THE REGULATIONS FOR IMPLEMENTING LAW NO. (19) OF 2005 REGULATING THE PRACTICING OF ENGINEERING PROFESSIONS

The Board of Directors:

After perusing Law No. (15) of 2004 establishing the General Authority of Planning & Urban Development as amended by Law No (9) of 2005, and

Law No. (19) of 2005 regulating the practicing of engineering professions, and

Emiri Decision No. (29) regarding decisions of the council of Ministers required to be submitted to the Emir to approve and issue, and

The proposal by the General Director of the General Authority of Planning & Urban Development, and the Committee for the Enrollment of Engineers and Engineering Consultancy Offices, and

The approval by the council of ministers of the draft of this decision in its regular meeting No. (22) of 2005 dated 22/6/2005,

Has decided as follows:

Article (1)

The provisions of the Regulations for Implementing Law No. (19) of 2005 Regulating Practicing of Engineering Professions) attached to this Decision shall be acted upon.

Article (2)

All concerned parties, each within its competence, shall implement this Decision which shall take effect from the date of its publication in the Gazette.

THE REGULATIONS FOR IMPLEMENTING LAW NO. (19) OF 2005 REGULATING THE PRACTICING OF ENGINEERING PROFESSIONS

PART ONE

ENROLLMENT IN THE REGISTER OF ENGINEERING PROFESSIONS

Article 1

The Committee for Enrollment of Engineers and Engineering Consultancy Offices shall prepare the Registers provided for in Article 4 of Law No. 19 of 2005 referred to, provided that each Register must include pages arranged in serial number and stamped with the Committee’s seal, provided also that each enrollment must have a separate enrollment page.

The Committee may classify the information included in the enrollment pages and publish them in the manner it thinks appropriate.

The General Director may upon the Committee’s proposal establish subsidiary registers. The register’s forms and the method of entry therein shall be issued by decision from the General Director upon the Committee's proposal.

Concerned parties shall be entitled to obtain information contained in the enrollment pages.

CHAPTER ONE

ENROLLMENT IN THE REGISTER OF ENGINEERS

Article 2

Applications for enrollment in the Register of Engineers must be presented to the Committee on the form issued a decision from the General director accompanied with the following documents and information:

1. copy of valid personal identity card (ID).

2. certificate of bachelor of engineering or equivalent in the specialization requested to be licensed for practicing, provided that it must be issued by one of the recognized universities and institutes and certified by the competent authorities.

3. any other technical qualification provided that they must be issued one of the recognized universities and institutes and certified by the competent authorities.

4. certificate issued by the Committee that he passed the technical ability tests in the field of his specialization.

5. official certificate that he was not finally convicted of a felony or punished with a liberty restricting sentence in an offence involving honor or honesty or that he was acquitted therefrom; provided that no more than three months have passed following issuance of such certificate.

6. undertaking not to work in any of the ministries or other government organs or public authorities and institutions, or carry out contracting works or trade in building materials or other materials relating to the execution of projects of any size or kind, Or seek to obtain any other work in a manner inconsistent with the profession ethics or practices and to devote himself to the works of the profession.

Article 3

The enrollment page in the Register of Engineers shall include the following information:

1. name of the engineer, his date of birth and full address.

2. number of his identity card (ID).

3. number and date of enrollment in the register.

4. his academic qualifications and the branch of his specialization indicating the name and location of the university or institute and the date of graduation.

5. name of the ministry or government organ or any other recognized body or engineering office he worked with as an engineer and the duration of such work.

6. duration of training, if any, and the office in which he was trained.

7. the engineering specialization he is licensed to practice.

8. the category under which he is classified and any modifications thereto.

9. gist and date of the decisions issued by the Committee regarding the engineer.

10. gist of the final disciplinary decisions or judgments relating to the profession practicing issued against the engineer.

11. certificate of passing the technical ability tests in the field of his specialization.

