MINUTES TO THE REGULAR MEETING OF

March 25, 2010

The regular monthly meeting of the Board was called to order by the Chairman at 9:45 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

Judge White asked every one present to bow their heads for a moment of Silent Prayer in remembrance of Leonard Servat, a valued Employee, who recently passed away.

Mr. Dupuy, Board member, led the members and audience in the Pledge of Allegiance, which was followed by an invocation given by Judge Darrell White, Hearing Officer then Judge White introduced himself and advised those present of his duties.

A MOTION was made by Mr. Lambert and seconded by Mr. Clouatre to accept the Minutes of the February 18, 2010 regular meeting, as typed. The motion carried unanimously.

Mr. McDuff introduced Mr. Richard McGimsey, with the Attorney General’s Office and Mr. Tripp Hawthorne, the New Board Attorney effective April 1st.

Mr. West thanked Mr. McGimsey for his assistance to this Board.

◙ Judgment Hearings:

Olivier’s Building Contractors, Inc. (CL #42112 – Inactive)

Administrative Hearing – Consider an alleged violation by Olivier’s Building Contractors, Inc. of the provisions of Louisiana R. S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgement which was rendered by the Lake Charles City Court, No. 07-2892, Parish of Calcasieu, State of Louisiana, on the 7th day of February, 2008, in which you, Mr. Olivier, D/B/A Total Restoration Service and Olivier’s Building Contractors, Inc., holder of inactive commercial contractor’s license number 42114 (can be renewed – license expired on January 10, 2010), were ordered to pay in the amount of SEVEN THOUSAND, SEVEN HUNDRED DOLLARS AND 00/100, ($7,700.00) together with legal interest from February 7, 2008 until paid, and all costs of court in favor of Justin Clark and Kelly Clark.

Ms. Kris Fitch read the allegations against OLIVIER’S BUILDING CONTRACTORS, INC. then asked if a representative of OLIVIER’S BUILDING CONTRACTORS, INC. was present. Mr. Patrick Olivier was present.

Mr. Olivier came to the stand, he was sworn.

Mr. Justin and Kelly Clark were not present at the meeting.

A MOTION was made by Mr. Weston and seconded by Mr. Meredith to revoke the license held by OLIVIER’S BUILDING CONTRACTORS, INC. The motion carried unanimously.

◙ Qualifying Party Hearing(s):

All-Temp Refrigeration Services, Inc. (CL #31407)

Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 31407 held by All-Temp Refrigeration Services, Inc. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.

Ms. Kris Fitch read the allegations against ALL-TEMP REFRIGERATION SERVICES, INC. then asked if a representative ALL-TEMP REFRIGERATION SERVICES, INC. was present. There was no response.

Ms. Fitch stated that they were 5 months passed due, that 2 letters had been mailed to them and we have service on the Notice of Hearing and they have voluntarily surrendered their license and requested it be put in the status of In-active.

A MOTION was made by Mr. Gallo and seconded by Mr. Clouatre to accept the surrendered Commercial License Number 31407 held by ALL-TEMP REFRIGERATION SERVICES, INC. The motion carried unanimously.

CST Environmental, Inc. (CL #29791 & MRL #250094)

Administrative Hearing – Consider suspending or revoking the Louisiana commercial contractor’s license number 29791 and the mold remediation contractor’s license number 250094 held by CST Environmental, Inc. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.

Ms. Kris Fitch read the allegations against CST ENVIRONMENTAL, INC. then asked if a representative CST ENVIRONMENTAL, INC. was present. There was no response.

Ms. Fitch stated that they were 7 months passed due, that 2 letters had been mailed to them and we have service on the Notice of Hearing and they have voluntarily surrendered their license and requested it be put in the status of In-active.

A MOTION was made by Mr. Meredith and seconded by Mr. Gallo to accept the surrendered Commercial License Number 29791 and Mold Remediation License Number 250094 held by CST ENVIRONMENTAL, INC. The motion carried unanimously.

Deloach Corporation (CL #29661)

Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 29661 held by Deloach Corporation for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.

