MINUTES TO THE REGULAR MEETING OF

November 18, 2010

The regular monthly meeting of the Board was called to order by the Chairman at 9:30 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

There being a quorum, the regular order of business began.

Mr. Chris Stuart, Board member, led the members and audience in the Pledge of Allegiance, which was followed by an invocation given by Judge Darrell White, Hearing Officer. Judge White introduced himself and advised those present of his duties.

A MOTION was made by Mr. Stuart and seconded by Mr. Clouatre to accept the Minutes of the October 21, 2010 regular meeting. The Motion passed.

The Honorable Buddy Caldwell, Attorney General, thanked the Board for inviting him to this meeting. He discussed the ongoing cooperative efforts between the LSLBC, law enforcement, and the court system. He emphasized the importance and the continuation of these partnerships to ensure protection of Louisiana’s citizenry from unlicensed, fraudulent contractors.

Mr. Jonathan McFarland, (Engineer Manager, Business Community Outreach and Incentive Division) with the Louisiana Department of Environmental Quality (DEQ), thanked the Board for inviting him to this meeting. He discussed a number of DEQ programs which could be of benefit to the Board. He also discussed the Lead and Asbestos issues, and stated that the DEQ can offer training on environmental issues or regulations which would be of interest to the LSLBC.

NEW BUSINESS:

◙ Qualifying Party Hearing(s):

NOVA MECHANICAL, L.L.C. (CL #47066)

Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 47066 held by Nova Mechanical, L.L.C. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.

Ms. Kris Fitch read the allegations against NOVA MECHANICAL, L.L.C. then asked if a representative of NOVA MECHANICAL, L.L.C. was present. There was no response.

A MOTION was made by Mr. Weston and seconded by Mr. Dupuy to give NOVA MECHANICAL, L.L.C. thirty (30) days to have a new qualifying party in place. If after thirty (30) days a new qualifying party is not in place, there will be immediate revocation of Commercial License Number 47066 held by NOVA MECHANICAL, L.L.C. The Motion passed.

◙ Compliance Hearing(s):

Frey-Moss Structures, Inc. (CL #37232

Administrative Hearing – Consider an alleged violation by Frey-Moss Structures, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Frey-Moss Structures, Inc., entered into a contract with an unlicensed contractor to perform work on the RaceTrac project in Baton Rouge, Louisiana in an amount in excess of $50,000.00.

Ms. Bobbie Hughes read the allegations against FREY-MOSS STRUCTURES, INC. and gave a brief synopsis of the allegations. Ms. Hughes stated that FREY-MOSS STRUCTURES, INC. had submitted a Settlement Offer of $500.00 plus Administrative fees associated with these proceedings.

A MOTION was made by Mr. Weston and seconded by Mr. Gallo to submit a substitute proposal back to FREY-MOSS STRUCTURES, INC. of $1,000.00 plus Administrative Fees associated with these proceedings. The Motion passed.

Lamar Contractors, Inc. (CL #16384)

Administrative Hearing – Consider an alleged violation by Lamar Contractors, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Lamar Contractors, Inc., entered into a contract with an unlicensed contractor to perform work on the RaceTrac project in Baton Rouge, Louisiana in an amount in excess of $50,000.00.

Ms. Bobbie Hughes read the allegations against LAMAR CONTRACTORS, INC. Ms. Hughes stated that LAMAR CONTRACTORS, INC. had submitted a Settlement Offer of $1,000.00 plus Administrative Fees associated with these proceedings.

A MOTION was made by Mr. Weston and seconded by Mr. Gallo to accept the Settlement Offer of $1,000.00 plus Administrative Fees associated with these proceedings. The Motion passed.

RaceTrac Petroleum, Inc. (Unlicensed)

Administrative Hearing – Consider an alleged violation by RaceTrac Petroleum, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, RaceTrac Petroleum, Inc., acted as a contractor to perform work on the RaceTrac project in Baton Rouge, Louisiana in the amount of $437,000.00 without possessing a Louisiana state contractor’s license.

