Approval of Statement of Proceedings/Minutes for the meeting of October 26, 2005

ACTION:

ON MOTION of Member Cox, seconded by Member Roberts, the Air Pollution Control Board of the San Diego County Air Pollution Control District approved the Statement of Proceedings/Minutes for the meeting of October 26, 2005, on Consent.

| |OVERVIEW: |

| |This is a request to allocate funds for a Supplemental Environmental Program funded by Kiewit Pacific Company pursuant to an |

| |agreement resolving a dispute over alleged violations during the construction of the Olivenhain Dam. Additional funding from the Air |

| |Quality Power Generation Mitigation Fund is also being utilized for this program. The intent of the two projects in this Supplemental|

| |Environmental Program is to reduce exposure to diesel emissions from school buses. |

| |The first project will purchase and install an ultra low sulfur diesel tank for the Escondido School District ($32,210). Ultra low |

| |sulfur diesel is needed to fuel buses previously retrofitted with particulate filters. The current method of fueling using a mobile |

| |fueling truck is inefficient and increases the possibility of spilling. The second project will reconfigure the fueling system at |

| |the San Dieguito Transportation Cooperative ($45,660) to accommodate physical changes to the bus yard and add four natural gas |

| |fueling posts. This project will reduce idling and unnecessary driving by eliminating the need to move buses in and out of fueling |

| |posts and will accommodate an additional natural gas bus if one is added to the fleet in the future. Since the total for these two |

| |projects ($77,870) exceeds the available Kiewit Supplemental Environmental Program funds ($60,000), an appropriation of $17,870, from|

| |Air Quality Power Generation Mitigation Fund is recommended to complete the project funding. |

| |FISCAL IMPACT: |

| |This request is not included in the Fiscal Year 2005-06 Operational Plan. The funding source is Kiewit violation settlement money |

| |deposited in the Air Quality School Bus Program Fund ($60,000) in June 2005 and the Air Quality Power Generation Mitigation Fund |

| |($17,870). If approved, this request will result in one-time costs and fund balance use of $77,870, and no subsequent year costs or |

| |revenue. It will require no additional staff years and no net General Fund cost. |

| |RECOMMENDATION: |

| |AIR POLLUTION CONTROL OFFICER |

| |Establish appropriations of $60,000 in the Air Quality School Bus Program Fund for the Supplemental Environmental Program based on |

| |fund balance made available from prior year revenues from Kiewit Pacific Company. (4 VOTES) |

| |Establish appropriations of $17,870 in Air Quality Power Generation Mitigation Fund, Operating Transfer Out, for the Supplemental |

| |Environmental Program based on available fund balance. (4 VOTES) |

| |Establish appropriations of $17,870 in the Air Quality School Bus Program Fund for the Supplemental Environmental Program based on an|

| |Operating Transfer from the Air Quality Power Generation Mitigation Fund. (4 VOTES) |

| |Approve the recommended projects for the Escondido School District and San Dieguito Transportation Cooperative to be funded by |

| |allocations from the Kiewit Supplemental Environmental Program and Air Quality Power Generation Mitigation Fund balance. |

| |In accordance with Section 401 et seq. of the County Administrative Code, authorize the Director of the Department of Purchasing and |

| |Contracting to award contracts for the Escondido School District and San Dieguito Transportation Cooperative projects, subject to |

| |negotiations and approval of the Air Pollution Control Officer. |

| |ACTION: |

| |ON MOTION of Member Cox, seconded by Member Roberts, the Air Pollution Control Board took action as recommended, on Consent. |