Ms. Kris Fitch read the allegations against DELOACH CORPORATION then asked if a representative DELOACH CORPORATION was present. There was no response.

Ms. Fitch read a letter the Board had received from Deloach Corporation.

A MOTION was made by Mr. Graham and seconded by Mr. Gallo to revoke Commercial License Number 29661 held by DELOACH CORPORATION for not having a qualifying party. The motion carried unanimously.

Marine Electric, L.L.C. (CL #48794)

Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 48794 held by Marine Electric, L.L.C. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.

Ms. Kris Fitch read the allegations against MARINE ELECTRIC, L.L.C. then asked if a representative MARINE ELECTRIC, L.L.C. was present. There was no response.

Ms. Fitch stated that they were 7 months passed due, that 2 letters had been mailed to them and we have service on the Notice of Hearing and staff recommends revoke their license.

A MOTION was made by Mr. Weston and seconded by Mr. Gallo to give MARINE ELECTRIC, L.L.C. thirty (30) days to get a new qualifying party in place. If not done within the thirty (30) days their Commercial License Number 48794 will be revoked. The motion carried unanimously.

Renovation General Contractors, Inc. (CL #47062)

Administrative Hearing – Consider removing the classification of Building Construction from the Louisiana contractor’s license number 47062 held by Renovation General Contractors, Inc. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.

Ms. Kris Fitch read the allegations against RENOVATION GENERAL CONTRACTORS, INC. then asked if a representative RENOVATION GENERAL CONTRACTORS, INC. was present. There was no response.

Ms. Fitch stated that they were 4 months passed due, that 2 letters had been mailed to them and we have service on the Notice of Hearing, staff recommends just removing the Building Construction classification.

A MOTION was made by Mr. Weston and seconded by Mr. Gallo to remove the Building Construction classification from Commercial License Number 47062 held by RENOVATION GENERAL CONTRACTORS, INC. The motion carried unanimously.

Shamrock Management, L.L.C. (CL #49899)

Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 49899 held by Shamrock Management, L.L.C. for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.

Ms. Kris Fitch read the allegations against SHAMROCK MANAGEMENT, L.L.C. then asked if a representative SHAMROCK MANAGEMENT, L.L.C. was present. Mr. William Kelly representing Shamrock Management, L.L.C. was present.

Mr. Kelly came to the stand, was sworn in.

Ms. Fitch stated that they were 14 months passed due, that 2 letters had been mailed to them and we had service on the both Notice of Hearings, staff recommends revoking their license.

A MOTION was made by Mr. Weston and seconded by Mr. Gallo to give SHAMROCK MANAGEMENT, L.L.C. thirty (30) days to get a new qualifying party in place. If not done within the thirty (30) days their Commercial License Number 49899 will be revoked. The motion carried unanimously.

Woods Restoration Services, LLC (CL #44089)

Administrative Hearing – Consider suspending or revoking the Louisiana contractor’s license number 44089 held by Woods Restoration Services, LLC for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.

Ms. Kris Fitch read the allegations against WOODS RESTORATION SERVICES, LLC then asked if a representative WOODS RESTORATION SERVICES, LLC. was present. There was no response.

Ms. Fitch stated that they were 13 months passed due, that 2 letters had been mailed to them and we had service on the both Notice of Hearings, staff recommends revoking their license.

A MOTION was made by Mr. Weston and seconded by Mr. Graham to revoke Commercial License Number 44089 held by WOODS RESTORATION SERVICES, LLC for nothing have a qualifying party. The motion carried unanimously.

◙ Continuances - Compliance Hearing(s):

Toolcraft Machine & Tool (Unlicensed)

Continuance – Consider an alleged violation by Toolcraft Machine & Tool of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Toolcraft Machine & Tool, acted as a contractor to perform work on the Franke Beverage Systems, Inc. project in Ruston, Louisiana in the amount of $117,500.00 without possessing a Louisiana state contractor’s license.

