Westfall Township, Matamoras, PADecember 7, 2020The Regular meeting of the Westfall Township Board of Supervisors was held Monday, December 7, 2020 at 7:01 pm. The meeting was held in person at the Westfall Township Municipal Building at 102 LaBarr Lane, Matamoras, PA with all following CDC Guidelines.Those present were Chairman, Robert Melvin, Vice Chairman, Jerry Dotey; Supervisors; Paul Fischer and Richard Roa; Solicitor, Robert Bernathy; and Secretary, Jodi Manheim. Also present were Road Master, Keith Rodriguez; Westfall Township Fire Department President, Bill Koferl; Westfall Township Fire Chief, Fred Jacobs; Jeff Cammerino, Zoning Officer; Treasurer, Scott Myer; Chief, Chad Stewart, Eastern Pike Regional Police Department; John Dalton. There were approximately 2 members of the general public present. The Board maintained 25 people maximum in the room at one time to comply with the CDC Guidelines. Supervisor Paul Schaldonat was absent. Mike Fischetta, EMC, was also absent.The last executive session was held on December 7, 2020 at 6:40 pm, just prior to the meeting, for potential litigation matters. APPROVAL OF AGENDA:Chairman Melvin removed #9 under New Business. He also added “Letter to DVSD” as #9 under New Business. A motion was made by Vice Chairman Dotey to approve the revised agenda. The motion was seconded by Supervisor Fischer and carries with all in favor. PUBLIC COMMENT: Mr. Dalton addressed the Board and presented a printout to each Supervisor. The printout referred to the funding of the Eastern Pike Regional Police Department and the split between Matamoras Borough and Westfall Township. He noted that Matamoras Borough had every opportunity in the past several years to address the split percentage but since they failed to do so which resulted in a loss of funds on their part. Mr. Dalton stated he would address this matter at the Matamoras Council meeting tomorrow evening. He also noted that Matamoras recently tried to make changes to the funding split agreement and that the rules cannot be changed “mid game”. Chairman Melvin thanked Mr. Dalton for his comment.MINUTES: A motion was made by Supervisor Roa to approve the November 2, 2020 Regular Meeting Minutes. The motion was seconded by Vice Chairman Dotey and carries with all in favor. TREASURER’S REPORT: Mr. Myer gave the report through the month of December, 2020. Mr. Myer noted the following:Real Estate Taxes received are over 100% of budgetReal Estate Transfer tax received is $130,000 which is $70,000 over budgetThe FEMA grant funds were received in the amount of $57,000+ A motion was made by Supervisor Fischer to approve the Treasurer’s Report through the month of December, 2020. The motion was seconded by Vice Chairman Dotey and carries with all in favor. POLICE REPORT: Chief Stewart gave the report for the month of November, 2020 which reflected the following:Miles Patrolled: 5,868YTD: 73,647Motor Vehicle Accidents: 16YTD: 138Calls for the Month: 161YTD: 1,999Westfall: 113Matamoras: 48A motion was made by Supervisor Roa to approve the Eastern Pike Regional Police report for the month of November, 2020. FIRE DEPARTMENT: Chief Jacobs gave the report for November, 2020 which reflected the following: Automatic Fire Alarm-9; Chief Investigation-3; CO Alarm-1; Landing Zone-1; Structure Fire-3; Vehicle Accident-2; Vehicle Fire-2; Wires Down-3Total: 24Year to Date: 237Man Hours: 45Man Hours YTD: 575EMS Calls for November, 2020:Delaware Township-1; Matamoras Borough-5; Milford Township-1; Orange County-1; Shohola Township-1; Westfall Township-28Total Calls for November: 37Year to Date: 738Man Hours: 30Man Hours YTD: 1060Westfall/Matamoras EMS Report:-Westfall Ambulance responded to 6 calls in Westfall Township and 5 calls in Matamoras Borough-Port Jervis Ambulance responded to 21 calls in Westfall Township and 17 calls in Matamoras Borough-There was one call where both ambulances responded in Westfall TownshipTraining Report: -Three in house training night for a total of 55 training hours-hosted a rural water movement class with Matamoras, Delaware and Montague fire departments with about 10 members from our department and 20 from the other departments. The class was 8 hours long and reviewed tanker and drafting operations. Other News: Last week the department received delivery of a new brush truck. It is a 2020 Chevy 