JOB DESCRIPTIONDirector of Humane LitigationFLSA Status: ExemptSUMMARY: The Pennsylvania SPCA is looking for a lawyer, licensed in our state, who is looking to make an impact on the lives of animals that are victims of cruelty and neglect and to help us seek justice against their abusers. The Director of Humane Litigation supports all legislative and case management efforts of the Pennsylvania SPCA’s Humane Law Enforcement division. PRINCIPAL DUTIES Humane LitigationSupports Humane Law Enforcement Case Management efforts for all open cases to:Ensure charges are filed in an expedient manner Ensure charges filed are consistent amongst all jurisdictions covered by the PSPCA (currently 18 Pennsylvania counties)Maintain court calendarEnsure that all required litigation paperwork is completed properly and filed on timeEnsure evidence provides for likely successful prosecution of subject caseEvaluate cases for Cost of Care proceedings and oversee/support preparation of such petitions on behalf of the organizationMonitor all animals seized by the department with the goal of ensuring cases are processed in a timely manner.Advises on all Humane Law Enforcement-related litigation, including warrants, citations, court and testimony preparationAs needed, advocates as lead counsel or co-counsel in criminal court in coordination with the District Attorney’s office when approved through the District Attorney’s office which may include the negotiation of plea agreementsOversees security and maintenance of evidence held at PSPCA.Develops and maintains relationships with District Attorney's offices in key counties covered by PSPCA HLE Officers.Monitors restitution and develops strategies for increasing compliance of payment plans by offenders including but not limited to working with courts for compliance and working with pro bono attorneys on attaching liens to offender’s propertiesMaintains library of tools, including model warrants, sample citation language, sample briefs, and applicable statutory and case law for ease of referenceCoordinates with pro bono counsel network for a variety of legal needs within the departmentAssists in the Development of Improved Methods of Tracking/Monitoring HLE activities.Advises in the management and development of policies and practices for HLE in order to reduce liabilityHelps develop substantive court experience and knowledge for HLE officersAssists in the development of legislative priorities for the organization with key staffLegislative Advocacy; keeps abreast of potential legislation relative to organization's goals and informs senior management and HLE of developmentsOther duties as assignedEXPERIENCE, EDUCATION ABILITIES AND QUALITIES REQUIRED JD; Licensed to practice law in Pennsylvania with 2-4 years of experienceDemonstrated commitment to Pennsylvania animal law, policy and welfareStrong leadership, communication (oral and written) and organizational skillsAbility to work with a wide variety of people and animalsHighly organized and meticulousAbility to communicate effectively with a culturally diverse staff, volunteers and community.Passion for animals, concern for their welfare and a willingness to accommodate animals in the workplace. Sincere interest in the mission and programs of the Pennsylvania SPCAIMMEDIATE SUPERVISOR: Director of Humane Law EnforcementHOURS FLSA STATUS: EXEMPT POSITION Minimum of 8 hours per day, 40 hours per week. Daily morning and afternoon hours and days of the week may vary according to the needs of the department schedule. Position may include weekends, nights and holidays. INTRODUCTORY ASSESSMENT PERIOD The introductory assessment period runs from the date of hire for three months thereafter. For employment in any position with the Pennsylvania SPCA, this introductory assessment period is the period during which the specifics of the job are learned. During this period, either the employee or the Pennsylvania SPCA may end the employment relationship without notice or prejudice.EMPLOYMENT There is no minimum period of employment guaranteed or implied by acceptance of an employment offer. It is the policy of Pennsylvania SPCA that even exempt positions are governed by the needs of the agency, which means that employment is for no specified term and either the Pennsylvania SPCA or the employee, may terminate that employment at any time.