Mrs. Bobbie Hughes stated that items B and C were related matter and could be heard together then Mrs. Hughes read the allegations against TOOLCRAFT MACHINE & TOOL and FRANKE BEVERAGE SYSTEMS, INC. then she read the Settlement Offer of $1,000.00 plus $500.00 administrative fees associated with these proceedings for a total of $1,500.00 submitted by Toolcraft Machine & Tool.

Then Ms. Hughes read the Settlement Offer of $3,525.00 plus $500.00 administrative fees associated with these proceedings for a total of $4,025.00 submitted by FRANKE BEVERAGE SYSTEMS, INC.

Mrs. Hughes gave a brief statement what happened in this matter.

A MOTION was made by Mr. Gallo and seconded by Mr. Fenet to accept the Settlement Offer of $1,000.00 plus $500.00 administrative fees associated with these proceedings for a total of $1,500.00 submitted by TOOLCRAFT MACHINE & TOOL. The motion carried unanimously.

Franke Beverage Systems, Inc. (Unlicensed)

Continuance – Consider an alleged violation by Franke Beverage Systems, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Franke Beverage Systems, Inc., acted as a contractor to perform work on the Franke Beverage Systems, Inc. project in Ruston, Louisiana in the amount of $117,500.00 without possessing a Louisiana state contractor’s license.

Administrative Hearing – Consider an alleged violation by JRDKS Construction, L.L.C. of Rules and Regulations Section 1111, and consideration of applicable penalties therein. This hearing is being called for reason on information and belief that, JRDKS Construction, L.L.C., was unable to provide bonding and insurance coverage as required by the proposal bid for the execution of the project(s).

Mrs. Bobbie Hughes stated that they could not get service on this Notice of Hearing, so this matter was continued until next month.

Envirotech Services, L.L.C. (CL #45470)

Administrative Hearing – Consider an alleged violation by Envirotech Services, L.L.C. of Rules and Regulations Section 1111, and consideration of applicable penalties therein. This hearing is being called for reason on information and belief that Envirotech Services, L.L.C., was unable to provide bonding and insurance coverage as required by the proposal bid for the execution of the project(s).

Mrs. Bobbie Hughes read the allegations against ENVIROTECH SERVICES, L.L.C. then asked if a representative of ENVIROTECH SERVICES, L.L.C. present. Mr. Lloyd Broussard representing Envirotech Services, L.L.C. was present.

Mr. Broussard came to the stand, was sworn in.

Mr. Meredith questioned Mrs. Hughes. Mrs. Hughes responded.

Mr. Hawthorne made a statement.

Mr. Broussard gave his statement then requested a continuance in this matter.

A MOTION was made by Mr. Weston and seconded by Mr. Holloway to give ENVIROTECH SERVICES, L.L.C. an extension until the April 15, 2010 Commercial Board Meeting. The motion carried unanimously with Mr. Graham recusing himself.

Picke Construction Corporation (CL #45733)

Administrative Hearing – Consider an alleged violation by Picke Construction Corporation of Rules and Regulations Section 1111, and consideration of applicable penalties therein. This hearing is being called for reason on information and belief that, Picke Construction Corporation was unable to provide bonding and insurance coverage as required by the proposal bid for the execution of the project(s).

Mrs. Bobbie Hughes stated that they could not get service on this Notice of Hearing, so this matter was continued until next month.

BENETECH, L.L.C. (CL #48544)

Administrative Hearing – Consider an alleged violation by BENETECH, L.L.C. of Rules and Regulations Section 1111, and consideration of applicable penalties therein. This hearing is being called for reason on information and belief that, BENETECH, L.L.C., was unable to provide bonding and insurance coverage as required by the proposal bid for the execution of the project(s).

Mrs. Bobbie Hughes read the allegations against BENETECH, L.L.C. then asked if a representative of BENETECH, L.L.C. present. Mr. Jason Cavignac and Mrs. Claire Easterling, Attornies representing Benetech, L.L.C. and Mr. William Bennett representing Benetech, L.L.C. were all present.

Mr. Meredith questioned Mrs. Hughes. Mrs. Hughes responded.

Attorney Cavignac and Attorney Easterling both came to the stand. Attorney Cavignac gave his statement.

