CALL TO ORDER

Mr. West called the meeting to order at 10:03 a.m.

REVIEW OF MINUTES

The Council reviewed the minutes of the February 21, 2006 meeting. Mr. Fantini made a motion, seconded by Mr. Bauermeister, to approve the February 21, 2006 meeting minutes as amended. The motion was unanimously carried.

UNFINISHED BUSINESS

Discussion on Licensure of Tax Assessors

The Council discussed its responsibilities in establishing a work group to establish educational standards for assessors. Mr. West advised that he has contacted Mr. Al Valente and they hope to meet the week of April 17th with Mr. Lou Cox and two other individuals informally to find out what each is bringing to the table. Following this, the group will have a public meeting. DAG Adams will research whether or not the group can conduct this informal meeting first and will advise Mr. West of her findings.

Discussion on HB 347 – Regulation of Home Inspectors

There is nothing to report at this time. Mr. Witt would like to include information regarding this pending legislation in the April newsletter.

Update on Newsletter

The April newsletter will contain the new Rules and Regulations. Any Council member wishing to include any items in the April newsletter should contact Mr. Witt.

NEW BUSINESS

Hearing – Complaint No. 19-07-05 Against Brenda Hoopes

The hearing scheduled for 10:00 a.m. was continued. Mr. West expressed his appreciation to

the Council members in present for their attendance.

Discussion on Application for Temporary Practice Permit

The Council and DAG Adams were provided with a copy of the draft Temporary Practice Permit

application previously prepared when the Council wished to change the process to allow for use

of the Federal Registry for verification of licensure for temporary permits. DAG Adams will make

changes to the draft and it will be distributed to the Council prior to the April meeting.

Review of Applications

Mr. Painter made a motion, seconded by Mr. Witt, to approve the following applications:

Reciprocity/Certified Residential Real Property Appraiser:

Kenneth Milutin George Mitnick

The motion was unanimously carried.

Mr. Painter made a motion, seconded by Mr. Bauermeister, to approve the following applications:

Reciprocity/Licensed Real Property Appraiser:

John P. Parsons Neal Scott

Daniel Hill – contingent upon receipt of full fee payment

The motion was unanimously carried.

Mr. Witt made a motion, seconded by Mr. Cahall, to approve the following applications:

Certified Residential Real Property Appraiser:

Sue Parsons – to sit for exam

Bonnie Lewis – to sit for exam

Ronald Kuhn – to sit for exam

The motion was unanimously carried.

Mr. Fantini made a motion, seconded by Mr. Bauermeister, to approve the following applications:

James McCloskey – to sit for exam

The motion was unanimously carried. Mr. McCloskey will be notified that he must submit a copy of his prior log to show a total of 3,000 hours prior to his license being approved after he passes the exam.

Mr. West made a motion, seconded by Mr. Witt, to table the following application:

DAG Adams will further review the criminal history documentation and determine whether the applicant is barred from licensure. The motion was unanimously carried.

Mr. Bauermeister made a motion, seconded by Mr. Witt, to approve the following application:

The motion was unanimously carried.

Mr. Witt made a motion, seconded by Mr. Painter, to approve the following application:

David Decoursey – to sit for exam

The motion was unanimously carried.

The Council reviewed the following applications for which Temporary Practice Permits had been issued.

No action was taken by the Council. The above information was for informational purposes only under the new statute.

Review of Continuing Education Activities

A motion was made by Mr. Huston, and seconded by Mr. Witt, to approve the following continuing education applications:

The motion was unanimously carried.

Assignment of Complaints

Complaint No. 19-01-06 was assigned to Mr. Huston.

Complaint No. 19-02-06 was assigned to Mr. West.

Review and Discussion of Consent Agreements

Complaint No. 19-07-04

The Council reviewed the consent agreement reached between the Department of Justice and the respondent, William H. Thomas. Mr. Witt made a motion, seconded by Mr. Painter, to request that the agreement be changed in two ways. The Council will request that the respondent not only be required to take the 15 hour USPAP course but also must successfully complete the exam. The agreement had a provision regarding an extension of time to complete this action. The Council will request that the agreement be changed to state that if an extension is necessary that it must be referred to the Council for an extension of six months. Mr. Fantini, the contact person in this complaint, recused himself from the vote. The motion was unanimously carried.

Complaint No. 19-08-05

The Council reviewed the consent agreement reached between the Department of Justice and the respondent, Glenn T. Piper. Mr. Fantini made a motion, seconded by Mr. Huston, that the Council accept the consent agreement reached between the Department of Justice and the respondent in this complaint. Mr. Witt, the contact person to this complaint, recused himself from the vote. The motion was unanimously carried.

Complaint No. 19-03-04

The Council reviewed the consent agreement reached between the Department of Justice and the respondent, Thomas J. Kelly, X4-000285. Mr. Witt made a motion, seconded by Mr. Painter, that the Council accept the consent agreement reached between the Department of Justice and the respondent in this complaint. Mr. West, the contact person to this complaint, recused himself from the vote. The motion was unanimously carried.

Update on Complaint No. 19-09-05 – Referred to Dept. of Justice

Complaint No. 19-09-05 has been referred to the Department of Justice for further action.

Other Business Before the Board (for discussion only)

The Council will reschedule the May Council meeting until May 18, 2006, and the disciplinary hearing against Brenda Hoopes will be held during that meeting.

Mr. Earl Loomis will be offering a 2 hours Delaware Rules and Regulations course and adding one hour of ethics to the course. This better enables licensees to take two courses on the same day and obtain 7 hours of continuing education in one day. Mr. Witt inquired whether the course should be changed to a 3 hour requirement instead of a 2 hour requirement. No action was taken by the Council at this time.

Next Scheduled Meeting

The next meeting will be held on Tuesday, April 18, 2006 at 9:30 a.m. in Conference Room A, second floor of the Cannon Building, 861 Silver Lake Boulevard, Dover, Delaware.

Adjournment

There being no further business, Mr. Witt made a motion, seconded by Mr. Huston, to adjourn the meeting at 11:10 a.m. The motion was unanimously carried.
