Non 10+1ADMINISTRATIVE PROCEDURE 6750 SEQUOIAS CCD Business PARKING These procedures are intended to promote safe and orderly movement of traffic within District property for the safe and orderly parking of vehicles. All applicable provisions of the California Vehicle Code are expressly applicable both on and off paved roadways. Parking of motor vehicles and bicycles is limited to specially designated areas. Fee permits are required. Vehicles parked in violation of the provisions of this code are subject to fines, towing, or impoundment. All persons entering the College premises in/on a motorized vehicle are charged with knowledge of the provisions of this procedure and are subject to the penalties for violations of such provisions. PERMITS: Semester permits may be purchased in two ways: On-line – See District Police website. Over-the counter: o Visalia Campus - Cashier’s Office (Sequoia South – Rm 102). Take receipt to the District Police Department (Blue Oak) to obtain permit. Tulare Center - Student Services, Building A. Hanford Center - Hanford Hub, Vocational Building. Parking on all COS property is by permit only. One permit is needed for each vehicle. Permits ARE NON-TRANSFERABLE from vehicle to vehicle A permit does not guarantee a parking space. Permit MUST BE ATTACHED to the driver’s side lower windshield. Alternatives to purchasing a semester permit include: Purchase of daily permits from dispensers (dollar bills or credit card only), or on-line purchase of daily permit. An additional semester permit may be purchased at a reduced price once proof is provided that the second vehicle is registered to the same residence. If you pay for a daily permit and the machine fails to issue a permit, notify District Police Department immediately. Refunds: To obtain a refund for a parking permit, bring or mail the receipt to the District Police Department on the Visalia Campus. If approved, a check will be mailed within 2-3 weeks. The original permit or a remnant of it must be returned. No refunds for semester permits will be made after the second week of each semester. Lost Permits: May be replaced for the same price as the original permit. Stolen Permits: Report to the District Police Department immediately. To avoid being charged for a replacement permit, a police report must be provided which documents the theft. Faculty/Staff Permits: Faculty and staff may obtain up to two parking permits at no charge. Permits are available on-line at the District Police website. Vehicles displaying a faculty/staff permit may park in areas designated as reserved (yellow curbs/stalls) and student areas (white curbs/stalls). Vehicles displaying a faculty/staff permit must comply with all other parking regulations. RESTRICTED PARKING: City streets adjacent to the campuses may be restricted for RESIDENT PARKING ONLY. These streets have posted signs. Vehicles that do not display a Resident Parking Permit issued by the city or county will be cited by the authorized city police department. Vehicles may also be subject to towing for violation of these ordinances. Area businesses request COS students not use their parking lots while attending classes. Violator's vehicles may be towed by those businesses at the owner's expense. DESIGNATED PARKING AREAS: RESERVED: COS staff parking only (yellow curb/stalls). DISABLED: Disabled only-designated by signs and blue curb/stalls space marking – CA Disabled placard / plate required. MOPEDS-MOTORCYCLES: To be parked in designated areas (orange) only. Permits are not required when in motorcycle parking. LOADING ZONE: White curb - Time limited. 20-MINUTE ZONE: Visitor parking, green curb. GENERAL PARKING: Remaining areas of the campus with white painted spaces are open to student and visitor parking with a permit. GUEST AND VISITOR PARKING: Free limited parking privileges may be given to visitors and guests if arrangements are made in advance with the District Police. HOURS OF ENFORCEMENT (Section 101): All traffic and parking regulations are enforced 24 hours daily / 7 days weekly. Parking permits are enforced from 6:00 AM to 10:00 PM / M-F. Parking permits are not required during weekends. VIOLATIONS & FINES: *Parking fines include mandatory state assessment fees pursuant to GC section 76000(b), GC section 70372(b), and GC section 76000.3Section Violation Fine Section 102 Disobedience of Campus Police Officer – Any person who willfully disobeys a lawful order of District Police. $45.00 Section 103 Speed Limit – 10 MPH on all COS District Property unless posted otherwise. $75.00 Section 104 No Visible Parking Permit – All vehicles parking on District property must have a valid permit. Permits must be properly displayed. Failure to display permits in accordance with the permit instruction constitutes a non-permitted vehicle. $35.00 $47.00Section 105 Display of Unauthorized/Altered Parking Permit – The display of any permit which has been altered in such a manner as to appear to be a valid District permit. $100.00 $112.00Section 107 COS Staff Only Parking (yellow curb/stalls) – Parking in staff/reserved parking without the proper staff permit. $35.00 $47.00Section 108 Motorcycle/Moped Required to Park in Orange- Painted Spaces – Motorcycles/mopeds shall park in orange motorcycle parking areas unless such vehicle is displaying a valid general parking permit. $35.00 $47.00Section 110 Misuse of Passenger Loading Zone – Vehicles using loading/unloading zones (white curbs) shall remain in loading zones for that time which is necessary to load/unload items. $35.00 $47.00Section 