Mr. Hawthorne called Brent Templet to the stand he was sworn in then Mr. Templet introduced himself and responded to Mr. Hawthorne’s questions.

Mr. Hawthorne requested that the Benetech, L.L.C. exhibit packet be entered into the record. Judge White asked Attorney Cavignac if he had any objections? Attorney Cavignac responded no. Judge White stated it would be accepted into the record.

Attorney Cavignac then questioned Mr. Templet. Mr. Templet responded.

Then Attorney Cavignac stated he had three (3) witnesses with him to testify today.

Mr. Talbot responded to Attorney Cavignac.

Mr. Talbot questioned Mr. William Bennett, Sr. Mr. William Bennett, Sr. responded.

Attorney Cavignac called Mr. Bennett’s son – William (Aaron) Bennett to the stand Mr. William Bennett was sworn in then introduced himself. Attorney Cavignac then questioned Mr. Bennett. Mr. Bennett responded.

Mr. Talbot asked Mr. Bennett if he was finished. Mr. Bennett responded yes.

Mr. Meredith asked Mr. Bennett if his company was seeking legal action against JRDKS. Mr. Bennett responded they are suing them, they also notified the state. The State office of Insurance Commissioner has it own statewide investigation. Several places inside of Louisiana and they found out all of the country these this company is selling bonds that are no good. The letter they received mentioned something about 150 victims of this.

Mr. Meredith then questioned to staff, why are we hearing this company and JRDKS is not here, hot hearing them.

Mrs. Hughes responded because we couldn’t not get service on JRDKS. The address that they have on file at the Licensing Board, they went to that address to hand serve the Notice of Hearing the office is empty. The found a couple of other addresses they went to those other addresses it seems they have disappeared.

Mr. Meredith asked Mrs. Hughes are they licensed?

Mrs. Hughes responded yes sir they are.

Mr. Meredith stated they need to do something about that don’t they.

Mr. Talbot asked if there were any other questions.

Mr. Lambert questioned Mr. Bennett if his records would show what he paid these people – Infinity? Attorney Cavignac stated amount he thinks in checks also. Mr. Bennett responded he thinks they submitted one of the invoices he wants to say it was over. . . .

Attorney Cavignac stated it was over $150,000.00.

Mr. Bennett stated not on just this project, on this project he thinks it was just $25,000.00 for the first payment on this bond. He doesn’t think they made the second payment because they didn’t get that far in the project.

Mr. Lambert asked if all of these jobs didn’t happen at one time, you must have had some idea you had a problem.

Attorney Cavignac responded that actually the problem, as they were paying for Bid Bonds and paying for the Performance Bongs at the Airport at the Jefferson Parish – these are all bids around the same time frame. So they were being accepted at the airport, so they paid for their bond.

When they have been hey accepted and under contract with Jefferson Parish School Board, so they paid for the bond. The put a deposit down when their were notified that they were apparently low bidders with the state and once their had a technical difficulty Infinity was saying hold on ,you don’t owe us any money until we get this cleaned up the bond until the bond is actually accepted. They would have owed them another payment on that bond. So they had every reason to believe that the bonds were good because of the fact that they been accepted prior to them working with Infinity and once they abolished themselves with Infinity the bonds were accepted in other markets in – inside of Louisiana.

Attorney Cavignac responded to Mr. Lambert stating they had a series of emails that he didn’t initially supply, but received the day before from Benetech that shows from September to October on into November the State was actually talking to George Black at Infinity trying to work out the problem, so everybody still thought there was still a license or residence issue, it was much later when they realized the guy was running a scam, they stopped using them once they figured it out.

