Worn on each collar, 1” up from the tip, centered.

4. Nameplate – Worn ½” above the right pocket, centered.

5. Awards – Worn above the left pocket, centered from left to right. The awards shall also be centered between the top of the pocket and the bottom edge of the Round Explorer Chest patch. Awards will be worn in accordance with the Awards Program Policy.

6. Whistle shall be attached to the whistle chain. The whistle will be in the right breast pocket and the chain will be attached to the right epilate of the Class A Shirt.

B. Class B Shirts – shall have the wording “West Bend Police Explorer” (centered over 3 lines) in yellow, on the left chest (3” high) and centered on the back (12” high).

C. Jackets and Fleece Liners - shall have the following insignia attached.

1. Explorer Shoulder Patch – Worn on both shoulders, centered, 1” below the shoulder seam.

2. Embroidery consisting of the City of West Bend Wisconsin logo, followed by “Police Explorer Post 9911” centered on the left chest.

Explorer Post #9911 is sanctioned by the Learning for Life-Boy Scouts of America and is sponsored by the West Bend Police Department. The mission of the Post is to provide area youth with a better understanding of local government, its functions and responsibilities; to promote respect for the law; to provide each Explorer and Cadet with the opportunity to observe the operations of the police department in the discharge of its responsibility to protect and serve the citizens of West Bend; and to provide information and exploration of law enforcement careers.

This Post Manual is established and shall remain in effect until directed otherwise by the Chief of Police.
