The regular monthly meeting of the Board was called to order by the Vice Chairman at 9:30 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

Mr. Ken Jones, Board member, led the members and audience in the Pledge of Allegiance, which was followed by an invocation given by Judge Darrell White, Hearing Officer then Judge White introduced himself and advised those present of his duties.

A MOTION was made by Mr. Lambert and seconded by Mr. Dupuy to accept the Minutes of the June 17, 2010 regular meeting, as typed. The Motion passed.

◙ Judgment Hearing(s):
AA Plumbing & Mechanical, LLC (CL#53435)
Administrative Hearing – Consider an alleged violation by AA Plumbing & Mechanical, LLC of the provisions of Louisiana R.S. 37:2150 - 2192, The Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (9), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief both Steven Andrew Alexander and Tracy Alexander d/b/a AA Plumbing, LLC, and you Tracy being only a Member and “Andy” being a Member and only qualifying party, for AA Plumbing & Mechanical LLC, holder of commercial contractor’s license number 53435, have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by both of you of the above statutes. This violation is based on the fact that you have a judgment which was rendered by the 22nd Judicial District Court, No. 2010-11451, Division “E”, Parish of St. Tammany, State of Louisiana, on the 10th day of March, 2010, in which both Andy Alexander and Tracy Alexander d/b/a AA Plumbing, LLC, an unlicensed contractor, were ordered to pay jointly, severally, and in solido in the principal amount of THIRTY-TWO THOUSAND FIVE HUNDRED FIFTY-FOUR DOL-LARS AND 85/100 ($32,554.85) plus 25% of that principal award as attorney’s fees, interest on the principal award at the rate of 14% per annum from March 27, 2009, until paid, and all costs of court in favor of LCR-M Limited Partnership. This judgment results in problems relating to the ability of the contractor(s), its qualifying party(ies), or any of its principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience.
Ms. Kris Fitch read the allegations against AA Plumbing & Mechanical, LLC then Judge White asked if a representative of AA Plumbing & Mechanical, LLC was present. Ms. Tracy Alexander with AA Plumbing & Mechanical, LLC and Mr. Frank White, Attorney representing LCR-M a Limited Partnership were both present.
Mrs. Alexander and Attorney White both came to the stand. Mrs. Alexander was sworn in then gave her statement.
Attorney White stated AA Plumbing & Mechanical, LLC and LCR have entered into an Agreement and AA Plumbing & Mechanical has begun making monthly payments towards the outstanding judgment in full. Then requested sixty (60) days to give AA Plumbing & Mechanical, LLC time to pay the outstanding judgment in full.
Mrs. Alexander stated their original Agreement gave them until the end of 2010 to pay the outstanding judgment in full.
A MOTION was made by Mr. Gallo and seconded by Mr. Stuart to give AA Plumbing & Mechanical, LLC until December 31, 2010 to pay the outstanding Judgment with LCR-M Limited Partnership in full. If the judgment is not paid in full by January 1, 2011, Commercial License Number 53435 held by AA Plumbing & Mechanical, LLC will immediately be revoked. The Motion passed.
Bayou Contracting, LLC (CL#49106)
Administrative Hearing – Consider an alleged violation by Bayou Contracting, LLC of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the City Court of Slidell, No. 2007C01076, Parish of St. Tammany, State of Louisiana, on the 15th day of May, 2009, in which Bayou Contracting, LLC, holder of commercial contractor’s license number 49106, was ordered to pay in the full and true sum of THIRTY FIVE THOUSAND DOLLARS AND 00/100 ($35,000.00) together with legal interest thereon from the date of judicial demand until paid and for all costs of the proceedings in favor of Ms. Rae Jeanfreau.
Ms. Kris Fitch read the allegations against Bayou Contracting, LLC then Judge White asked if a representative of Bayou Contracting, LLC was present. Mr. William Billingsley representing Bayou Contracting, LLC and Ms. Marcie Trask Graff, Executor for Ms. Rae Jeanfreau were both present.
Mr. Billingsley and Ms. Trask Graff both came to the stand and both were sworn.
Mr. Billingsley gave his statement.
Then Ms. Trask Graff gave her statement.
