PETITION FOR REORGANIZATION OF [NAME OF FIRST DISTRICT] and [NAME OF SECOND DISTRICT] INTO A SINGLE ELEMENTARY DISTRICT RESOLUTION #To the Superintendent of Schools of Sonoma County:Pursuant to Education Code Section 35700, subdivision (d) the undersigned Board members of the [Name of First District] and the [Name of Second District] hereby petition the Sonoma County Superintendent of Schools to reorganize these two elementary districts into a single elementary district. The property to be reorganized is described as follows:[Name of First District] [Name of Second District] Legal descriptions of each of the districts are on file in the Sonoma County Office of Education.The undersigned Board members/Petitioners request the reorganization of the school districts for the following reasons:To better serve the students of the existing districts, with the ability to provide enhanced educational and academic programs.To sustain fiscal viability, implementing efficient use of taxpayer dollars in educating students in Sonoma County.The Petition includes the following information, all to the best knowledge and belief of thePetitioners:1.The name of the new district will be “[Insert Name of Newly-Created District]” [Note: this can be the name of one of the pre-existing school districts]2.The governing board shall be [specify number] members. The method of election is to be determined.3.The election will be held in the territory of both of the existing districts.4.If the reorganization election is held in June of 20__, the first governing board shall be elected at the first regular election after the passage of the reorganization proposal (November 20__). If the reorganization election is held in November of 20__, the governing board shall be elected at the same election as the reorganization proposal. The method of determining which elected officials shall serve four (4) years and which shall serve two (2) years is still to be determined. Normally, the three (3) candidates with the highest number of votes shall serve four (4) year terms and the two (2) candidates with the fourth and fifth highest number of votes shall serve two (2) year terms. 5.It is expected that the reorganization will have no effect on the certificated personnel at the existing schools as it is expected that all schools will remain open and will serve substantially the same number of students.6.The base revenue limit per unit of average daily attendance for the [Name of First District] is [insert revenue limit]. The base revenue limit per unit of average daily attendance for the [Name of First District] is [insert revenue limit]. [or] [Name of Existing District] [is a basic aid elementary school district]. The base revenue limit per unit of average daily attendance for the newly formed elementary district would be approximately [insert revenue limit].7.This is a consolidation of existing school districts; therefore there is no property to be divided. The territory shall automatically assume its proportionate share of any outstanding bonded indebtedness for each of the three districts, if any. State whether that parcel tax shall end prior to formation of the new district].8.In response to the conditions set forth in Education Code section 35753 the Petitioners have made the following findings, all or any of which may be augmented by the Sonoma County Committee on School District Organization: (1)The reorganized district will be adequate in terms of number of pupils involved.(2)The new district will be organized on the basis of a substantial community identity.(3)The proposal will not require a division of property or facilities.(4)The reorganization of the districts will preserve both the existing districts’ and the new district’s ability to educate students in an integrated environment and will not promote racial or ethnic discrimination or segregation.(5)The costs to the state which will result from the reorganization are currently unknown and this Petition will require augmentation from the County Committee on this issue.(6)The proposed reorganization will continue to promote sound educational performance and will not significantly disrupt the educational programs in the districts affected by the proposed organization. (7)Any increase in school facilities costs as a result of the proposed reorganization will be insignificant and otherwise incidental to the reorganization.(8)The proposed reorganization is primarily designed for purposes other than to significantly increase property values.(9)The proposed reorganization will continue to promote sound fiscal management and not cause a substantial negative effect on the proposed district.
