In November 2003, the chapter pertaining to foreign language interpreter remuneration was approved by the Judicial Council of Virginia. In August 2009, the document was formatted in its entirety into a searchable template so as to facilitate its being posted on the Office of the Executive Secretary website, in lieu of printing paper copies.

In February 2011, the following modifications were made to this document. These sections were changed:

1. Information pertaining to the Deaf and Hard of Hearing removed from document. It is now posted under Americans with Disabilities Act (ADA).

2. Frequently Asked Questions (FAQ'S) modified to include regular opportunities for clarification.

o Reference is made to Federal Regulations and meaningful access for those with Limited English Proficiency.

o Verbiage discouraging the use of interested parties and minors as interpreters is strengthened.

o Coverage for foreign language interpreters during court-ordered doctors' evaluations is addressed.

o Use of the "Special Needs" field within the eMagistrate System is suggested.

o Unaddressed billing issues are clarified in accordance with Fiscal Department practices.

- Standards for billing more than one two-hour minimum within a day

- Billing increments used on the DC-44, LIST OF ALLOWANCES INTERPRETER

- Court closures due to inclement weather

3. Appendices

As a means of providing technical assistance to courts and judicial officers, United States Department of Justice guidance regarding access to those with Limited English Proficiency is included. Also, some foreign language materials and a document revision history are provided.

4. Remainder of Document Contemporized

In practice interpreting had changed in Virginia for over seven years before this update. These changes modified the document so that it would reflect reality, but did not effect any substantive changes into the way the foreign language interpreting program was currently being operated in Virginia. According to minutes from meetings when the Guidelines were enacted, the sections of the document that were modified appeared outside of that section that was approved by the Judicial Council of Virginia.

The document was made current by changing the following:

o Added Arabic, Korean, and Vietnamese to the languages in which interpreter certification is currently offered.

o Added a two-day orientation training provided to non-certified interpreters in all languages.

o Removed requirement that access to interpreter training was limited to those who passed a written exam. Changed the passing score on the written exam to 80%. Included the translation sentences, as a component of the written exam.

o Modified formatting and removed references to printing and distributing documents.

o Included the option of receiving a sight translation from the telephonic interpreting provider.

5. Various appendices merged to create new "Miscellaneous" appendix

In March 2015, the following modifications were made to this document. These sections were changed:

1. Introduction modified to include citation of Federal regulations, updated timeline, and additional history of language access program

2. Term limited English proficient (LEP) used throughout to reflect common parlance

3. Establishes court best practices: a. designating individuals within each court to coordinate language access services b. contacting OES if in need of additional language access resources c. extending language access services to LEP parents or guardians of juveniles d. receiving and processing complaints about language access services e. posting notice that free language access services are available