CHAPTER TWO

ENROLLMENT IN THE REGISTER OF LOCAL ENGINEERING CONSULTANCY OFFICES

Article 4

Applications for enrollment in the Register of Local Engineering Consultancy Offices must be presented to the committee on the form issued by decision of the General Director and accompanied with the following documents and information:

1. copy of valid identity card (ID) of the office owner, provided that he must be a Qatari national; and if the office is owned by more than one natural or corporate person the following documents must provided:

a) the company’s original memorandum of association authenticated by the competent bodies, provided that the percentage of contribution by the Qatari partners to the capital must not be less than %51.

b) Copy of the Commercial Register of the company.

c) Copies of valid identity cards (ID) for natural person partners, and an authenticated copy of the original memorandum of association for corporate partners.

d) Certificate of enrollment in the Register of Engineers of non-Qatari natural person partners, or certificate of enrollment in the Register of Engineering Consultancy Offices for non-Qatari corporate partners.

2. Certificates of enrollment in the Register of Engineers for all engineers working in the office, provided that experience of each of them must not be less than five years.

3. name proposed for the office in Arabic and English.

4. authority signed by the office owners indicating name of the engineer or engineers responsible and names of person or persons authorized to manage and sign for the office, including samples of their signatures. The Engineer Responsible must:

a) be entered in the Register of Engineers.

b) have at least ten years experience.

c) Undertake to permanently remain in the country and such (undertaking) is not affected by departure for usual vacations or for exceptional temporary periods.

d) be authorized to practice the profession in the country of his domicile and provide proof thereof.

5. undertaking to provide, on acceptance of application for registration, copies of the office rent contract indicating precisely the size of office, its location and address.

6. certificate issuing from the Ministry of Civil Affairs and Housing for each of the office owner, partners and engineers working therein, indicating that none of them is employed by any ministry, other governmental body or public authority or institution.

Article 5

The page of enrollment in the Register of Local engineering Consultancy Offices must include the following information:

1. name and full address of the office licensed.

2. name, address of and full information about the office owner.

3. number and date of enrollment in the register.

4. the engineering specialization(s), which the office is licensed to practice, and the category under which it is classified with any modifications thereof.

5. names, information, qualifications and specializations of the engineers working in the office and numbers of their enrollment in the Register of Engineers.

6. name of the Engineer Responsible and name of the authorized signatory for the office, his qualifications and full address.

7. summary of the final disciplinary decisions striking the name of any engineer working in the office off the register in which he was enrolled, or suspending him from practicing the profession.

8. summary of the final judgments against the owner or partners to close down the office, and the disciplinary penalties striking the office off the register or suspending it from practicing the profession.

CHAPTER THREE

Enrollment in the Register of International Engineering Consultancy Offices

Article 6

A foreign main office seeking to open a branch office to practice the engineering consultancy profession in Qatar must present its application to the committee on the form issued by decision of the general director with the following documents and information attached:

1. true copy of the memorandum of association of the main office in its homeland and the articles if any.

2. a certificate issuing from the competent authorities in the homeland of the main office proving that it has been practicing the engineering consultancy profession for at least ten years continuously.

3. certified valid certificates of licenses for branches of the main office in at least four countries other than its homeland.

4. the annual budget of the main office for the three years preceding the date of application, provided that it must be audited by one of the certified auditing offices.

5. list of ten projects achieved by the office or one of its branches in countries other than its homeland, from which it earned at least one hundred million riyals, and the documents and records showing the details of those projects must be attached to such list.

6. true copy of the quality appraisal or international professional competence certificates obtained by the main office or one of its branches if any.

7. unconditional undertaking certified by the concerned Qatar embassy to carry out the following:

A. bear all obligation arising from practicing the engineering consultancy profession in Qatar by the branch office.

B. Encourage the national industry and give it priority in the specifications to be prepared by the branch office in accordance with the applicable laws.

C. Provide the branch office with the necessary technical expertise, and insure it, its employees and the engineering works carried out by the office in Qatar with one of the Qatari insurance companies.

8. the academic qualifications and experience certificates of the engineers and employees to be affiliated to work in the office, provided that such qualifications and certificates must be approved by the competent bodies.

9. the certificates of enrollment in the Register of Engineers of all engineers to be affiliated to work in the office.