Ms. Bobbie Hughes read the allegations against RACETRAC PETROLEUM, INC. Ms. Hughes stated that RACETRAC PETROLEUM, INC. had submitted a Settlement Offer of $5,000.00 including Administrative Fees associated with these proceedings.

A MOTION was made by Mr. Weston and seconded by Mr. Gallo to accept the Settlement Offer of $5,000.00 including Administrative Fees associated with these proceedings. The Motion passed.

Shaw Enterprises LLC (Unlicensed)

Administrative Hearing – Consider an alleged violation by Shaw Enterprises LLC, of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Shaw Enterprises LLC, acted as a contractor to perform work on the Krewe of Aphrodite Roofing System and Exterior project in Houma, Louisiana in the amount of $79,000.00 without possessing a Louisiana state contractor’s license.

Ms. Bobbie Hughes read the allegations against SHAW ENTERPRISES LLC and asked if a representative of SHAW ENTERPRISES LLC was present. There was no response. Ms. Laborde called Compliance Investigator, Charlie Pellegrin to the stand and he was sworn in by Judge White. Ms. Laborde questioned Mr. Pellegrin regarding his duties as a Compliance Investigator and his investigatory findings. Ms. Laborde reviewed the exhibit packet with Mr. Pellegrin. Ms. Laborde requested the exhibit packet for SHAW ENTERPRISES LLC be received into the record. Judge White accepted the exhibit packet into the record.

A MOTION was made by Mr. Weston and seconded by Mr. Gallo to find SHAW ENTERPRISES LLC Guilty. The Motion passed.

A MOTION was made by Mr. Weston and seconded by Mr. Gallo to assess SHAW ENTERPRISES LLC. a fine of 10% of $79,000.00 plus Administrative Fees associated with these proceedings. The Motion passed.

Sunset Solutions, LLC (CL #51091)

Administrative Hearing – Consider an alleged violation by Sunset Solutions, LLC of the provisions of Louisiana R.S. 37: 2158 (A) of the State of Louisiana Contractors’ Licensing Law, and in particular Paragraph 9, problems relating to the ability of the contractor, its qualifying party, or any of its principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience, at but not limited to the Family Dollar project located in Baton Rouge, Louisiana.

Ms. Bobbie Hughes read the allegations against Sunset Solutions, LLC then asked if a representative was present. Attorney Dana Bolton, representing Sunset Solutions and Mr. Jonathan Grimmett both made an appearance on behalf of SUNSET SOLUTIONS, LLC. Mr. Grimmett was sworn in. Mr. Bolton reported to the Board that his client will appear in court on December 13, 2010 for charges he believes will be dismissed. He requested that the Board grant a Stay of any Action against Mr. Grimmett pending the outcome of the court hearing.

A MOTION was made by Mr. Meredith and seconded by Mr. Fenet to approve a Stay of any Action against SUNSET SOLUTIONS, pending the outcome of the court hearing on December 13, 2010. After ninety (90) days, Attorney Bolton should contact the LSLBC staff to advise them whether or not this matter has been resolved. If after ninety (90) days this matter is not resolved, this Board can request that this matter be reset for hearing. The Motion passed.

Campo Contractors, L.L.C. (CL #37719)

Administrative Hearing – Consider an alleged violation by Campo Contractors, L.L.C., of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Campo Contractors, L.L.C., entered into multiple contracts with multiple unlicensed contractors to perform work on the Dutchtown High School Stadium - Home Side Bleachers project in Geismar, Louisiana in an amount in excess of $50,000.00.

Ms. Bobbie Hughes read the allegations against CAMPO CONTRACTORS, L.L.C. and asked if a representative was present. There was no response. Ms. Hughes gave a brief synopsis regarding the allegations against CAMPO CONTRACTORS, L.L.C. Ms. Hughes stated that CAMPO CONTRACTORS, L.L.C. had submitted a Settlement Offer of $1,000.00 plus Administrative Fees associated with these proceedings.