A MOTION was made by Mr. Meredith and seconded by Mr. Clouatre to give Bayou Contracting, LLC Sixty (60) days or by September 16, 2010 Commercial Board Meeting to pay the outstanding Judgment with RAE JEANFREAU in full. If the judgment is not paid in full within Sixty (60) Days or by September 16, 2010, Commercial License Number 49106 held by Bayou Contracting, LLC will immediately be revoked. The Motion passed.
Todd Broussard Construction, L.L.C. (CL#41517-Inactive / RL#86480)
Administrative Hearing – Consider an alleged violation by Todd Broussard Construction, L.L.C. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a default judgment which was rendered by the 15th Judicial District Court, No. 2009-2719, Parish of Lafayette, State of Louisiana, on the 10th day of August, 2009, in which Todd Broussard Construction, L.L.C., holder of commercial contractor’s license number 41517 and inactive residential contractor’s license number 86480 (can be renewed), was ordered to pay in the amount of FORTY FIVE THOUSAND THREE HUNDRED EIGHTY-SIX DOLLARS AND 92/100 ($45,386.92), together with legal interest from the date of judicial demand until paid and reasonable attorneys fees of 25% of the principal sum in favor of Scott Hebert Interiors, Inc.
Ms. Kris Fitch read the allegations against TODD BROUSSARD CONSTRUCTION, L.L.C. then Judge White asked if a representative of TODD BROUSSARD CONSTRUCTION, L.L.C. was present. Mr. Chuck Schaub, Attorney representing Scott Hebert Interiors was present, no one was present for Todd Broussard Construction, L.L.C.
Attorney Schaub came to the stand, introduced himself and who he represented.
A MOTION was made by Mr. Meredith and seconded by Mr. Dupuy to immediately revoke Commercial License Number 41517 and Residential License Number 86480 held by TODD BROUSSARD CONSTRUCTION, L.L.C. for failure to pay an outstanding Judgment with Scott Hebert Interiors, Inc. in full. The Motion passed.
Marcel Joseph Champagne (CL#41927)
Administrative Hearing – Consider an alleged violation by Marcel Joseph Champagne of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the 22nd Judicial District Court, No. 2009-16422, Division “F”, Parish of St. Tammany, State of Louisiana, on the 26th day of March, 2010, in which Champagne, Inc. and you, Marcel Joseph Champagne, holder of commercial contractor’s license number 41927, were ordered to pay in the principal amount of ONE THOUSAND NINE HUNDRED EIGHT DOLLARS AND 00/100 ($1,908.00) plus interest at the per annum rate of 18% on each unpaid invoice commencing from the twenty-fifth day of the month following the month of the invoice, attorney’s fees equal to 15% of the total of principal and interest, and costs of court, in favor of Jackson Supply Company.
Ms. Kris Fitch read the allegations against MARCEL JOSEPH CHAMPAGNE then Judge White asked if a representative of MARCEL JOSEPH CHAMPAGNE was present. Mr. Marcel Champagne and Mr. Frank White, Attorney representing Jackson Supply Company were both present.
Attorney White and Mr. Champagne both came to the stand, Mr. Champagne was sworn in.
Judge White then asked Attorney White if there was any settlement in this matter.
Attorney White stated he has spoken to Mr. Champagne’s Attorney that they have promised full payment of the outstanding amount within sixty (60) days then requested a sixty (60) days
A MOTION was made by Mr. Clouatre and seconded by Mr. Gallo to give MARCEL JOSEPH CHAMPAGNE Sixty (60) days to pay the outstanding Judgment with Jackson Supply Company in full. If the judgment is not paid in full within Sixty (60) Days Commercial License Number 41927 held by MARCEL JOSEPH CHAMPAGNE will immediately be revoked. The Motion passed.
Edward E. Montz (CL#38148)
Administrative Hearing – Consider an alleged violation by Edward E. Montz of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the 21st Judicial District Court, No. 126-103, Division “D”, Parish of Livingston, State of Louisiana, on the 2nd day of February, 2010, in which you, Edward E. Montz, III, holder of commercial contractor’s license number 38148, were ordered to pay in the principal amount of TWO THOUSAND SEVEN HUNDRED TWELVE DOLLARS AND 52/100 ($2,712.52) plus interest at the per annum rate of 12% on each unpaid invoice commencing from the twentieth day of the month following the month of the invoice until paid, attorney’s fees in the amount of $500.00, and all costs of court including the cost of the provate process server in favor of Jackson Supply Company.
This matter was settled before the 7/29/10 Commercial Board Meeting starting.
