Overview of the Week at the Capitol

Week of February 21

Since last week only two additional bills have been brought forward bringing the 46th day of session total bills to 1337, still with only 6 signed into law.

Senate President Russell Pearce was able to get his Omnibus Immigration bill, SB1611, passed in the Senate Appropriations Committee Tuesday, February 22nd on a vote of 7-6. This bill was dropped at the end of the month and was described by President Pearce as a cleanup bill. Opponents of the bill state that it is far reaching and is much more severe than SB1070, the immigration bill that received nationwide attention.

Another late introduction bill, SB 1609, introduced by Senator Yarbrough, passed the Senate Finance Committee 3-1. SB 1609 is the Senate Republican’s version of pension reform and had unanimous opposition from the groups affected. The bill aims to increase the employee contribution, starting in 2014, to the retirement plans of Public Safety Personnel, Corrections Officer, and Elected Officials. It also would freeze cost-of-living increases in pensions. House Speaker Adams has a pension reform bill as well that is much different than the Senate version and is also opposed by the various employee stakeholder groups. Critics of both reforms state that these moves are unconstitutional and break contracts that were given to these State employees many years ago. Proponents of the bill state that it is the only way to save the current pension system.

Pinal County is one step closer to receiving $5 million dollars of photo-radar money that would normally go to the GF as a result of Speaker Pro-Tem Montenegro’s HB 2718. Sheriff Babeu testified on behalf of the need for this funding to combat illegal human and drug smuggling that goes through Pinal County. All other counties that physically border Mexico are given additional funding from the Federal Government to finance border security. The Sheriff testified that this additional funding will go to puchase ground based radar as well as other essential equipment.

There was also a second Jobs Forum this week hosted by Representatives Forese and Dial. The guests this week included Steve Voeller of the Free Enterprise Club, Kevin McCarthy of ATRA, Glenn Hammer of the Arizona Chamber of Commerce and Eric Crown of Insight. The overall message these key leaders told the joint body of assembled Legislators was that the best tax policy is one of equality. Do not choose winners and losers but instead do broad based tax cuts or incentives. Mr. Voeller went so far as to say “Don’t underestimate the value of doing nothing.”

Week of February 28:

With the deadline to hear legislation in the committee of origin passing last week (House committees can no longer hear House bills; Senate committees can no longer hear Senate bills), both legislative chambers spent most of the week on the floor voting in Committee of the Whole (COW) and on 3rd Reads, sending over bills to the other chamber. Both the House and Senate made a significant dent in the long backlog of bills that had cleared the committee process, but were waiting for full consideration. Other than the House and Senate Rules Committees, hearing calendars were extremely light as legislation continues to crossover to the other chamber and be assigned to committee.

Budget Update

A joint House and Senate leadership budget proposal has been submitted to the Governor. The Governor’s budget plan was used as the skeleton for the proposal, but legislative leaders chose not to utilize the proposed accounting maneuvers, such as rollovers, to help balance the budget. Instead, approximately $600 in cuts were substituted for the accounting “gimmicks,” with education taking a larger hit rumored to be $200 million. The Governor and her staff are digesting the plan and according to legislators, her office was somewhat surprised at the level of cuts being proposed and does not appear to be embracing the plan. The Legislature is still working toward releasing the budget, which will be a 16 month budget to address FY11 and FY12, near the 60 day mark of the legislative session. They would like to move it quickly through the process. If there is not agreement on the budget with the Governor’s Office, then it would face a veto. It is doubtful that there are sufficient votes to override the veto, but there does not appear to be sufficient votes to pass the budget in the form that the Governor initially proposed.