A MOTION was made by Mr. Weston and seconded by Mr. Meredith to accept the Settlement Offer of $1,000.00 plus Administrative Fees associated with these proceedings. The Motion passed.

MGM Construction Services, LLC (Unlicensed)

Administrative Hearing – Consider an alleged violation by MGM Construction Services, LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, MGM Construction Services, LLC, acted as a contractor to perform work on the Dutchtown High School Stadium - Home Side Bleachers project in Geismar, Louisiana in the amount of $58,000.00 without possessing a Louisiana state contractor’s license.

Ms. Bobbie Hughes read the allegations against MGM CONSTRUCTION SERVICES, LLC and asked if a representative was present. There was no response. Ms. Laborde called Compliance Investigator, Johnny Rogers to the stand. He was sworn in. Ms. Laborde questioned Mr. Rogers regarding his duties as a Compliance Investigator and his investigatory findings. Ms. Laborde reviewed the exhibit packet with Mr. Rogers. Ms. Laborde requested the exhibit packet for MGM CONSTRUCTION SERVICES, LLC be received into the record. Judge White accepted the exhibit packet into the record.

A MOTION was made by Mr. Gallo and seconded by Mr. Weston to find MGM CONSTRUCTION SERVICES, LLC Guilty. The Motion passed.

A MOTION was made by Mr. Gallo and seconded by Mr. Weston to assess MGM CONSTRUCTION SERVICES, LLC a fine of 10% of $58,000.00 plus Administrative Fees associated with these proceedings. The Motion passed.

Feazel Electrical Contracting Inc. (CL #32754)

Administrative Hearing – Consider an alleged violation by Feazel Electrical Contracting, Inc., of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Feazel Electrical Contracting, Inc., entered into a contract with an unlicensed general contractor to perform work on the Verizon Wireless Store - Finish Out project in Bossier City, Louisiana.

Ms. Bobbie Hughes read the allegations against Feazel Electrical Contracting Inc. and asked if a representative was present. Mr. James Feazel came to the stand and was sworn in. Mr. Feazel entered a plea of Guilty, that Feazel Electrical Contracting Inc had submitted a bid to an unlicensed contractor. Mr. Feazel further advised that he had no objection to the consolidation of related matters. Ms. Hughes gave a brief synopsis regarding the allegations against Feazel Electrical Contracting Inc.

In his testimony to the Board, Mr. Feazel described that it had come to his attention that Lucky Construction needed an electrical subcontractor, and they had begun to enter into a contract with Lucky Construction. After the Project Manager for FEAZEL ELECTRICAL CONTRACTING INC. tried to pull the electrical permit for this project with the City of Bossier, and brought it to Mr. Feazel, he noticed that Mustang Homes was listed as the general contractor on the permit. Mr. Feazel contacted the City of Bossier and was informed that Lucky Construction did not have a permit and, furthermore, that they were not a licensed contractor in Louisiana. Mr. Feazel withdrew from the project.

A MOTION was made by Mr. Weston and seconded by Mr. Meredith to dismiss the allegations against Feazel Electrical Contracting Inc. The Motion passed.

Lucky Construction, Inc. (Unlicensed)

Administrative Hearing – Consider an alleged violation by Lucky Construction, Inc., of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Lucky Construction, Inc., acted as a contractor to perform work on the Verizon Wireless Store - Finish Out project in Bossier City, Louisiana in the amount of $250,000.00 without possessing a Louisiana state contractor’s license.

Ms. Bobbie Hughes read the allegations against LUCKY CONSTRUCTION, INC. and asked if a representative was present. Mr. Steven Lucky came to the stand and was sworn in. Mr. Lucky entered a plea of Not Guilty. Mr. Lucky further advised that he had no objection to the consolidation of related matters.

Ms. Laborde called Compliance Investigator, Paige Fretwell to the stand, and she was sworn in. Ms. Laborde questioned Ms. Fretwell regarding her duties as a Compliance Investigator and her investigatory findings. Ms. Laborde reviewed the exhibit packet with Ms. Fretwell. Ms. Laborde requested the exhibit packet for LUCKY CONSTRUCTION, INC. be received into the record. Judge White accepted the exhibit packet into the record.