4500 with a 200 gallon skid unit on it. This truck will be used for brush fires, EMS and police assists, traffic control, wires down calls and many other incident types where the larger trucks aren’t needed which will help preserve the life of the larger more expensive trucks. We hope to have it in service by the end of the year. The Department has also been awarded the LT DiBernardo grant in the amount of $11,725. This grant will help the Department purchase safety equipment in the form of Personal Safety Rope Systems or better known as bailout systems. These are used when you become trapped on an upper floor and have to bailout of a window quickly. Chairman Melvin stated that as of January 3, 2021 the Port Jervis Ambulance Contract will be terminated. A motion was made by Vice Chairman Dotey to send a letter to the Port Jervis Ambulance Corps. to terminate the Ambulance Services Contract effective January 3, 2021. The motion was seconded by Supervisor Fischer and carries with all in favor. Chairman Melvin directed Jodi Manheim to draft and send the letter as soon as possible. A motion was made by Vice Chairman Dotey to approve the Westfall Fire Department Report for the month of November, 2020. The motion was seconded by Supervisor Roa and carries with all in favor. HIGHWAY DEPARTMENT: Keith Rodriguez gave the report for November, 2020 which reflected the following: Removed undersized culvert pipe at Burger end of emergency road and replaced with larger ped emergency road with millings and rolled to complete the roadSalt spreaders installed in all trucksFilled pot holes Looking to purchase three Honda generators to power the traffic signals during power outages. Cost proposal of $2,841.63.A motion was made by Vice Chairman Dotey to approve the Highway Department Report for November, 2020. The motion was seconded by Supervisor Fischer and carries with all in favor. Brief discussion was held regarding the need for the emergency generators. Chairman Melvin directed Jodi Manheim to review the traffic signal maintenance agreement to confirm the responsible party for payment reimbursement for the generator purchase. A motion was made by Supervisor Fischer to approve the purchase in the amount of $2,841.63 from Montague Tool and Supply Company of three Honda 2200 Emergency Generators. The motion was seconded by Vice Chairman Dotey and carries with all in favor. BUILDING/ZONING DEPARTMENT: Jeff Cammerino gave the Building/Zoning Report for the month of November, 2020 which reflected the following:2 Building Permits totaling $67,267.00 in fees2 Zoning Permits totaling $150.00 in feesTotal Fees Received: $67,417.00A motion was made by Supervisor Roa to approve the Building/Zoning Report for November, 2020. The motion was seconded by Supervisor Fischer and carries with all in favor. EMERGENCY MANAGEMENT: Mike Fischetta was not present. Chairman Melvin read the report for November, 2020 which reflected the following:There were no calls for the month of November. A motion was made by Supervisor Fischer to approve the Emergency Management Report for the month of November, 2020. The motion was seconded by Vice Chairman Dotey and carries with all in favor. CORRESPONDENCE: On desk for reviewOLD BUSINESS: Act 537 Plan Draft-Advertise Notice for Public Comment: Solicitor Bernathy reviewed the notice. A motion was made by Supervisor Fischer to approve the advertising notice for the Act 537 Plan Extension Public Comment Period and advertise same. The motion was seconded by Supervisor Roa and carries with all in favor. The public comment period will be from December 11, 2020 through January 14, 2021. This matter will be placed on the agenda for the February 1, 2021 Supervisor Meeting. Act 537 Plan-Consideration of Mandatory Connection to Sewer Extension: Discussion followed. Chad Stewart stated a mandatory hookup would help with funding of the project. He also noted any construction within 100 feet of the line would be required to hook up. Tap in fees are based on usage and monthly fee for gallon usage. He stated the tap in fee for a residence is $1,600 and $40 per month service fee. Commercial properties are based on usage. Brief discussion followed. A motion was made by Supervisor Roa to include wording in the Act 537 Plan Extension that it is the Supervisor/Township’s intention to require a mandatory hook up for new construction and that there will be a future ordinance enacted. The motion was seconded by Vice Chairman Dotey and carries with all in favor. 