10. the documents relating to the conditions required for the Engineer Responsible and the Authorized Signatory for the branch office, and in particular, the following:

a. the academic qualifications obtained by him, and which indicate his specialization in one of the engineering branches in which the office is sought to be enrolled, provided that they are issued by one of the recognized universities or institutes and approved by the concerned authorities.

b. Certificate of working experience for not less than ten years, five of which in the main office; and if the Engineer Responsible or the authorized Signatory is a national of Qatar, it suffices that his experience is not less than ten years.

c. Undertaking to remain in Qatar permanently, which will not be affected by the fact of leaving it for normal vacations or temporarily exceptional periods.

d. The license of practicing the profession in his country.

e. The certificate of enrollment in the Register of Engineers.

f. Copy of valid identity card (ID).

Article 7

The page of enrollment in the Register of International engineering Consultancy Offices must include the following information:

1. the name of the licensed branch engineering office, its nationality, full address in Qatar and the date and number of its enrollment in the register.

2. the name and address of the main office and its other branches outside Qatar.

3. the name of the engineer in charge of the office management, his nationality and full address.

4. the number and names of the engineers working in the branch office, their specializations and nationalities.

5. the engineering specializations licensed for the office to practice and any modifications that might occur thereto.

6. the number of the commercial license of the office.

7. gist of the final disciplinary decisions ordering the striking out of the Engineer in Charge of the office management or any of the engineers working therein from the register in which they are enrolled or suspending the branch office from practicing the profession in the State.

PART TWO

Specializations of the Engineering Professions

Article 8

The engineering professions and their technical specializations shall be determined according to the following:

First: Civil Engineering:

1) construction engineering

2) roads & traffic engineering

3) hydraulic, irrigation and sewage engineering

4) infrastructure & soil engineering

5) public works engineering

6) air & sea ports engineering

7) sanitary & ecological engineering

8) survey engineering

Second: Architectural Engineering:

1) architectonics

2) architectural engineering

3) urban planning

4) architectural designing

Third : Mechanical Engineering

1) mechanical power engineering

2) conditioning, cooling, heating and ventilation engineering

3) fluid mechanics engineering

Fourth: Electrical & Electronic Engineering

1- electrical engineering

2- electronic & computer engineering

3- electrical power & auto control engineering

4- electrical grids & distribution engineering

Fifth : Chemical & Petroleum and Gas Engineering

1) chemical engineering

2) petroleum and gas engineering

3) petrochemical engineering

4) geological engineering

5) metals engineering

6) mines and mining engineering

7) basic synthetic engineering

Sixth: Quantity Calculation & Cost estimation

1) Quantity Calculation

2) Cost estimation

Seventh: Projects Management:

Management of projects in all specializations and engineering works.

Eighth: Industrial Engineering

Systems engineering

Ninth: Security & Safety Engineering

Tenth: Communication Engineering

PART THREE

Categories & Rules of Classification

CHAPTER ONE

Categories & Rules of Classification of engineers

Article 9

Engineers enrolled in the Register of Engineers in the specializations they are licensed to practice, shall be classified under the following categories:

a) Category One

b) Category Two

c) Category Three

Article 10

For classification under Category One or Two, work experience in the engineering works must not be less than any of the following terms:

First : Category One:

1- Ten years for bachelor certificate holders.

2- Seven years for master certificate holders.

3- Five years for doctorate certificate holders.

Second: Category Two:

1. Seven years for bachelor certificate holders.

2. Five years for master certificate holders.

3. Three years for doctorate certificate holders.

Article 11

Engineers enrolled in the Register of Engineers who do not meet the conditions required for classification under Category One or Two, shall be classified under Category Three.

Chapter Two

Categories & Rules of Classification of Local Engineering Consultancy Offices

Article 12

Local Engineering Consultancy Offices enrolled in the Register of Local Engineering Consultancy Offices in the professions of civil engineering, excepting survey engineering; or architectural engineering, excepting urban planning; or electrical and electronic engineering, shall be classified under one of the following categories:

a- Category One

b- Category Two

c- Category Three

Classification of those offices in the professions of mechanical engineering, quantity calculation and cost estimation, the specialization of urban planning and the survey engineering, shall be under one of the following two categories:

a- Category One

b- Category Two

Classification of offices in the professions of chemical, petroleum and gas engineering, projects management, industrial engineering, security & safety engineering and the communication engineering, shall be under Category One.