Mr. David Griffin, Project Manager for LUCKY CONSTRUCTION, INC., came to the stand and was sworn in. He testified before the Board that LUCKY CONSTRUCTION, INC. was located in Dallas, Texas, and that a contractor in Texas is not required to be licensed.

A MOTION was made by Mr. Meredith and seconded by Mr. Gallo and Mr. Graham to find LUCKY CONSTRUCTION, INC. guilty of performing work on the Verizon Wireless project without possessing a Louisiana state contractor’s license. The Motion passed.

A MOTION was made by Mr. Weston and seconded by Mr. Meredith to assess LUCKY CONSTRUCTION, INC. a fine of $5,000.00 plus Administrative Fees associated with these proceedings. The Motion passed.

MUSTANG BUILDERS, INC. (CL #31885)

Administrative Hearing – Consider an alleged violation by MUSTANG BUILDERS, INC. of the provisions of Louisiana R.S. 37:2158 (A,5) of the State of Louisiana Contractors’ Licensing Law, in that you have permitted your contractor’s license to be used by another when the other contractor does not hold a license for the classification of work for which the contract is entered, at Verizon Wireless Store - Finish Out Project, located in Bossier City, Louisiana.

Ms. Bobbie Hughes read the allegations against MUSTANG BUILDERS, INC. and asked if a representative was present. Mr. Brian Lowery came to the stand and was sworn in. Mr. Lowery entered a plea of Not Guilty. Mr. Lowery further advised that he had no objection to the consolidation of related matters.

Mr. Lowery testified that he did not have any knowledge of the events leading up to the time that Ms. Fretwell contacted him about a possible violation. He further testified that Ms. Fretwell asked him about the job in question, in particular why his residential company pulled a permit for an unlicensed commercial contractor. Mr. Lowery could not explain why his accountant signed a check for the permit to be pulled for Lucky Construction, or why they would have received monies from Lucky Construction. Mr. Lowery also stated that he checked their bank records to review whether checks from Lucky had been deposited, and they had not. He stated that once he found out what happened, he instructed his staff to terminate its dealings with Lucky.

Ms. Laborde called Compliance Investigator, Paige Fretwell to the stand. Ms. Laborde questioned Ms. Fretwell regarding her duties as a Compliance Investigator and her investigatory findings. Ms. Laborde reviewed the exhibit packet with Ms. Fretwell. Ms. Laborde requested the exhibit packet for MUSTANG BUILDERS, INC. be received into the record. Judge White accepted the exhibit packet into the record.

A MOTION was made by Mr. Meredith and seconded by Mr. Graham and Mr. Clouatre to find MUSTANG BUILDERS, INC. guilty of entering into a contract without holding a license for that classification, and for allowing their license to be used by an unlicensed contractor. The Motion passed.

A MOTION was made by Mr. Meredith and seconded by Mr. Gallo to assess MUSTANG BUILDERS, INC. a fine of $1,000.00 plus Administrative Fees associated with these proceedings, and six (6) months probation. The Motion passed.

Universal Plumbing Company of Shreveport, Inc. CL #50127)

Administrative Hearing – Consider an alleged violation by Universal Plumbing Company of Shreveport, Inc., of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Universal Plumbing Company of Shreveport, Inc., entered into a contract with an unlicensed general contractor to perform work on the Verizon Wireless Store - Finish Out project in Bossier City, Louisiana.

Ms. Bobbie Hughes read the allegations against UNIVERSAL PLUMBING COMPANY OF SHREVEPORT, INC. and asked if a representative was present. Mr. Trey Giglio came to the stand and was sworn in. Mr. Giglio entered a plea of No Contest. Mr. Giglio further advised that he had no objection to the consolidation of related matters.

