Family Medical Leave Act (FMLA)

Certification Process

As Cingular’s FMLA administrator, Nationwide Better Health, is responsible for approving and tracking all absences applicable under the FMLA. If you are, or expect to be, absence from work (due to your own serious health condition or that of a family member or to care for your newborn child or a child placed with you for adoption or foster care), you should follow these steps:

• Contact Force Management and Gates-McDonald immediately to report your absence.

• If your absence is foreseeable, please call Nationwide Better Health at 1-866-4LEAVES at least 30 days prior to your absence. Otherwise, you should call Nationwide Better Health within the first 2 days of your absence.

• Nationwide Better Health’s representative will ask you a series of questions: your name, address, telephone number, date of birth, Social Security number, nature of absence, job location, your healthcare provider’s name and phone number, and your treatment dates. When asked for “Supervisor’s Name”, please advise them to contact Mike Rush at 337-279-6138.

• Nationwide Better Health will mail you a packet of FMLA information within 2 business days of your call. Unless you have made a Short-Term Disability (STD) claim concurrent with your FMLA request, Nationwide Better Health must receive the enclosed Health Care Provider Certification (HCPC) form or your claim will be denied. You should return the HCPC within 15 calendar days.

• It is your responsibility to follow up with Nationwide Better Health and your healthcare provider to ensure that the HCPC form is provided to Nationwide Better Health within the time requirement. NOTE: Your healthcare provider may require a signed authorization from you prior to releasing your medical information to Nationwide Better Health.

• Depending on the circumstances of your leave, you may be required to submit additional or subsequent medical information regarding your FMLA claim. You must comply with requests for information from Nationwide Better Health or your claim will be denied.

• If you have been approved for an Intermittent FMLA Leave, you must continue to notify Nationwide Better Health and Force upon each absence.

• Reporting Requirements: Any FMLA Intermittent days taken must be reported to Force on the same day taken. Also, these days must be reported to Nationwide Better Health within 2 days of the absence. Failure to do so can result in denials and/or delayed approvals.

• You are expected to return to work the next work day following the end of your FMLA leave, unless you have made other approved arrangements with Force. If you plan to return to work prior to the closure of your FMLA claim, please coordinate your return to work date with Nationwide Better Health and Force.

• Upon the closure of your FMLA Claim, Mike Rush will update your records accordingly.
