Call To Order

Chairman George Fair called the regular meeting of the Commission of Real Estate Appraisers, Appraisal Management Companies, and Home Inspectors to order at 10:40 a.m.

Introduction of Charles Corbin

Administrator Schott introduced Charles Corbin to the Commission members. Ms. Schott advised that Mr. Corbin was hired as the Commission’s new investigator. The members welcomed Mr. Corbin to the Commission’s staff.

Approval of Minutes

The minutes of the business meeting held on June 11, 2013 were approved without corrections. A Motion was made by Commissioner Grewell, seconded by Commissioner Hauser and unanimously carried that the minutes of the business meeting be approved without corrections.

Real Estate Appraiser Complaint Committee Report

Commissioner Rush reported to the Commission that the Appraiser Complaint Committee met prior to the public meeting and reviewed many items of business, which had been placed before the Committee. The disposition of which was as follows:

Complaints - 76 cases were reviewed;

4 cases were dismissed;

1 case was referred to informal hearing;

3 cases were referred to pre-charge;

4 cases were referred to investigation;

64 cases were tabled.

The Appraiser Complaint Committee met prior to the public meeting in Executive Session, pursuant to State Government Article, Annotated Code of Maryland, §10-508(a)(7), to receive the advice of counsel regarding the above-mentioned matters. A Motion was made by Commissioner Grewell, seconded by Commissioner O'Farrell that the Commission accepts the report and recommendations of the Appraiser Complaint Committee. This motion passed by a unanimous decision.

Appraiser Education/Application Committee Report

Commissioner Rush reported that the Appraiser Education Committee met on this date and reviewed and approved 9 courses. A Motion was made by Commissioner Grewell, seconded by Commissioner O'Farrell and unanimously carried that the Commission accept the recommendations of the Real Estate Appraiser Education Committee.

Home Inspector Complaint Committee Report

Commissioner Grewell reported that the Home Inspector Complaint Committee met prior to the public meeting and reviewed five items of business, which had been placed before the Committee. The disposition of which was as follows:

Complaints - 1 case was referred to pre-charge;

4 cases were dismissed.

A Motion was made by Commissioner Brauning, seconded by Commissioner Rush and unanimously carried that the Commission accept the recommendations of the Home Inspector Complaint Committee.

New Business

Proposed Action COMAR 09.19.02.04 Continuing Education - Appraisers

The Commission was provided with the draft text for proposed action concerning continuing education for appraisers under COMAR 09.19.02.04. Administrator Schott recommended that the Commission consider promulgating a regulation to amend the language pertaining to continuing education requirements for appraisers. The intent of the language is to specifically require that an appraiser complete the prescribed 42 hours of continuing education prior to filing an application for renewal of a license or certificate, notwithstanding the expiration date of the license or certificate being renewed. The proposed text also advises of the consequences of failing to comply with the continuing education requirements.

A Motion was made by Commissioner O'Farrell, seconded by Commissioner Hauser and unanimously carried that the Commission promulgate the regulation as proposed under COMAR 09.19.02.04 Continuing Education for Appraisers.

Administrator Schott further informed the Commission that she placed a work order request to amend the electronic licensing renewal script that closes matches the text of the proposed regulation.

COMAR 09.36.03 Fees - Home Inspectors

Administrator Schott advised the Commission that the State of Delaware is now licensing home inspectors, which has resulted in an influx of requests for letters of good standing from home inspectors licensed by the Commission wishing to seek a Delaware home inspector license. Administrator Schott advised that appraisers must pay a $15 fee in order to obtain a letter of good standing and the Commission might consider promulgating a regulation to require a similar fee for home inspectors.

A Motion was made by Commissioner Grewell, seconded by Commissioner Rush and unanimously carried that the Commission promulgate a regulation under COMAR 09.36.03 to establish a fee of $25 for a letter of good standing prepared for a home inspector.

Executive Session

A Motion was made by Commissioner Grewell, seconded by Commissioner Brauning and unanimously carried that the State Commission of Real Estate Appraisers, Appraisal Management Companies, and Home Inspectors go into executive session at 11:00 a.m. in the 2nd floor conference room, 500 N. Calvert Street, Baltimore, MD 21202. The purpose of the meeting was to receive advice of counsel. The meeting was permitted to be closed pursuant to State Government Article, Annotated Code of Maryland, §10-508(7).

The Commission reconvened its regular meeting at 11:40 a.m. A Motion was made by Commissioner Grewell, seconded by Commissioner Brauning, and unanimously carried that the Commission accept the decisions rendered in Executive Session.

Adjournment

There being no further business to discuss a Motion was made by Commissioner Grewell, seconded by Commissioner Rush and unanimously carried that the meeting adjourn. The meeting adjourned at 11:45 a.m.
