ACTIVITY: Adoption of new “Rules and Regulations to Protect the Privacy of Certain Personal Information Contained in Payroll Records Submitted to the Department of Transportation.”

STATUTORY AUTHORITY: 26 MRSA §1311; 23 MRSA §52

PURPOSE: These Rules would restrict from public disclosure certain personally identifying account numbers such as Social Security and taxpayer identification numbers contained in payroll records filed with the Maine Department of Transportation by private contractors retained by MaineDOT on projects where Federal funding and Federally-established wage & benefit minimums are not involved.

ACTIVITY: Minor amendments to MaineDOT’s “Rules for the Installation of Gas, Food, Lodging, Camping and Attractions Logo Signs on the Rural Portions of the Interstate Highway System”

PURPOSE OF THE RULE: These amendments would provide that gas stations and lodging establishments participating in this program must provide telephone service available to patrons for use in an emergency but need not provide public telephone service for personal or business use.

ACTIVITY: New Rule – “Relocating Utility Facilities Underground in Federally Designated Historic Districts on Federal-Aid Highways”

STATUTORY OR OTHER BASIS: 23 MRSA §4120-A, as enacted by PL 2005, c. 282 and amended effective June 18, 2007 by PL 2007 c. 306.

PURPOSE OF THE RULE: Pursuant to Ch. 23 §4120, the Maine Department of Transportation will develop rules to allow for application for reimbursement for relocation of overhead utilities underground in federally designated historic districts to the extent that such payments by the department are eligible for reimbursement under the federal surface transportation program pursuant to 23 United States Code, Section 133(b)(8) (2005)

ACTIVITY: New rule – “Transportation Planning Incentive Funding Program”

STATUTORY OR OTHER BASIS: 23 MRSA §73-A, as enacted effective September 20, 2007

PURPOSE OF THE RULE: It is the purpose of this rule is to facilitate the establishment and administration of a program of transportation planning incentive funding designed to further the purposes and policies of Title 23 MRSA section 73 and Title 30-A, chapter 187, subchapter 2, to encourage sound transportation planning and protect the integrity of regional transportation systems and thereby prevent or reduce the need for costly future capacity or retrofitting expenditures associated with unmanaged development along state transportation corridors. This rule is adopted pursuant to P.L. 2007, chapter 208, “An Act to Promote Transportation Planning, Increase Efficiency and Reduce Sprawl”, codified at 23 MRSA §73-A.
