054610The Minimum Data Set – Section Q Frequently Asked Questions – DECEMBER 2014What is the MDS?The Minimum Data Set or MDS, is the functional assessment given to all residents in all Medicare or Medicaid certified nursing facilities. What are the federal laws around MDS?It is required by federal statute that all residents admitted into a nursing facility be assessed using the Minimum Data Set (MDS) 3.0 functional assessment tool upon admission, quarterly, annually, and if the resident has a significant change of condition. What is Section Q of the MDS?Section Q of the MDS was revised on October 1, 2010, with the addition of the Return to Community question Q0500. Question Q0500 specifically asks a resident, “Do you want to talk to someone about the possibility of leaving this facility and returning to live and receive services in the community?” The purpose of Section Q is to make the MDS assessment more of a person-centered process by supporting the resident’s right to make an informed choice about where they want to live and receive services. Is the Section Q question asked of all residents?Yes, the Section Q question is required to be asked of all nursing facility residents upon admission, quarterly, annually, and if the resident has a significant change of condition. What happens if the resident answers “yes” to the Section Q question?If the resident responds “yes” to Section Q, the nursing facility is required to make a referral to a local contact agency (LCA) within three (3) days. The LCA contacts the nursing facility and meets with the client within ten (10) working days to provide options counseling for the resident. Options counseling is when the LCA discusses the different options available for community based supports and services with the resident. If the resident answers “yes” to Section Q and receives options counseling do they have to leave the nursing facility?If a resident responds “yes” to Section Q and receives options counseling there is no obligation for the resident to leave the nursing facility. A “yes” answer only indicates a resident’s desire for information about community supports and services. After a resident has been given the information that they need to make an informed choice, they can then choose whether to proceed with the transition process or stay in the nursing facility. What should be done if the nursing facility is refusing to ask question Q0500 or make a referral for options counseling?If this situation happens, speak with the facility administrator, social worker, or ombudsman for more information.
