REPLY BRIEF "Oh what a tangled web we weave, when first we practice to deceive." Sir Walter Scott, Marmion: A Tale of Flodden Field. The only thing that is consistent in the tangled web DACS and FDLE have now woven across multiple cases, is that when called before a Court each points the finger at the other or at a third party. The agency named, whether in the particular case, or identified by statutory law, claims it is the other agency, the U.S. Department of Justice (DOJ), or another state. Alternatively, they claim the process chosen by the citizen whose rights they are infringing is the wrong process.
? File a circuit court action? You failed to exhaust administrative remedies. Heffron v. DACS.
? File an administrative claim? You can't file that here, wrong agency. R.C. v. DACS
? File an administrative claim? You have to go to the state whose hearsay upon which we are relying. R.C. v. DACS
? File an administrative remedy and appeal the denial? We have not rendered a final decision. Lynch v. FDLE.

? File for Mandamus to compel a final decision. Order to show
cause issued by this Court. Mandamus is not available, and
we have decided to moot the case to avoid responsibility.

? FDLE provide this Court an amicus brief. Half-truths,
misleading statements of law and selective quotations of
carefully selected agency reports and rules, not statutes.
I. May DACS rely on a NICS query result to determine whether an applicant is qualified for a Florida concealed carry license (CWFL)?
No. No agency of the state of Florida, including DACS or FDLE may
rely on a NICS query result to adjudicate the rights of an individual under
Florida law for any purpose.1
1 As explained infra, the NICS query is purely a matter of federal law and bears no relevance to the issues before this Court:
1. Whether R.C. was entitled to a formal hearing before a final determination of ineligibility by DACS for R.C. to receive a CWFL, and
2. Whether the record on appeal contains competent substantial evidence to support the determination of the hearing officer at the informal hearing.
3. Whether DACS' actions in denying R.C. both a license and the hearing which he was entitled to by law require an award of attorneys' fees to R.C.