Spears Consulting, Inc. (CL#48797)
Administrative Hearing – Consider an alleged violation by Spears Consulting, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, The Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (9), and consideration of applicable penalties therein. This hearing is being called to consider suspending or revoking your commercial contractor’s license number 48797 for reason that on information and belief you, Mr. Spears, have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by you of the above statutes. This violation is based on the fact that you, Mr. Spears, as the only incorporator of this company and only qualifying party of Spears Consulting, Inc., holder of commercial contractor’s license number 48797, have a default judgment which was rendered by the 19th Judicial District Court, No. 565,816, Section 23, Parish of East Baton Rouge, State of Louisiana, on the 29th day of July, 2009, in which Spears Roofing & Consulting, LLC, an unlicensed contractor, was ordered to pay in the amount of TWENTY-TWO THOUSAND SIX HUNDRED NINETEEN DOLLARS AND 60/100 ($22,619.60) together with judicial interest from date of demand until paid and for all court costs incurred by Plaintiffs in the prosecution of this claim in favor of Laurence Delaroderie and Jackie Snow. This judgment results in problems relating to the ability of the contractor(s), its qualifying party(ies), or any of its principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience.
Ms. Kris Fitch read the allegations against SPEARS CONSULTING, INC. then Judge White asked if a representative of SPEARS CONSULTING, INC. was present. Mr. Gerald Ashy, Attorney representing Laurence Delaroderie and Jackie Snow and Laurence Delaroderie and Jackie Snow were all present.
Attorney Ashy came to the stand gave his statement then requested sixty (60) days for Spears Consulting, Inc. to satisfy the outstanding judgment.
A MOTION was made by Mr. Clouatre and seconded by Mr. Gallo to give SPEARS CONSULTING, INC. Sixty (60) days to pay the outstanding Judgment with Laurence Delaroderie and Jackie Snow in full. If the judgment is not paid in full within Sixty (60) Days Commercial License Number 48797 held by SPEARS CONSULTING, INC. will immediately be revoked. The Motion passed.
Stewart Brothers Independent Contractors (CL#36270)
Administrative Hearing – Consider an alleged violation by Stewart Brothers Independent Contractors of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (9), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief both Christopher E. Stewart and Kevin T. Stewart d/b/a Stewart Brothers Construction, and you Christopher, being only a Partner, and Kevin, being a Partner and only qualifying party, for Stewart Brothers Independent Contractors, holder of commercial contractor’s license number 36270, have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by both of you of the above statutes. This violation is based on the fact that you have a judgment which was rendered by the 21st Judicial District Court, No. 2005-0002349, Division “F”, Parish of Tangipahoa, State of Louisiana, on the 11th day of March, 2009, in which both Christopher E. Stewart and Kevin T. Stewart d/b/a Stewart Brothers Construction, an unlicensed contractor, were ordered to pay in the amount of ONE HUNDRED THIRTY FOUR THOUSAND ONE HUNDRED THIRTY TWO DOLLARS & 72/100, ($134,132.72), together with legal interest from July 11, 2005 until paid, together with attorneys fees in the amount of $5,000.00, and for all costs incurred in this proceeding in favor of Jill E. Firmin and Craig R. Firmin. IT IS FURTHER ORDERED, ADJUDGED AND DECREED that petitioners’ rights against the remaining defendants, FRED HOLLIDAY AND ALTERNATIVE SOURCE, INC. be and the same are hereby reserved. IT IS HEREBY ORDERED, ADJUDGED, AND DECREED that the Motion for New Trial filed by Christopher E. Stewart and Kevin T. Stewart was denied by the same court as stated above. The order was signed in Amite, Louisiana, on the 24th day of May, 2010. This
judgment results in problems relating to the ability of the contractor(s), its qualifying party(ies), or any of its principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience.
Ms. Kris Fitch read the allegations against Stewart Brothers Independent Contractors then Judge White asked if a representative of Stewart Brothers Independent Contractors was present. Mr. Frank DeVittorio, Attorney representing Stewart Brothers Independent Contractors, Mr. Kevin Stewart, Sr., and Mr. Chris Stewart were all present.
Attorney DeVittorio came to the stand gave his statement.
Board Attorney, Stephanie LaBorde made a statement.
Then there was discussion between Attorney DeVittorio and Board Attorney, Stephanie LaBorde regarding this judgment.
