REALTOR and TITLE COMPANY FACT SHEET

For

PROSPECTIVE HOME BUYERS IN SIERRA PARK, Long Barn, CA.

Sierra Park does not have a homeowners association (HOA). Rather it has two shareholder-owned companies (only Park property owners can be shareholders). One provides water and the other road maintenance and ancillary services to the community. These companies are the Sierra Park Water Company (SPWC) and Odd Fellows Sierra Recreation Association, Inc. (RA).

The California Public Utilities Commission (CPUC) regulates SPWC, which is responsible for maintaining the entire water system. This includes testing of water supply per CA Dept. of Public Health guidelines. The Park’s water system has two tank farms holding up to 300,000 gallons of water. Main and distribution water lines throughout the Park supply water to all lots. These lines also have hydrants for fire fighting. SPWC has an employee with D1 and T1 Water License certifications for water testing and water system maintenance. An independent laboratory tests the water monthly and the reports are sent to the Water Quality Board; they are available to all property owners by a posting on the web site.

SPWC’s rates are set by the CPUC. The SPWC bills Quarterly. Failure to pay the bill will result in the property’s water being locked off until such time as the billing is resolved.

Odd Fellows Sierra Recreation Association (RA) responsibilities include, but are not limited to, ROADS (road repair, maintenance, snow removal) and ANCILLARY SERVICES (trash disposal facility and its maintenance, pine needle dump [Calfire Codes require annual property cleanup], and common area maintenance for playground, picnic area, lake, etc).

Billing for ROADS and ANCILLARY SERVICES is done annually (circa June 1, XX). All property owners must pay the ROADS costs per CC845. The Ancillary Services portion of the bill is for the use of the garbage dumpster (the RA is the sole provider of trash service in the Park), pine needle dump, common areas such as the playground, lake and other picnic areas. Opting not to pay this portion of the bill means electing to not use these Park features at all, and unauthorized users will be subject to fines.

Property Sale and/or Title Transfer

When a property in the Park sells or other wise changes hands, the title company for the transaction should contact the RA’s accounting firm: Carlson & Associates 14520 Mono Way Ste 130, Sonora, CA 95370, 209-532-5171. The firm will supply to the title company the amount of any funds as part of escrow that the buyer should refund the seller, i.e. the prorated share of the current year of unused annually billed cost for Roads and Ancillary (if paid) that the buyer is obliged to assume. The current year’s and previous year’s invoiced amounts are provided at the end of this document. In the event the seller is in arrears for any prior year(s) Roads and Ancillary costs, there maybe a lien on the property. If there is not a lien, the seller is still obligated to make good on the unpaid amounts owed to the RA prior to the close of escrow.

Annual Meetings: Annual Shareholder meetings of both companies are held in the Park’s lodge on the Sunday of Memorial Day weekend. The fiscal year for both companies runs from June 1 to May 31 of the following year.

Shareholder Information: SPWC and RA are for-profit companies owned exclusively by Park property owners, who may elect to purchase one share in each company. A share of stock costs $10.00. Only one share of stock is offered in each company for each lot.

All property owners are encouraged to attend the Annual Meetings, but only shareholders can vote on matters that come up for a vote. Only shareholders can run for and be elected to a Board position, or vote on the proposed annual budget and any other matters.

Both the SPWC and RA encourage new homeowners to purchase shares and contribute their voice to the Park’s management. Please contact the SPWC or RA Secretary to obtain stock purchase forms for each company.

Gate Access: the Seller should give to the agent escrow officer all keys to the property including the gate access devices. These should be transferred to the new owners.

There are two types of gate openers: remote device and a card key device. Once the new property owner receives these devices from the seller, they must contact the Director in charge of the gate to get the devices registered in their name and keep them active. If the new owners do not contact the Director and the Board of Directors receives notification of the sale, the devices will be deactivated within 4 weeks of the sale.

Since many devices get lost or misplaced, additional devices may be purchased at the cost of $55 for a remote device and $35 for a card device. We try to limit the number of devices per property to 6 but realize there may be multi-families sharing a property where more devices are needed.

Accessing entry for visitors to your home: You must have a 209 area code phone number in your home. A three digit gate code will be given to you and your name will be added to the Alpha List at the gate, where visitors can search for your code. If visitors have your code already, they should punch in the number at the gate and press “call”. Once you answer in your home, you press *9 to open the gate. A card will be given to you by the gate Director with your code and the instructions.