2020 Low Volume Road Program Contract ($8,500 Grant for Bluestone Boulevard Project): A motion was made by Vice Chairman Dotey to approve the Low Volume Road Program Contract. The motion was seconded by Supervisor Fischer and carries with all in favor. NEW BUSINESS:Adoption of 2021 Budget-Resolution 2020-7 and 2020-8: Chairman Melvin read both Resolutions. He noted that tax mills will be held flat for 2021. A motion was made by Supervisor Fischer to approve Resolution 2020-7. The motion was seconded by Vice Chairman Dotey and carries with all in favor. A motion was made by Supervisor Roa to approve Resolution 2020-8. The motion was seconded by Supervisor Fischer and carries with all in favor. Pike Health Properties, LLC-Bond Release Request #9: Brief discussion regarding curbing issue. It is Mr. Cozza’s position that the remaining bond amount will cover any curbing issues. A motion was made by Vice Chairman Dotey to approve the Pike Health Properties, LLC Bond Reduction Request in the amount of $250,832.86 with the remaining bond amount to be $436,460.43. The motion was seconded by Supervisor Fischer and carries with all in favor. R.C. Lain-Insurance Invoice-Mill Rift FD Quarterly Payment: A motion was made by Supervisor Fischer to approve payment in the amount of $2,090.00 for the Mill Rift FD Quarterly Insurance Invoice. The motion was seconded by Vice Chairman Dotey and carries with all in favor. Mr. Koferl questioned the assets/vehicles covered by the policy. Chairman Melvin directed Jodi Manheim to obtain a copy of the insurance policy for review. Westfall Township Volunteer Fire Department Relief Association-Compliance Audit: Chairman Melvin stated the audit is completed and all is good and very compliant. This has been noted for public knowledge.No action needed or taken. Mill Rift Volunteer Fire Department Relief Association –Compliance Audit: A motion was made by Vice Chairman Dotey to direct Solicitor Bernathy to prepare a letter to the District Attorney to review the Compliance Audit. The motion was seconded by Supervisor Fischer and carries with all in favor. Legal Notice Posting for Organization Meeting/Auditor Meeting/Planning Organization Meeting: Chairman Melvin read the notice. A motion was made by Supervisor Fischer to approve the meeting notice and advertising same. The motion was seconded by Supervisor Roa and carries with all in favor. Thank You Letter to Senator, Lisa Baker for Monroe County LSA Grant Support: A motion was made by Vice Chairman Dotey to send a thank you letter to Senator Baker. The motion was seconded by Supervisor Fischer and carries with all in favor. Camera Monitor-Township Office: A motion was made by to approve the purchase up to $1,000 of a computer/monitor for the township building camera system. The motion was seconded by Supervisor Fischer and carries with all in favor. Letter to Delaware Valley School District: Chairman Melvin stated that there was a recent smoke situation at the DVSD and the Fire Department was not notified which may affect the health, safety and wellbeing of the occupants of the school. The Fire Department should always be notified. A motion was made by Supervisor Road to direct Solicitor Bernathy to send a letter to the Delaware Valley School District regarding this matter. The motion was seconded by Vice Chairman Dotey and carries with all in favor. SUBDIVISION/LAND DEVELOPMENT/CONDITIONAL USE-REVIEW AND ACTION: Shop Rite Store-Minor Revision-Field Change: This matter has been reviewed by Alternate Township Engineer, Al Handy, Twin Oaks Consulting and Westfall Planning Commission. The applicant has removed a transformer in the rear of the project and replaced it with loading dock surface. As per Twin Oaks Consulting, LLC review letter dated December 7, 2020, the revision does not negatively impact or significantly change the intent of the originally approved application. It is Mr. Handy’s recommendation to insert the revised plan sheet into the originally approved application plan set. A motion was made by Supervisor Fischer to approve the field change. The motion was seconded by Vice Chairman Dotey and carries with all in favor. EXECUTIVE SESSION: None called.