A MOTION was made by Mr. Clouatre and seconded by Mr. Gallo and Mr. Stuart to have Board Attorney, Stephanie LaBorde file paperwork in this Suit asking to the court for clarification whether that injunction is still pending – before the Board would take any action with regarding to this judgment. The Motion passed.
Clay Young Construction, L.L.C. (CL#47315)
Administrative Hearing – Consider an alleged violation by Clay Young Construction, L.L.C. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the 21st Judicial District Court, No. 126670, Division “A”, Parish of Livingston, State of Louisiana, on the 7th day of April, 2010, in which Clay Young Construction, L.L.C., holder of commercial contractor’s license number 47315, was ordered to pay in the full sum of THREE THOUSAND ONE HUNDRED SIXTY SIX DOLLARS AND 99/100 ($3,166.99), plus interest thereon from judicial demand, along with reasonable attorney fees in the amount of 25% of principal and for all costs of the proceedings in favor of Cornerstone Reconstruction Services, L.L.C. d/b/a Paul Davis Restoration of Greater Baton Rouge.
Ms. Kris Fitch read the allegations against Clay Young Construction, L.L.C then Judge White asked if a representative of Clay Young Construction, L.L.C was present. Mr. Clay Young, representing Clay Young Construction, L.L.C. and Mr. Bill Spears, representing Cornerstone Reconstruction were both present.
Mr. Young and Mr. Spears both came to the stand and both were sworn in.
Ms. Fitch stated to the Board that Items H and I were related matters, that both companies were involved.
Mr. Young stated that an Agreement had been reached.
Mr. Spears stated the Agreement was $1,000.00 until the outstanding judgment Is paid in full. That the payments will begin on August 21st. Then Mr. Spears gave Board Attorney, Stephanie LaBorde a copy of the Agreement to file into the record.
The Board asked Mr. Spears to report back to staff whether or not this judgment was paid in full or not.
A MOTION was made by Mr. Jones and seconded by Mr. Stuart to give Clay Young Construction, L.L.C. Six (6) months to pay the outstanding Judgment with Cornerstone Restoration Services, L.L.C. DBA Paul Davis Restoration of Greater Baton Rouge in full. If the judgment is not paid in full within Six (6) months Commercial License Number 47315 held by Clay Young Construction, L.L.C. will immediately be revoked. The Motion passed.
The Voltech Group LLC (CL#41944)
Administrative Hearing – Consider an alleged violation by The Voltech Group LLC of the provisions of Louisiana R.S. 37:2150 - 2192, The Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (9), and Section 115, Paragraph C, of the Rules and Regulations of the Board and in consideration of applicable penalties therein. This hearing is being called to consider suspending or revoking your commercial con- tractor’s license number 41944 for reason that on information and belief you, Mr. Young, have failed to properly engage in the business of contracting as demonstrated by your prior contracting business experience due to an alleged violation by you of the above statutes. This violation is based on the fact that you, Mr. Young, as the only Member and only qualifying party of The Voltech Group, holder of commercial contractor’s license number 41944, have a judgment which was rendered by the 21st Judicial District Court, No. 126670, Division “A”, Parish of Livingston, State of Louisiana, on the 7th day of April, 2010, in which Clay Young Construction, L.L.C., holder of commercial contractor’s license number 47315, was ordered to pay in the full sum of THREE THOUSAND ONE HUNDRED SIXTY SIX DOLLARS AND 99/100 ($3,166.99), plus interest thereon from judicial demand, along with reasonable attorney fees in the amount of 25% of principal and for all costs of the proceedings in favor of Cornerstone Reconstruction services, L.L.C. d/b/a Paul Davis Restoration of Greater Baton Rouge. Mr. Young and Mr. Spears both came to the stand and both were sworn in.
Ms. Fitch stated to the Board that Items H and I were related matters, that both companies were involved.

Administrative Hearing – Consider suspending or revoking Louisiana contractor’s license number 42959 held by Aaron Dodge Electrical Service, Inc. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.
Ms. Kris Fitch read the allegations against AARON DODGE ELECTRICAL SERVICE, INC. then Judge White asked if a representative of AARON DODGE ELECTRICAL SERVICE, INC. was present. There was no response.
A MOTION was made by Mr. Meredith and seconded by Mr. Graham to immediately revoke Commercial License Number 42959 held by AARON DODGE ELECTRICAL SERVICE, INC. for not having a current qualifying party in place. The Motion passed.