The ultimate impact of the budget on Medicaid is still somewhat fluid. The AZ Hospital and Healthcare Association (AzHHA) has begun seeking support for the hospital/provider tax, but this concept has not gained much traction with legislators, who would rather see greater cost sharing from AHCCCS members in the form of co-pays, monthly premiums, penalties for not showing up to appointments with medical providers, and elimination of non-emergency transportation. The AzHHA has begun to focus on the Governor’s Office and has a meeting with the Governor next week to discuss their plan. While the Governor’s initial proposal to reduce eligibility for childless adults on AHCCCS (i.e. the Prop. 204 populations) has been embraced by Republicans, the Executive now appears to be moving toward wanting flexibility on eligibility standards for eligible AHCCCS members. Discussions about an enrollment freeze for AHCCCS members, similar to the KidsCare program, are taking place and April 1st could become the first day in a draw down plan for Arizona’s Medicaid program. The Governor is considering freezing enrollment for childless adults earning at 100% of the Federal Poverty Level as part of a phase down process that could eventually take 250,000 similar enrollees off of AHCCCS. To do this legally the State owes U.S. Centers for Medicare and Medicaid Services a phase down plan no later than March 31st. However, opponents of the idea, which include Legislative Democrats as well as advocacy groups do not believe that it is legal under Proposition 204 which passed by voters in 2000. That proposition gave benefits that exceeded the Federal minimum levels of Medicaid Assistance.

Arizona’s Economy

The State’s economy showed more signs of an upward trend with January marking the sixth consecutive month of year over year growth in general fund revenue collections. The sales tax appears to be the biggest contributor, showing its fourth consecutive month of growth as well as January’s increase being much higher than the months prior. State Treasurer Doug Ducey anticipates no cash flow problems for the rest of the fiscal year, and will not have to resort to daily borrowing as in the previous two years.

Senate Passes Controversial Gun Bill

Emotions ran high on the floor of the Senate on Thursday afternoon when they voted to pass SB 1201, Firearms Omnibus. In addition to several changes to Arizona’s gun laws, SB 1201 would allow gun owners to carry a firearm into most public buildings regardless of a notice of prohibition, unless all visitors either go through a metal detector or are screened by security personnel with hand-held wands.

The measure passed out of the Senate on a straight partisan vote, 21-8. Debate on the floor became emotional as both Democrats and Republicans invoked the memory of the Tucson shootings that took place two months ago. Several Democrats questioned the bill’s timing, especially right on the heels of the shooting of their former colleague, US Congresswoman Gabrielle Giffords; while Republicans defended the rights of gun owners to protect themselves at all times. SB 1201 will now move onto the House for consideration.

Senate Majority Leader Bundgaard May Face Charge of Domestic Violence

Senate Majority Leader, Scott Bundgaard was stopped and questioned by police last weekend when he and his girlfriend got into a dispute after leaving a charity event in Phoenix. Police were called to the scene where both Senator Budgaard and his girlfriend appeared to have suffered some minor physical injuries. Senator Bundgaard was not arrested at the scene because he is a sitting Senator during the Legislative session, however his girlfriend was arrested and charged with suspicion of domestic violence and later released and no charges have been filed at this time. While Senator Bundgaard was immune from arrest at the time of the incident, he still faces the possibility of domestic violence charges pending an investigation by Phoenix Police.

AHPA Key Issues:

Pension Reform

• HB 2726 public retirement systems; plan design (Adams) – HB 2726 has not moved since passing out of the House Employment and Regulatory Affairs Committee. The Speaker has been meeting with individual stakeholders to see whether common ground can be found with the employee stakeholder groups. Kelsey Lundy has met with Speaker Adams on two occasions and has discussed AHPA concerns with the bill as drafted, particularly the increase in contribution rate increases, COLA changes and elimination of DROP. She has also discussed the Arizona Police Association’s proposal and has encouraged the Speaker to adopt the APA’s proposed second tier for new hires. Now that SB 1609 has passed the Senate, it is expected that the Speaker will want to get his bill moving through the process and over to the Senate. It is unclear what, if any, amendments will be proposed or adopted on the House floor. It is rumored that the Speaker and Senator Yarbrough will be meeting next week to see if they can come to any agreement on the differences in their two proposals.

• SB 1609 retirement systems; plans; plan design (Yarbrough) – SB 1609 passed out of the Senate Finance Committee on Wednesday, February 23rd on party lines, 3-1. All of the employee groups, including AHPA, testified in opposition to the bill and each group focused on specific parts of the bill. (See special AHPA newsletter that went out on Friday, February 25th for full details.) This bill was then fast tracked and a closed caucus was held by the Senate Republicans on Monday, February 28th where members were asked not to offer any amendments on the floor to show their support for the Senate proposal over the one being moved by House Speaker Adams, HB 2726. The bill then went to COW on Wednesday, March 2nd and there was no discussion and then 3rd Read on Thursday, March 3rd and passed on a party line vote 21-5. Senator Yarbrough stated that this bill was needed to save the pension funds. Senator Kyrsten Sinema (D) stood in opposition to the bill and stated that it was unconstitutional and would end up in court. The bill will be transmitted to the House early next week.