Article 13

Subject to the provisions of the preceding Article, for classifying local engineering consultancy offices enrolled in the Register of Local Engineering Consultancy Offices it is a condition that each office must be organized technically, managerially and financially, and must satisfy the following requirements for:

First: Category One:

1- The office must have a number of engineers not less than four in any of the specializations of the professions of civil engineering, architectural engineering, chemical engineering and petroleum & gas engineering; or not less than three engineers in any of the specializations of the other professions of engineering where it is permitted to classify into this category, provided that the experience of the engineers working in the office must not be less than ten years in the same specialization.

2- The value of the liability insurance in respect of its professional activity must not be less than two million riyals.

3- It must have carried out a number of engineering projects the annual total value of which is not less seventy million riyals. A first time enrolled in the register office shall be exempt from this condition.

4- The office's space must not be less than 200 square meters.

Second: Category Two:

1- The office must have a number of engineers not less than three in any of the specializations of the professions of civil engineering and architectural engineering, or at least two in one of the other specializations of the engineering professions where licensing and classifying in this category is allowable, provided that the experience of the engineers working in the office must not be less than ten years in the same specialization.

2- The value of the liability insurance in respect of its professional activity must not be less than one million riyals.

3- It must have carried out a number of engineering projects the annual total value of which is not less thirty million riyals. A first time enrolled in the register office shall be exempt from this condition.

4- The office's space must not be less than 120 square meters.

Third: Category Three:

1- The office must have at least one engineer in any specialization licensed to it to practice from the specializations of the professions of civil engineering, architectural engineering or electrical and electronic engineering provided that the experience of the engineers working in the office must not be less than seven years in the same specialization.

2- The value of the liability insurance in respect of its professional activity must not be less than five hundred thousand riyals.

3- The office's space must not be less than 120 square meters.

In all cases, no engineering profession office shall be classified under more than one of the category of the engineering specialization the licensed for it practice.

CHAPTER THREE

The Category of the International Engineering Consultancy Office

Article 14

Subject to the provisions and conditions of enrollment provided for in Law No. (19) of year 2005 referred to and this Regulations, the international engineering consultancy offices shall be classified under one category.

The branch engineering office enrolled in the register of international engineering consultancy offices shall undertake the following:

1- that the responsible manager must give full time for the office works;

2- the number of permanent engineers in the office must not be less than three, provided that the experience of the non Qatari engineers shall not be less than ten years.

3- The value of the liability insurance in respect of its professional activity must not be less than two million riyals.

4- The office must keep regular accounts which are annually audited by one of the accredited accounts audit and control offices.

5- The office's space must not be less than 200 square meters.

A branch office enrolled in the register of international engineering consultancy offices may perform all engineering specializations of any kind or size within the engineering profession which is licensed to practice.

PART FOUR

Applications & Procedures of Enrollment

Article 15

The Committee shall decide on the applications for enrollment within thirty days from the date of their presentation, and it may delay the disposal of any such applications until completion of the information and documents required within not more than thirty days from the delayed date of disposal thereof. It may also summon those concerned for examination whenever it sees such is necessary.

Article 16

The Committee shall decide whether to accept or refuse the applications. The acting secretary shall serve notice on those concerned of the Committee's decisions by registered letter with receipt acknowledgement.

Article 17

If the Committee decides to refuse the application it shall give the reasons for such refusal in writing and notify the person concerned by registered letter with receipt acknowledgement.

Those whose application is refused may complain to the General Director within the time limits and pursuant to procedures provided for in Article (13) of Law No. (19) of year 2005 referred to.

Article 18

The Committee's decision accepting the application for enrollment in the Register of Engineers or in the Register of Local or International Engineering Consultancy Offices shall determine the specialization and classification in the engineering professions licensed to be practiced.

The Committee may, when renewing the enrollment, modify the classification according to the results of periodical evaluation.

Article 19

Those whose application for enrollment is accepted shall pay the prescribed fee within thirty days from the date of notifying him with the decision of his acceptance shall be made except after paying the prescribed fee.

Article 20

The engineers enrolled in the Register of Engineers shall be given a certificate signed by the chairman of the committee and stamped with the committee's seal signifying enrollment in the register and stating the specialization they are authorized to practice and the category they are classified under. Enrollment in the Registers shall be considered an authorization for the engineers enrolled in the Registers to practice the profession after taking oath.

