OFFICIAL PROCEEDINGS OF THEBOARD OF COUNTY COMMISSIONERSMCKENZIE COUNTY, NORTH DAKOTAAPRIL 4, 2013The Board of Commissioners of McKenzie County, North Dakota met at the Courthouse in Watford City, North Dakota on April 4, 2013. Present: Commissioners Anderson, Cayko, Chinn, Lawlar and Nordby, Auditor Svihovec and Deputy Auditor Wold. Chairman Anderson called the meeting to order at 9:00 a.m.Treasurer Grantier presented the treasurer’s report along with a department update. The Commission agreed to close the office at 3:45 p.m. to title work with the remainder of the Motor Vehicle Department closing at 4:00 p.m.Tax Director Lovaas discussed a proposal from Forsgren Associates, Inc. to assist the County with establishing protocols, documenting the location and compliance of the temporary housing units, and administering the program on behalf of the county. Moved by Nordby and seconded by Cayko to approve the contract with Forsgren for contracting administration of temporary housing permit program in the amount of $60,000.00. All voting aye, motion carried.Moved by Lawlar and seconded by Chinn to approve the treasurer’s report, minutes and bills with the exception of the Kennedy Scales, Inc. bill. All voting aye, motion carried.Moved by Cayko and seconded by Nordby to approve a contract with Wenck Associates Inc. in the amount of $48,500.00 for updating the Hazardous Mitigation Plan as presented by Emergency Manager Samuelson. All voting aye, motion carried. Moved by Cayko and seconded by Nordby to appoint Construction Engineers of Grand Forks, ND as the Construction Managers on the courthouse expansion project. All voting aye, motion carried. Paul Deutsch, Basin Brokers, presented a proposal for the purchase of the property adjacent to the courthouse located at 101 5th St NW, Watford City, ND. The purchase price is $310,000.00 plus the County will pay $1,500.00 towards sellers moving expenses and for the inspection of the property located at 716 2nd Ave NE. Basin Brokers will not charge commission on the sale of the 5th St NW property. The closing date will be June 15, 2013. Moved by Cayko and seconded by Lawlar to proceed with the purchase of the property south of the courthouse. All voting aye, motion carried. Chairman Anderson reported that a copy of a petition which as mailed to the ND Dept. of Health with approximately 200 signatures addressing concern with the Ideal Oilfield Disposal, LLC. wa s also received at the Auditor’s Office. Moved by Chinn and seconded by Lawlar to award the bid to Foley Brothers in the amount of $28,475.00 to add an entrance addition to the Water Resource/Storage building. All voting aye, motion carried.HD Director Giffin gave an update on employee status in various departments. Clerk of Court Roos and Deputy Clerk Lawlar presented a request for two part-time employees to address back log in their department and future maternity leave of two employees. Moved by Nordby and seconded by Cayko to approve the request for two part-time employees in the amount of $22,000.00. All voting aye, motion carried. County owned mobile home usage was discussed. At this time there are two units available. One is intended for the Engineer when he comes on board and the Commission agreed to rent the other unit to Giffin on a weekly basis. Giffin will prepare a plan for the county units in Wolf Run Village. Individuals from the Sweet Crude Travel Center were in attendance as the Commission considered their application for off sale beer and wine with Sunday sales liquor applications. Moved by Cayko and seconded by Chinn to approve the liquor applications from Sweet Crude Travel Center. Lawlar voting nay, motion carried.Moved by Nordby and seconded by Lawlar to approve a raffle permit for Pheasants Forever 248. All voting aye, motion carried.Moved by Chinn and seconded by Cayko to write a letter to the NDDOT supporting the City of Alexander’s preferred route which is the west route or route B. All voting aye, motion carried.Fuel bids were opened at 10:30 a.m. with bids received from Farmers Union Oil and Rolfson Oil. Moved by Chinn and seconded by Nordby to award the bid to Farmers Union Oil for all fuels at all locations. All voting aye, motion carried.Mike Dollinger will work with David & Gary Schwartzenberger to address road concerns in Terrace Subdivision. The Commission agreed to have a 20 mph sign posted on Terrace Road.Road issues and possibly a road agreement were discussed with Tervita regarding County Route 14. The Commission approved Mike Dollinger to negotiate with Plote Construction for the purchase of river gravel. Following lunch break Daryl Flagen addressed the Commission requesting an additional $20,000.00 for the East Fairview Lagoon. Moved by Cayko and seconded by Lawlar to approve Flagen’s request. All voting aye, motion carried.The public hearing for the Antelope Hills Subdivision re-plat was held. Moved by Nordby and seconded by Cayko to publish the resolution for