• Budget – Rumors a circulating that the House and Senate leaderships have come to a tentative agreement on a budget that cuts and includes fund sweeps of $600 million above the Governor’s budget proposal. It is unclear at this point if the DPS budget is affected by the proposal, but there is significant support for the agency in the Legislature and many have indicated they would not like to see any further cuts to DPS.

• Union Dues Deduction Bills – SB 1365 paycheck deductions; political purposes passed out of COW with a floor amendment on March 1st. The floor amendment, which can be viewed at , exempts public safety employee groups from the provisions of the bill, including AHPA. Jimmy Chavez and Brian Livingston were instrumental in working with Senator Antenori on this amendment and protecting the rights of police officer associations. SB 1555 failed in the Senate Government Reform Committee 3-3 which was the other bill that took away the ability of employee groups to have their dues deducted from paychecks.

• SB 1013 capitol police; transfer – SB 1013, sponsored by President Pearce, would transfer capitol police from ADOA to DPS. SB 1013 was amended and passed out of the Senate Appropriations Committee on February 8th and passed out of COW with a floor amendment on March 2nd. Both issues of funding of the transfer and personnel transfer have been addressed in the bill as amended.

• HB 2718 public safety; equipment fund; appropriation - HB 2718, as introduced by Representative Steve Montenegro, appropriated $5 million in photo radar monies from the public safety equipment fund to Pinal County for illegal immigration efforts. The bill was amended, at the request of AHPA and DPS, in the House Appropriations Committee to take the monies from the GF portion of photo enforcement funds. It was inaccurately identified that there were excess funds from photo enforcement monies in the public safety equipment fund and when Representative Montenegro was shown that this would actually be a $5 million cut to the DPS budget, he was very willing to amend the bill and stated he never intended to potentially cut the DPS budget with his bill. The bill still has to go to COW and be 3rd Read in the House.

• SB 1353 moving violations; assessment; enforcement; equipment – Senator Antenori introduced SB 1353 which increases the assessment of a moving violation by $10, half of which will go the DPS public safety equipment fund and the other half will be distributed among local law enforcement agencies for public safety equipment. The bill is expected to be amended on the floor to address concerns from the courts and will raise the assessment from $10 to $13 with some of the money going to the courts to cover their administrative costs for administering the assessment. The bill is expected to go to the floor next week.

• Legislation Overview – With bills now mostly switched over to the other house, the over 160 bills being monitored by the AHPA is down to under 70. Any bills that did not make it through the committee in the House of origin by the end of last week were taken off the bill tracking list.

|The responsibility to regulate drug laboratory site remediation firms is transferred to the Board of Technical Registration's |

|newly established criminal investigations unit, from the Registrar of Contractors. Additionally, the criminal investigations |

|unit may investigate any criminal act related to the practice of professions regulated by the board. Municipalities may apply |

|to the Technical Registration Fund for money to remediate property where drug labs were found. After remediation, the board |

|shall place a lien on the property to recoup its remediation costs from the sale of the property. Establishes a civil penalty |

|($2000 max) for the first time the onwer of a drug lab property knowingly allows a notice of removal posted at the property to|

|tbe disturbed. The penalty for a second or subsequent instance of the notice being disturbed increases to a class 5 felony. |

|The criminal penalty for a person other than the owner who disturbs the notice is increased to a class 5 felony from a class 6|

|felony. Establishes that an owner of a property undergoing remediation who fails to disclose its status to a purchaser may be |

|subject to criminal prosecution. Penalties are also established for an owner to knowingly allow a child or vulnerable adult to|

|enter a drug lab property or for any other person to enter a drug lab property before remediation is complete. Establishes |

|additional penalties for entering the property, removing items, or removing a mobile home or R.V. from a site without approval|

|Amends Laws 2010, Chapter 211, that authorized the attorney general and governor to defend the state in any legal proceeding |

|challenging last year's S10170 (immigration; law enforcement; safe neighborhoods) to delete references to a terminal date for |

