Now, more than ever, procedural systems must be in place, first to foster, then to document, the process of compliance. The relationship of FHAA, Section 504, and ADA, taken together, require substantial but manageable changes in the way management must operate both at the property level and organization-wide levels.

Compliance actions must provide the protection afforded those covered by these laws, while considering the practical limitations that may be encountered, as the cost and burden of these actions are measured against each property's ability to pay. The laws require compliance and accommodation to the fullest extent, yet each law also recognizes that full compliance may not be possible. Declaring an undue financial and administrative burden or fundamental alteration of the program does not relieve an owner/management of compliance responsibilities.

1. NHE, Inc. is pledged to the letter and spirit of U.S. policy for the achievement of equal housing opportunity throughout the nation. We encourage and support an affirmative advertising and marketing program in which there are no barriers to obtaining housing because of race, color, religion, sex, handicap, familial status, or national origin.

2. NHE, Inc. proudly and strictly adheres to the Rehabilitation Act of 1973 (Section 504), Fair Housing Amendments Act of 1988 (FHAA) and the American with Disabilities Act of 1990 (ADA), as well as the Civil Rights Act of 1968.

3. NHE, Inc. will seek to identify and eliminate situations or procedures which create a barrier to equal housing opportunity for all. In accordance with Fair Housing and Section 504, NHE, Inc. will make reasonable accommodations and structural modifications for applicants or residents with disabilities. Such accommodations may include changes in the method of administering policies, procedures, services and making structural modifications when necessary.

4. The selection of residents will be made fairly and consistently based on all applicable Fair Housing laws.

5. All prospective residents shall be equally informed of available apartments.

6. No preference regarding waiting lists, referrals, applications, maintenance requests, or rent promotions shall be given to any prospective or current resident based upon that person's race, national origin, color, religion, sex, familial status, or disability.

7. If a prospective resident inquires about the resident mix at any property, it should be politely explained that we select residents based on their ability to pay rent and to comply with the terms of the Lease.

8. Each employee is to receive a copy of the Fair Housing Compliance Statement which must be signed attesting to their understanding and compliance on the initial date of employment. This statement becomes part of the personnel file.

9. All NHE, Inc. community rental offices are required to have and display an Equal Housing Opportunity (EHO) poster.

10. The EHO logo type or slogan must be used prominently in all advertising (print, television, radio, etc.). In any advertisements where other logos appear, the EHO logo should be at least equal in size to the other logos.

11. The Fair Housing logo, slogan, and statement are listed below. When used, they must be displayed as shown:

c. The Equal Housing Opportunity Statement is as follows:

12. It is important to understand that any action taken by you even in part because of race, color, creed, religion, national origin, sex, marital status, disability, (physical or mental handicap) or familial status (except where the property is specifically designated for a particular age group) that has the effect of making housing unavailable to such persons protected under these laws constitutes a violation of the Fair Housing laws and subjects you and the Company to substantial liability.

13. While there are no guaranteed measures to ensure that a Fair Housing Complaint is never filed against you, your property, and/or the company, there are a few guidelines you can follow to minimize exposure to any charges arising from even "an appearance" of discrimination.

14. Should you receive a Fair Housing Complaint, contact your “supervisor” immediately.