the Antelope Hills Subdivision re-plat. All voting aye, motion carried. Preliminary plats were received for the BDR Star Subdivision, McKenzie Ridge Subdivision, Westwood Business Park Subdivision and Northwood Business Park Subdivision. The McKenzie Ridge Subdivision was tabled due to access issues and a public hearing was scheduled for May 7, 2013 at 1:00 p.m. for the remaining three subdivisions.Lloyd Clock presented a proposal to relocate the radar tower at Sather Dam and partner with Richland County, MT for a joint tower. The Commission supported the proposal and agreed to meet with Richland County Commission.The Commission approved having Trane install a cooling system in the Sheriff’s Office library in the amount of $8,739.00.Sheriff Rankin reported on recent incidents including 10 fatalities in McKenzie County since the beginning of the year.Kevin Magstadt, Wenck presented proposals for the landfill. The first proposal is for the design for a landfill security system, the design for a new truck drive through waste radioactive detection system, the design of required fencing for the newly purchased property to the south of the landfill and a dirt relocation plan for the excess dirt on the west side of the current operating landfill cell in the amount of $25,300.00. The second proposal includes hydrogeological/geotechnical investigation of the expansion property, soil survey, groundwater monitoring plan and Spill Prevention Pollution Control and Countermeasure Plan in the amount of approximately $204,000.00. Moved by Cayko and seconded by Chinn to approve the two proposals. All voting aye, motion carried.Kent Pelton, Newfield Production Co., requested to close a portion of the section line between Sections 11 & 14, T149N R98W. He has obtained a road use agreement and easement to the County for access around the closed section from the adjacent landowners. Moved by Chinn and seconded by Nordby to advertise to close a portion of this section line and to hold a public hearing on May 7, 2013. All voting aye, motion carried.Wayne Krygier and Jason Remingon were present as their liquor license applications were discussed. Wayne explained he has changed the name of his establishment from Mountain Lodge Camp to Watford Mountain Ridge LP. Moved by Cayko and seconded by Nordy to approve an on/off sale liquor license to the Watford Mountain Ridge LP. Lawlar voting nay, motion carried. Moved by Chinn and seconded by Cayko to approve an off sale beer application to Remington. During discussion Commissioner Nordby expressed his concern with Remington’s request; a plan should be presented to the Commission including the building and business plan not just the application. All voting aye, motion carried. HR Director Giffin presented a proposal to offer Suhail A. Kanwar the public works administration position with a salary of $140,000.00. Moved by Nordby and seconded by Chinn to approve the presented agreement with Suhail A. Kanwar. All voting aye, motion carried. State’s Attorney Johnson reported on his department and agreed to follow-up on a road survey on Flat Rock Road. Jim Johnsrud, EMS, reported on the current structure of the McKenzie County Emergency Response Department and future plans for the department including office space and living quarters.Gene Veeder gave an update on the Rural Water Department and Wolf Run Village.Auditor Svihovec presented a proposed 2013 Bankhead Jones Distribution worksheet for consideration of the Commission. Moved by Cayko and seconded by Chinn to approve the distribution as presented. All voting aye, motion carried.Tax abatement applications were presented for Alexander WF LLC (#3734) and Construction Services Inc. (#3735 & #3736). Moved by Lawlar and seconded by Cayko to approve Construction Services Inc.’s application. All voting aye, motion carried. Moved by Chinn and seconded by Nordby to approve the application submitted by Alexander WF LLC. All voting aye, motion carried.Moved by Lawlar and seconded by Cayko to approve Representative Drovdal’s request for the annual EMS responder’s appreciation night to be held in July. Chairman Anderson called the meeting to order at 5:00 p.m.The next set grievance meeting will be held May 9, 2013 beginning at 5:00 p.m.Chairman Anderson opened the hearing at 5:05 p.m. and explained the purpose of this hearing is to consider the grievances filed with the Auditor regarding Section 2.11 (2) Road Setbacks under Article II: General Provisions of the McKenzie County Zoning Ordinance. Testimony was provided by attendees with discussion following. Commissioner Lawlar moved and Commissioner Cayko seconded preparing an amendment to the zoning ordinance 2.11 which was adopted on March 18, 2013 to be considered at the May 7, 2013 meeting. The following amendment will be considered: 2.11 (2) The minimum setback for structures on U.S. Highway 85 and all other state highways shall be one hundred fifty (150) feet from the center of the road.