|the authorization. Effect is to make the authorization permanent. Additionally, the House speaker and Senate president are |

|authorized to hire lawyers to initiate legal proceedings or to appear on behalf of their respective chambers in any legal |

|challenge to S1070. Session law; does not amend statute; valid only for the life of the 50th Legislature. Retroactive to Jan. |

|A municipality or county sheriff may establish a continuous alcohol monitoring program for persons convicted of DUI (BAC of |

|0.08 of greater) or extreme DUI (BAC of 0.15 or greater). Eligibility standards to enter the program are established, |

|including having served at least 20% of the incarceration sentence. The period of monitoring shall be treated the same as |

|confinement in jail. The person shall bear all costs of testing, enrollment and monitoring. Also, the director of the Dept of |

|Corrections may establish rules by which prison inmates sentenced for violation of certain DUI statutes may be released into a|

|continuous alcohol monitoring program. |

|Various changes to statutes governing the Arizona State Retirement System, including ASRS members who receive or are eligible |

|to receive a retirement benefit from another public employee retirement system are ineligible to receive retirement benefits |

|from ASRS for the same period. Members who are performing qualified military service are not considered as having a severance |

|from employment for all ASRS purposes. ASRS members receiving a lump sum payment are eligible for group health insurance and |

|premium assistance. A retired member whose retirement benefits have been suspended because the member returned to work with an|

|ASRS employer must repay the ASRS for any benefits improperly received. The employer must pay contributions to the ASRS for |

|any retired worker who returns to work at a contribution rate determined by a formula calculated by the ASRS actuary. ASRS |

|members are not eligible for long-term disability under the system unless an initial claim is filed within 12 months of the |

|date of disability. ASRS is authorized to suspend or terminate a person's long-term disability benefits if the person does not|

|provide information requested by the system, the insurance carrier or the claims administrator. More. Appropriates $150,000 |

|S1520: AZ BACKGROUND CLEARANCE CARD |

|Creates an Arizona background clearance card (Card) and requires applicants for various licenses and positions to obtain a |

|Card from an authorized investigative provider licensed by the Department of Administration. In some instances, the Card |

|replaces the requirement for a fingerprint clearance card, and in other instances, it is another option in addition to the |

|fingerprint card. The licenses and positions include those related to CPS and foster care, teachers and other school district |

|personnel, child care providers, and various professional and health care licensees. Beginning January 1, 2012, the Dept of |

|Public Safety is required to provide, without cost, authorized investigative providers with the arrest records of individuals |

|arrested in Arizona for the purpose of the Card investigation. The DPS fingerprinting division is eliminated, and its duties |

|are transferred to authorized investigative providers. The name of the Board of Fingerprinting is changed to the Board of |

|Arizona Background Clearance Cards. Card applicants must apply directly with an authorized investigative provider and must pay|

|for the cost of the investigation. More. Due to a potential increase in state revenue, this bill requires the affirmative vote|

|of 2/3 of each house of the Legislature for passage. |

|Makes changes to various statutes related to immigration and demonstrating proof of legal residence in this country, |

|including, deleting the exclusion of certain federal programs (e.g., Medicaid) from the requirement that participants must |

|show proof of lawful presence. The effect is to make any person who receives a public benefit paid for from state or federal |

|monies (including public housing) subject to the requirement to demonstrate lawful presence in this county. Eliminates the |

|special treatment regarding citizenship documentation extended to American Indians, the elderly and disabled. It is a class |

|one (highest) misdemeanor for an illegal alien to operate a motor vehicle in this state. Punishments include: the vehcile is |

|forfeited and the person is subject to a 30-day jail sentence and must pay costs of incarceration. The Dept of Transportation |

|must have proof of lawful presence from an individual wishing to title or register a motor vehicle. The identification |

|required to enroll a child in school is limited to one of 12 specific items. (Formerly, statute permitted "other reliable |

|proof of the pupil's identity and age.") Similarly, the Board of Regents is prohibited from admitting anyone who does not show|

|one of 11 specific items. The attorney general is required to give notice to any employer who does not provide proof that the |

|employer is registered with and is participating in the E-Verify Program. A consular identification card is not acceptable as |

|a valid form of identification. More. |
