Today, [date], [name] of [city], Michigan, and [name] of [city], Michigan, agree to share living quarters and agree to the following conditions:

Independent Persons

The parties desire to enter their relationship as independent persons and to have their relationship be a natural consequence of their mutual love and affection without material or economic considerations. Each of the parties has achieved a measure of material independence, and each party agrees not to claim any interest in the property accumulated by the other party before or after today, or in any of the income or appreciation derived from it, except as provided in this agreement.

Property Rights

The parties want to define and clarify their respective rights in each other’s property and in any jointly owned property they might accumulate after today and to avoid interests that, except as provided by this agreement, they might otherwise acquire in each other’s property as a consequence of their relationship.

The parties want all property owned by either of them at present and all income derived from it and all increases in the value of it to remain their respective separate property, except as otherwise provided by this agreement. The parties agree that any transmutation of any of their separate property interests into jointly owned property will be by express written agreement. The following events will under no circumstances be evidence of any intention by either party or of any agreement between the parties to transmute their separate property interests into jointly owned property:

1. the taking of title to property, real or personal, in joint tenancy or in any other joint or common form

2. the designation of one party by the other as a beneficiary of his or her estate

3. the commingling by one party of his or her separate funds or property with jointly owned funds or property or with the separate funds or property of the other party

4. any oral statement by either party

5. any written statement by either party other than an express written agreement of transmutation

6. the payment from jointly held funds of any separate obligation, including but not limited to the payment of mortgage, interest, or real property taxes on separately owned property

7. the joint occupation of a separately owned residence

Disclosure of Property

Both parties to this agreement have made to each other a full and complete disclosure of the nature, extent, and probable value of all their property, estate, and expectancies. A statement of the separate property of the parties as of today is attached. Each party may acquire other separate property in the future as a result of income from or increases in the value of his or her existing separate property.

Children by Previous Marriages

The parties agree that neither intends to create an equitable parent relationship with the other’s children and that neither will make claims for custody or parenting time with the other party’s children should the parties separate.

If at any time either party resorts to his or her separate property to support or maintain the parties, that party will be entitled to reimbursement from the jointly owned property, provided that reimbursement does not expose the parties to economic insecurity.

Mutual Release of Claims

The parties agree to waive all claims they may acquire in each other’s separate property by reason of their relationship, including but not limited to

1. the right to support for themselves and any children of other relationships,

2. the right to a probate homestead,

3. the right of election to take against the will of the other,

4. the right to declare a homestead in the separate property of the other, and

5. the right to act as administrator of the estate of the other.

Modification or Waiver

This agreement will continue in force until modified by written agreement by both parties.