111 Misuse of 20-Minute Parking Zone (green zone) – Vehicles will not exceed 20-minutes in green zone parking. $35.00 $47.00Section 112 Parking in Red Zones – Parking or stopping in red zones is not permitted at any time. $35.00 $47.00Section 113 Driving/Parking Against Traffic Flow/Head-in Parking Only – All vehicles parked on District property shall be parked either with the flow of traffic (diagonal and parallel) or with the front of the vehicle facing in toward the center of the parking stall. No vehicle shall drive against the stated flow of traffic. $35.00 $47.00Section 114 Failure to Park Within Allotted Space – All vehicles shall park within the allotted spaces of the parking space. $35.00 $47.00Section 115 Parking/Driving in Authorized Areas – No vehicle, except those exempted by special permit shall park or drive on any area not designated a parking lot or public access roadway. $45.00 $57.00Section 116 Abandoned Vehicles Towed – Any vehicle left abandoned shall be towed at the owner’s expense. Towed at owner’s expense Section 117 Vehicles Blocking Traffic Towed – Any vehicle blocking or impeding traffic flow shall be towed at the owner’s expense. Towed at owner’s expense Section 118 Persistent Violators (5 unpaid citations) Vehicles Towed/Immobilized – Any vehicle which has five unpaid parking violations shall be towed or immobilized until such time as the parking fines are paid in full and a tow release fee or immobilized vehicle fee of $100.00 is paid in full. Any vehicle immobilized and not released prior to 11:59 p.m. nightly shall be towed at the owner’s expense and a tow release fee accessed. All tow/storage fees are the responsibility of the owner. Towed at owner’s expense Section 119 Sleeping in Vehicles (10 p.m. – 8 a.m.) – No person shall sleep or stay overnight in any District owned parking lot or property without the express written permission of District Police. $35.00 Section 121 Unauthorized Means of Conveyance – Bicycles, skates, skateboards, or similar methods of conveyance are not to be ridden on District roadways, service roads, sidewalks, landscaped areas, lawns or other paved or hard surfaced areas. $25.00 Section 122 Loud Music/Noise from Vehicles – Any vehicle emitting loud music or sound which may be heard from more than 50 feet away. $40.00 Section 123Misuse of Disabled Parking – Parking a vehicle in designated disabled parking without proper disabled designation for the vehicle or with disabled placards not belonging to the driver without the lawful owner of the placard/plate present.$330.00 $342.00Section 124 Littering – No person shall throw or deposit bottle, can, garbage, glass, nail, offal, paper, wire, or any noisome, nauseous, or offensive matter of any kind, or any lighted or non-lighted cigarette, cigar, match, or any flaming or glowing substances, except in approved receptacles. $100.00 CONTESTING OF CITATIONS: Persons wishing to contest a parking citation may request an administrative review within 21 days of issuance by filing a first-level appeal on-line via the District Police website. A decision will be emailed to the email address provided by the appellant. Persons wishing to contest the first-level appeal decision must request a second-level appeal within 21 days of the date the decision was emailed. The second-level appeal must be filed in writing with the District Police Department. The citation must be paid prior to the second-level appeal being filed, but the payment will be refunded if the citation is overturned. PAYMENT OF CITATIONS Instructions for paying a citation can be found on the District Police website. See “Pay a Parking Citation”. PAYMENT PLANS: The registered owner or person responsible for parking citations, who qualify for indigent status, may enroll in a payment plan. Citations associated with the vehicle, registered owner, or person responsible may be included in the payment plan at the time of enrollment. If additional citations are issued while a payment plan is in place, the plan will not be modified to include the new citations, nor will a concurrent payment plan be offered. Citations in a payment plan will not be used toward immobilization/tow/impound (booting) requirements pursuant to CVC 22651(i)1. The determination of indigent status will be approved as required by CVC 40220. The fee to enroll in the payment plan is five dollars ($5.00). Payment plans will allow the payment of unpaid parking fines and fees to be paid off in monthly installments of no more at a minimum of than twenty-five dollars ($25) for total amounts due that are four hundred and fifty dollars ($450) or less. However, unpaid parking fines and fees shall be paid off within 18 months. There shall be no prepayment penalty for paying off the balance prior to the payment period expiring. An approved payment plan waives all late fees and penalty assessments, if an indigent person enrolls in the payment plan. Waived late fees and penalty assessments will be reinstated if the person falls out of compliance with the payment plan. When a registered owner or lessee falls out of compliance with the payment plan, a one-time extension of 45 calendar days from the date the plan becomes delinquent to resume payments will be given before the payment plan is cancelled and a DMV hold is initiated.Applications for indigence determination/payment plans must be received by the police department within 60 calendar days from the issuance of the most recent parking violation, or 10 days after the administrative hearing determination, whichever is later.
