Tampa Machinery Auction (TMA)Terms & ConditionsBiddingMost of the items we sell are in our live auction on the second Saturday of each month and most of these items are available for pre-bidding on our web site but there may be a few that will not be available for pre-bidding. There are also a few items that will be offered for sale by online bidding only and will not be in the monthly live auction.Bidding may be done in one of several different ways depending on how the item you are interested in is designated and how you are registered to bid. Items will be designated for bidding in one of three ways. They are as follows. (1) Live auction only: This means that you must attend the live auction on the second Saturday to bid on this item. You can search for these items by selecting 'Live bid only' for the 'Bidding Method' in the 'Inventory Search options'.(2) On-line only: This means that only internet bids will be accepted on this item and it will not be available for bidding at our live auction. You must submit a registration requesting authorization to bid on these items and on some items a deposit will be required before you are granted access to bid. (3) Pre-bid allowed: This means that an item that is scheduled to be in the live auction will also be available for bidders to submit a pre-bid prior to the live auction. This is normally done when someone is unable to attend the live auction. A refundable bid deposit will be required before access to bid will be granted. There are several different scenarios that can occur when pre-bidding and the following will explain each of them.(a) If yours is the only pre-bid on the item then the auctioneer will bid for you by proxy but will get his first bid from a live bidder. He will then bid against the live bidder for you by proxy. This means that you could get the item for less than or at your pre-bid amount or you could be out bid by a live bidder.(b) If you are the highest of two or more pre-bidders by exactly the bid increment amount, then the auctioneer will start the bidding at the live auction with your pre-bid. This means that you could get the item for your pre-bid or you could be out bid by a live bidder.(c) If you are the highest of two or more pre-bidders by more than the bid increment amount, then the auctioneer will start the bidding with you at the next highest pre-bid plus one bid increment. This means that you could get the item for less than or at your pre-bid amount or you could be out bid by a live bidder.No matter which bidding method you use, all the purchase terms still apply unless different terms are specified for the particular item you are bidding on. You should be sure to read all of the purchase terms carefully before placing a bid so that in the event you are the successful bidder, you will be prepared to complete the transaction according to the terms set forth.Failure to complete a transaction as set forth by the terms and conditions found here-in will result in the revocation of your bidding privileges.Payment Terms and ConditionsPayment must be made in full on sale day WITHOUT EXCEPTION. If you are unable to comply with these terms then please do not bid.Cash or certified funds are acceptable forms of payment that will allow you to remove your purchase right away. Any other payment method mentioned here may require that you leave your purchase here until payment is verified. Certified funds are instruments such as cashier's checks, traveler's checks and money orders. Any of these forms of payment may be subject to verification with the issuer which in most cases can not be accomplished on Saturday and therefore will prevent us from releasing the pany or personal checks are accepted but will require five business days to verify payment unless a letter from the issuing bank that guarantees payment is provided. A letter of reference, available funds, or line of credit will not be sufficient to verify payment.We do NOT accept debit cards, credit cards, drafts or third party checks so please do not ask us to take any of these as payment for your purchase.A wire transfer on Monday after the auction will be accepted as long as a company or personal check is given on auction day for us to hold. If we do not receive funds before 4:00 PM Monday the check will be processed and the wait period mentioned above will apply.Applicable sales tax will be collected on all transactions unless a valid resale tax exemption certificate has been provided prior to or at the sale. On titled items a valid Motor Vehicle Dealer license must also be provided to exempt the purchase from sales tax.Applicable title fees will be collected on all titled items unless a valid motor vehicle dealer license has been provided to us. The State/County fee is $78.25, the Agency fee is $25 and the Dealer fee is $15.License plates can be purchased or transferred at the time of sale at exactly the same rates the County charges. Proof of insurance coverage is required by law. The last registration is required to do a tag transfer if you already have a tag that is not assigned to another vehicle.If you choose not to buy or transfer a tag you will have to wait several weeks for your title registration to come to you in the mail before you can buy or transfer your own tag. You can request a fast title be issued for an additional $15 which will get your title to you within a couple of weeks.Internet buyers can pay by wire transfer or by hand delivering any form of payment listed above, with the same conditions as mentioned above. This must be done by no later than 5:00 pm Monday following the auction.General Terms and ConditionsAll items are sold AS-IS WHERE-IS WITH NO WARRANTY OF ANY KIND EITHER EXPRESSED OR IMPLIED. We do not inspect for defects but we will relay any information that we do have.You must be 16 or older with a valid photo I.D. issued by a local, state or federal agency to obtain a bidder number and gain admittance to the auction grounds. NO EXCEPTIONS!We do not allow children under the age of 16 on the auction grounds for safety reasons, so please do not bring your kids. Our lobby is not large enough to accommodate everyone's entire family.You can register for a bidder number in person on auction day or you can pre-register on this web site using the link at the top of the page. The web site registrations must be submitted before 5:00 pm Friday the day before the auction.We are open Monday through Friday from 8:00 am to 5:00 pm for visual inspection but some items may not be available until the day of the auction.Vehicles and equipment will only be demonstrated by our personnel on the sale day just prior to going on the auction block. So please do not attempt to start anything on your own.Some items may be available to qualified bidders for on-line pre-bidding. This feature is intended for bidders who are unable to attend the live auction but would still like to participate. Special terms and conditions will apply, so please read the bidding terms carefully. ................
