The Public or Statutory Sector

The Public Sector, or Statutory sector, is the largest care sector in Wales. It employs more carers, provides more services and spends more money that the private and independent sectors put together. The word statutory means ‘the law’, and the statutory services are ones which have been established by the law. The statutory sector therefore is the responsibility of the Government.

There are 2 main divisions: central government and local government. The UK has devolved the governmental system. This means that the Assembly in Wales now has some powers which enable it to manage its country’s public affairs, and to operate independently of the Parliament in London. It has the powers to create health and social care policies and to manage the funding of the care services in its own country.

Every country in the UK also has a system of local government which is run by local authorities. These are administrative bodies which receive money and guidelines from central government in order to implement the policies of that particular government. e.g. each local authority is responsible for providing statutory social care, education and childcare services for the local people and for implementing national policies on relevant issues.

The 7 new health boards in Wales were created by the National Assembly on 1st October 2009. Their aim is to dispense with the internal market.

Edwina Hart, the minister for health, says that the new procedure will mean:

• less bureuocracy

• less competition between trusts

• more co-operation

• better care for the individual.

The seven new boards are as follows:

1. Abertawe Bro Morgannwg University Health Board

2. Aneurin Bevan Health Board

3. Betsi Cadwaladr University Health Board

4. Cardiff & Vale University Health Board

5. Cwm Taf Local Health Board

6. Hywel Dda Local Health Board

7. Powys

Comparing the Responsibilities of Central Government and Local Government

The Central Government’s role is to:

➢ Develop national health and social care policies

➢ Plan national health and social care services

➢ Monitor and be accountable for providing a national care service

➢ Fund care services

Every local government has a Health Department which co-ordinates all of this.

Civil Servants work here and the leader is the parliament member (or Assembly member) for Health. The civil servants undertake the department’s day to day work.

Each country in the UK also has a system of regional bodies which are responsible for implementing the government’s policies in that area.

We see therefore that central government is responsible for developing the main policies, making fundamental decisions and funding the health and social care services. The planning and transfer from these services is undertaken by more local organisations which are answerable to central government.

Role of Local Government

In England and Wales, the ‘local councils’ are responsible for ensuring the provision of care, education and early years services on a local level. They are responsible for:

A) Assessing the need for social and educational care in the locality.

B) Planning and buying statutory education and social care to meet the local need.

The local authority undertakes the work through the social services. Since the inception of the internal market in the care sector, the authority buys some care from the private and voluntary sectors and provides some itself. When the client’s needs are very complex, the care is shared by several different care organisations.

Structure and Organization

of Statutory Care in Wales

Facts

➢ In 1999, the Assembly was made responsibility for developing care policies and providing care services for the country. Most of the laws pertaining to health and social care were passed before devolution, and these have been incorporated in the new system which is evolving in Wales.

➢ The structure of statutory care is different from that of England.

Accessing health care in Wales

Secondary care may also be received directly through accident and emergency departments in hospitals or clinics which are located in both countries.

Accessing social care in Wales

A local authority social worker assesses the needs of anyone who needs social care. The authority employs a single assessment process which involves an assessment of the health and social care needs of every adult referred to them.

If the individual’s needs are sufficient and if he/she is eligible to receive care, a care package will be purchased for him/her. The package may include statutory, private or voluntary services.

The individual may purchase the services directly from the private sector or voluntary sector if he/she has the money, of course.

A large number of voluntary agencies offer social care and support services to those who are eligible. For example, homeless people who have no money may be eligible to have somewhere to stay overnight in a ‘night shelter’ or in homes for homeless people.

Independent Sector Services

These services are on the increase in both countries. These private agencies tend to offer specialized secondary care e.g. fertility treatment, surgery and cerebral treatment. i. e. if you have the money you can buy more specialised and quicker treatment than that which you would receive from the NHS.