Article 21

Subject to the provisions of Article (12) and (13) of this Regulations engineers and the local engineering consultancy offices, classified under Category Three, may apply to the committee on the time fixed for renewing the enrollment to modify their classification into the higher category and the following documents and information shall be attached to the application:

1- Certificate of enrollment in one of the registers.

2- A list of the number and names of the engineers working in the office in each specialization, and their qualifications and working experience.

3- List of the number, area and value of the projects achieved during the period following the date of the last classification.

The committee may verify the data and information given in the manner it deems appropriate; and may require to be provided with any additional data or other technical information.

PART FIVE

OBLIGATIONS OF THE LICENSEE

Article 22

Local and International engineering Offices may not practice the profession except after enrollment in the register and obtaining a certificate indicating enrollment and containing the details of number and date of enrollment in the register and the category of engineering specializations they may practice.

The certificate referred to, and any modifications thereof, must be displayed in a visible place within the premises in which such offices carry on their works. They must also display the said information, with the exception of the date, in all their papers, printouts, drawings and designs.

Article 23

Engineers enrolled in the Register of Engineers may not practice the profession in more than one of the engineering specializations or in a category higher than the one under which they are classified.

Article 24

Local Engineering Consultancy Offices classified under Category Three, may not carry out engineering works in projects with building space of more than two thousand square meters or projects whose value exceeds three million riyals, or their equivalent according to the type of specialization.

Local Engineering Consultancy Offices classified under Category Two, may not carry out such works in projects with buildings space of more than five thousand square meters or projects whose value exceeds ten million riyals, or their equivalent according to the type of specialization.

Article 25

A licensee enrolled in the Register of Engineers, may not assign enrollment in the register to another, and the enrollment in the register is deemed to be cancelled on the death of the licensee.

The licensee and his heirs in the case of his death shall have the right, on cancellation of his enrollment, to dispose of all contents and tools of the office owned by him.

Article 26

No assignment of license of an engineering consultancy office enrolled in the Register of local or international engineering consultancy offices may be made except with the approval of the committee if the conditions required in the engineering consultancy office assignee are satisfied, provided that such assignment must be made by an authenticated contract in which the signatures of the parties concerned are certified by the competent bodies.

PART SIX

Fees of Enrollment & Renewal of in the Registers

Article 27

The period of enrollment in the registers is two years starting as of the date of first enrollment. Renewal of enrollment must be made within thirty days from its expiration date. Non-renewal shall result in striking the name off the register after giving notice to the defaulter by registered letter with receipt acknowledgement and the passing of thirty days from the date of such notice. No re-enrollment may be made in this case except after paying fee of a new enrollment.

An application for renewal must be presented on the form prepared for this purpose, attached to it all papers and documents proving persistence of the conditions of enrollment in the register stated in Articles (2, 4, 6) of this Regulations.

Article 28

The fees of enrollment in each register and renewal thereof shall be determined by decision of the Director General upon proposal of the Committee. Such decision shall become effective only after approval of the Board of Directors.

PART SEVEN

GENERAL PROVISIONS

Article 29

The Committee shall conduct a periodical evaluation of the works of those licensed to practice the engineering professions to ensure compliance with the conditions and specifications required according to their specializations and categories of their classifications. Such evaluation includes in particular the following:

1- The technical, financial and administrative status.

2- The size and type of the engineering projects.

3- The engineers.

A copy of the periodical evaluation shall be sent to the manager responsible for the engineering office concerned, for commenting thereupon within a period not exceeding sixty days from the date of dispatch to him. The evaluation and comment if any shall be filed in the dossier of the licensee with the Committee.

Article 30

The document of liability insurance in respect of the professional activity must be issued by one of the Qatari insurance companies and must be valid for not less than three years from the final handover of the engineering works, for the purpose of securing compensation for injuries resulting from professional neglects, defects and faults which appear in such works during the period referred to.

Article 31

Specifications of the engineering designs prepared by an office authorized to practice the profession must be compatible with the specifications of national products or products of national origin available in the State, unless the employer or the contracting party requests other specifications of better quality.