Advance Construction & Remediation, L.L.C. (MR#250349)
Administrative Hearing – Consider suspending or revoking Louisiana contractor’s license number 250349 held by Advance Construction & Remediation, L.L.C. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.

Continuance/ Administrative Hearing – Consider an alleged violation by BOURQUE CONSTRUCTION CO., INC. of the provisions of Louisiana R.S. 37:2158 (A) of the State of Louisiana Contractors’ Licensing Law, and in particular Paragraph 5, in that you have permitted your contractor’s license to be used by another when the other contractor does not hold a license for the classification of work for which the contract is entered, at the Wal-Mart Super Center, project located in Opelousas, Louisiana.
Mrs. Bobbie Hughes read the allegations against BOURQUE CONSTRUCTION CO., INC. then Judge White asked if a representative of BOURQUE CONSTRUCTION CO., INC. was present. Mrs. Jennifer Treadway Morris, Attorney representing Bourque Construction Co., Inc. and Mr. Jerry Bourque representing Bourque Construction Co., Inc. were both present.
Attorney Treadway Morris and Mr. Bourque both came to the stand, Attorney Treadway stated that her client was pleading No Contest to the allegations against Bourque Construction Co., Inc. then gave her statement.
Board Attorney, Stephanie LaBorde then gave a statement, asking that the Bourque Construction Co. and the Domestic Construction Co matters could be consolidated.
Board Attorney, Stephanie LaBorde called Tommy Mimnaugh to the stand. Mr. Mimnaugh was sworn in then Mrs. LaBorde reviewed Mr. Mimnaugh’s job duties as an investigator in the Compliance Section. Then Mrs. LaBorde began to review with Mr. Mimnaugh what he found during his investigations into these matters. Mrs. LaBorde stated that there is no exhibit packet for Bourque because they had submitted a Settlement Offer.
Attorney Treadway Morris stated her client wishes to waive the Notice of Hearing and have a hearing today. Later in the meeting, Attorney Treadway Morris withdrew this request.
Mr. Bourque was sworn in then gave his statement then was questioned by several Board Members. Mr. Bourque responded to each.
Mr. Clouate stated first there needs to be a fine of $1,000.00 plus court costs assessed against Bourque, second put on probation to report to staff and third suspend or revoke the license Bourque has with this Board.
Mr. Stuart suggested a fine against Bourque of $1,000.00 plus court costs and six (6) months probation.
Mr. Gallo suggested that the Board defer this matter until they could hear from Domestic.

Administrative Hearing – Consider an alleged violation by NRI Construction, Inc. (Delaware) of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, NRI Construction, Inc. (Delaware), entered into a contract with multiple unlicensed contractors to perform work on the Forestwood Apartments Remodel project in Baton Rouge, Louisiana, where the labor and materials combined to complete the work exceeded $50,000.00.
Mrs. Bobbie Hughes read the allegations against NRI CONSTRUCTION, INC. (DELAWARE) then Judge White asked if a representative of NRI CONSTRUCTION, INC. (DELAWARE) was present. There was no response.
Mrs. Hughes stated that NRI had submitted a Settlement Offer of $2,000.00 plus $500.00 toward court costs for a total of $2,500.00.

Administrative Hearing – Consider an alleged violation by United Demolition South, LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, United Demolition South, LLC, acted as a contractor to perform work on the Demo at Riverland Industries, Old Uniroyal Plant project in Baton Rouge, Louisiana in the amount of $300,000.00 without possessing a Louisiana state contractor’s license.
Mrs. Bobbie Hughes read the allegations against UNITED DEMOLITION SOUTH, LLC Judge White asked if a representative of UNITED DEMOLITION SOUTH, LLC was present. Mr. James Gray, Attorney representing United Demolition South, LLC and Mr. William Marino, representing United Demolition South, LLC were both present.
Attorney Gray and Mr. Marino both came to the stand, Mr. Marino was sworn in then Attorney Gray stated his client was pleading No Contest. Mr. Marino then gave his statement.
Mrs. Hughes stated that United Demolition had submitted a Settlement Offer of $1,000.00 plus $500.00 toward court costs for a total of $1,000.00.
Board Attorney, Stephanie LaBorde then gave a statement.
Mrs. Hughes stated they agree with the settlement offer.
