This position also represents the Department of Environment, Great Lakes, and Energy (EGLE) in Part 201 and Part 213 enforcement proceedings, negotiations and settlement conferences. The person in this position will interact with RRD district staff and staff from the Department of Attorney General (DAG), as necessary, to complete the tasks outlined above. 15.Please describe the assigned duties, percent of time spent performing each duty, and what is done to complete each duty.List the duties from most important to least important. The total percentage of all duties performed must equal 100 percent.Duty 1General Summary of Duty 1% of Time75Represents EGLE in Part 201 and Part 213 enforcement proceedings, negotiation sessions, and settlement conferences, including the development of settlement documents as required. Assists, as requested by management, in the development and implementation of statewide enforcement procedures, policies, strategies, and guidelines for enforcement orders. These activities involve coordination with other EGLE staff, the DAG, EGLE management, other departments, and the federal government as necessary.Individual tasks related to the duty.Under the guidance of management, negotiates voluntary agreements with responsible parties, with assistance from the DAG when appropriate, for recovery of past and future costs incurred by the state at sites of environmental contamination and/or for implementation of response activities or corrective actions. Drafts initial settlement agreement and assures that certain programmatic consistencies are maintained throughout settlement negotiations. Revises settlement documents to reflect the outcome of negotiations.Coordinates negotiation strategies and procedures as appropriate and using established guidance with DAG staff, Remediation and Redevelopment (RRD) technical and program staff, and division/EGLE management to ensure a consistent programmatic approach and mutual support. Brings issues to supervisor when review is appropriate.Assists the DAG in the preparation of legal complaints, pleadings, and briefs, and provides litigation support per management and agency guidance.Prepares and/or reviews briefing reports and memoranda for referral of cases to DAG staff for assistance with negotiations, litigation, or legal opinions.Keeps team members informed of important issues as enforcement cases move forward toward resolution.Writes recommendations for approval of proposed settlements. Enters required data for assigned cases into appropriate Part 201 and Part 213 enforcement databases.Utilizes specific methods developed for the purpose of determining fines and penalties.Provides guidance to field staff, other agencies, the general public, and private attorneys regarding the RRD’s legal authority pursuant to Parts 201 and 213.Duty 2General Summary of Duty 2% of Time15Acts as liaison to the public and RRD staff, using input from management and senior level staff as appropriate, for Part 201 and Part 213 enforcement program issues, including statutory requirements, RRD procedures/policies, enforcement actions and other issues.Individual tasks related to the duty.Drafts and revises, as directed and appropriate, Part 201 and Part 213 program documents. Emphasizes accuracy, clarity, and consistency based upon knowledge and interpretation of Part 201 and Part 213 programs, technical knowledge of contaminant remediation; and knowledge of policies and procedures.Responds to requests for information and resolves problems relating to the Part 201 and Part 213 enforcement programs with the public, RRD staff, and federal and state agencies.Duty 3General Summary of Duty 3% of Time5Participates in and provides training sessions to enhance and maintain speaking and professional and technical skills relating to understanding all aspects of Parts 201 and 213, the rules for both statutes, corporate environmental liability; negotiation tactics; and the components of legally binding agreements used in the Part 201 and Part 213 programs.Individual tasks related to the duty.Attends and participates in District Enforcement Coordinator Committee (DECC) meetings.Participates in RRD policy-making discussions. This position, with management oversight, represents EGLE in Part 201 and Part 213 enforcement proceedings, negotiations and settlement conferences. Additional duties of this position will include review and coordination of bankruptcy claims and citizen suits filed under Part 201, Part 213, or other state and federal laws and regulations. The person in this position will interact with staff from the Department of Attorney General (DAG) office, as necessary, to complete the tasks outlined above. Knowledge of database applications is required in order to enter and manipulate enforcement data and related materials and to provide staff and the general public with access to our enforcement actions related to environmentally impacted properties within the state.22.Indicate specifically how the position’s duties and responsibilities have changed since the position was last reviewed.This position is currently vacant. The primary duties of this position will be case coordination as outlined in Duty #1. 23.What is the function of the work area and how does this position fit into that function?The Enforcement Unit (EU) is responsible for the compliance and enforcement of Parts 201 and 213 of the Natural Resources Environmental Protection Act (NREPA), the Comprehensive Environmental Response, Compensation, and Liability Act, 1980 (CERCLA) and other state and federal laws. In addition, the case coordinator will provide expertise to the department, division and Attorney General on matters relating to the legal and administrative elements for the enforcement of Part 201 and Part 213, including the recovery of costs incurred by the state for response and oversight activities conducted by the state at sites of environmental contamination.This position is responsible for pursuing and tracking enforcement cases to compel compliance with Parts 201 and 213. This position represents the department in enforcement proceedings and serves as a liaison with the DAG. The work product generated by this position is a component of the legally binding agreements required by Part 201, Part 213 and CERCLA to resolve parties’ obligations at sites of environmental contamination. 24.What are the minimum education and experience qualifications needed to perform the essential functions of this position?EDUCATION:Possession of a bachelor's degree in the biological sciences, engineering, physical sciences, resource development, or resource management.ORPossession of a bachelor's degree in any major with at least 30 semester (45 term) credits in one or a combination of the following: biochemistry, biology, botany, chemistry, crop and soil science, engineering, environmental health, environmental science, forest management, geology, ecology, meteorology, microbiology, physics, remote sensing, resource development, resource management, toxicology, or zoology.EXPERIENCE:9 level: No specific type or amount is required.10 level: One year of professional experience equivalent to an Environmental Quality Analyst 9.P11 level: Two years of professional experience equivalent to an Environmental Quality Analyst, including one year equivalent to an Environmental Quality Analyst 10.KNOWLEDGE, SKILLS, AND ABILITIES:The ability to interpret and apply environmental regulations is an important skill related to this position. Specific knowledge of Part 201 and/or Part 213 of NREPA and its administrative rules, policies and procedures and knowledge of the federal Comprehensive Environmental Response, Compensation, and Liability Act would be beneficial.