Mr. Giglio testified to the Board that he was approached by Lucky Construction, Inc. to submit a proposal to Lucky Construction for work. UNIVERSAL PLUMBING COMPANY OF SHREVEPORT, INC. submitted a proposal, and was awarded the job. Before beginning any work, UNIVERSAL PLUMBING OF SHREVEPORT, INC. pulled a permit with the City of Bossier. Mr. Giglio learned of the involvement of Mustang Builders from Ms. Paige Fretwell. Mr. Giglio notified his employees to cease working immediately.

A MOTION was made by Mr. Weston and seconded by Mr. Mallett and Mr. Meredith to dismiss the allegations against UNIVERSAL PLUMBING COMPANY OF SHREVEPORT, INC. The Motion passed.

BARBER PLUMBING (Unlicensed)

Administrative Hearing – Consider an alleged violation by Barber Plumbing of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Barber Plumbing, acted as a contractor to perform work on the China Flag Buffet project in Bossier City, Louisiana in the amount of $10,000.00 without possessing a Louisiana state contractor’s license.

Ms. Bobbie Hughes read the allegations against BARBER PLUMBING and asked if a representative was present. Mr. James Barber made an appearance on behalf of BARBER PLUMBING. After being sworn in by Judge White, Mr. Barber entered a plea of Not Guilty.

Ms. Laborde called Compliance Investigator, Paige Fretwell to the stand. Ms. Laborde questioned Ms. Fretwell regarding her duties as a Compliance Investigator and her investigatory findings. Ms. Laborde reviewed the exhibit packet with Ms. Fretwell. Ms. Laborde requested the exhibit packet for BARBER PLUMBING be received into the record. Judge White accepted the exhibit packet into the record.

Mr. Barber stated the he is the owner of Barber Plumbing. He was hired to fix leaks on an existing plumbing job that Basto Plumbing had installed. A permit was pulled with the city in the amount of $10,000, but BARBER PLUMBING’S amount was $6,000. After he completed the work, he was never paid. Mr. Barber stated to the Board that he was aware of the LSLBC licensing laws, and the $10,000 threshold. Board Members questioned Ms. Fretwell. Ms. Fretwell reported that the total costs of the plumbing job was over $10,000, that there were several plumbers on the job site, and that Mr. Barber was being honest in his testimony regarding his amount of the project.

A MOTION was made by Mr. Lambert and seconded by Mr. Gallo and Mr. Fenet to dismiss the allegations against BARBER PLUMBING. The Motion passed.

A MOTION was made by Mr. Gallo and seconded by Mr. Meredith to accept the Settlement Offer submitted by COMMERCIAL MECHANICAL, INC. The Motion passed.

COMMITTEE REPORTS

Staff Report

Ms. Dupuy called upon Doug Traylor to address the Board on the recent Reciprocity Agreement with the State of Kentucky. A Motion was made by Mr. Gallo and seconded by Mr. Jones to approve the new Reciprocity Agreement with the State of Kentucky. The Motion passed.

Ms. Dupuy recognized the Special Guests who attended the Investigative and Supervisory Workshop on November 17th at the Louisiana State Licensing Board for Contractor’s Office. Agencies represented included the Department of Justice, Office of the State Fire Marshal, Department of Insurance, Department of Environmental Quality, New Orleans Police Department and New Orleans District Attorney’s Office. Ms. Dupuy then called on Brent Templet, Compliance Director. Mr. Templet introduced and recognized his investigative staff.

Ms. Dupuy introduced National Regulatory Instructor and Professional Speaker, Mr. Tom Hannah. Mr. Hannah came forward and spoke briefly to the Board Members.

Building Committee

No report.

Classification and Testing Committee

Mr. Weston stated that Mr. Dupuy would give the Classification and Testing Committee report later in the meeting.

Legislative/Rules and Regulations Committee

No report.

Mr. McDuff stated that the new Rules and Regulations would be presented next month.

Act 725 Committee

No report.

FINANCE COMMITTEE

A MOTION was made by Mr. Dupuy and seconded by Mr. Clouatre to adjust the 2010 Operating Budget as follows: The Motion passed

• Transfer $2,000.00 from General Insurance Account to FICA Account