Mr. Lambert stated he’s sure its a scam there, the charge is here, if you bid on a job and you cannot produce the proper insurance or bond then you are subject to having your license revoked or some scantion being put on you and that‘s what this Board’s charge is, to show whether you were inniocently taken advantage of, if you proved how much you paid and the time frame is makes a big difference, and he happens to know that at Marscanpy, the other side of the story is, that accepted bid when you bid and they gave you a contracts and a few months later, as the job was progressing, somebody made claims on the bonds and couldn’t get the money or couldn’t get some result out of it so they check the financial situation and found there was just a couple of lots in Texas. . . (let him finish) . . . that was security for like a 6 million job and the lot were not worth $5 hundred-thousand. A bunch of sub-contractors were depending on that guarantee, to know that they would get paid and one of them happened they ordered granite out of Italy that had to be cut and shipped in and he couldn’t stop that, the order was already in progress, so the airport had to settle that , but is a lot of complicating than just a simple accepting this testimony without having those facts answered for the Board, he thinks their duties need to be – why didn’t you get another – you couldn’t find another surety?

Mr. Bennett stated they actually did, in the case of the import with the notification came the bond company tried to take over the job, they sent a letter saying they wanted to take over the job, it was similar to the Jefferson Parish Board which was . . . .

Mr. Gallo questioned Mr. Bennett Infinity tried to. Mr. Bennett responded they sent a letter to the school- to both the school board and the airport saying we want to take the job away from Benetech and give it to another contractor, that was just again more theft and more fraud that they were doing. They delivered a letter from CNA Bonding that they could have re-bonded the job at the airport they application of the public bid law was that since their bid bonds was no good there was no contract, they couldn’t accept the bond, that’s what they told them.

Mr. Lambert stated one more then asked Mr. Bennett what is your connection with the company that did the Sheriff’s Office in St. Charles Parish? Those people work you for ah. . .

Mr. Bennett responded um

Mr. Talbot asked those people work for you.

Mr. Lambert stated St. Charles Parish.

Mr. Bennett responded that Bob Blackwelder who works for Parish Construction did work as – in place for Benetech, but he is not a part of their company or

Mr. Lambert asked Mr. Bennett was he part of the (inaudible)

Mr. Bennett stated he knows the owner of Parish Construction but he doesn’t work with him.

Mr. Lambert asked if he was part of the bid in St. Charles Parish.

Mr. Bennett responded no sir.

Mr. Gallo stated that most of the state’s specifications and others require the Bonding Company to be rated triple A rating. They didn’t raise that question at the time of the bid to your knowledge?

Mr. Bennett responded there were three (3) specific cases that you are talking about, the Airport, the Jefferson Parish School Board and the State. He thinks there are several Infinity companies listed on that A & M Rating. At one point they started getting concerned on their part they looked and found it wasn’t that Infinity that there must be multiple Infinity companies. That’s why it passed through.

Mr. Gallo responded that’s probably why it passed through. Mr. Bennett responded right.

Mr. Bennett stated prior to that and post to that. . .

Mr. Talbot instructed Mr. Bennett to hold one. Any other questions?

Mr. Meredith stated one (1) more question then asked Mr. Bennett after being made aware that Infinity was a problem, did your company attempt in any shape form or fashion to continue doing business with Infinity or to use them for any other bonds or any other on anything. Mr. Bennett responded no sir.

Mr. Meredith asked once you were notified, made aware that you had a bad apple you cut it down.

Mr. Bennett stated he’ll say to be perfectly clear once they knew that they where bad and they actually notified the everyone else. There was poor concern raised either by the state, initially that who initially raised it and working with Infinity and with the state if was actually a problem or not. Once it was clear that they were not acceptable, they didn’t’ try to bid any more work with them and post their relationship with Infinity. There is a sheet and sample letters they have they are acceptable for bonding with CNA Zurich and of the best related bonding companies out there who are currently under bid under contract with the Core of Engineers for $25 million dollars with work that is currently bonded without a partner just Benetech only, so they are viable and acceptable for multiple assurity companies.

Mr. Talbot responded ok – ok

Mr. Weston questioned Mr. Bennett who is the bonding company on the Core Project? Mr. Bennett responded it is either Zurich or CAN doesn’t remember exactly but it is one of those two (2).

Mr. Talbot asked what are the wishes of the Board, we can stop here, if you want more information?

Administrative Hearing – Consider an alleged violation by JAROY CONSTRUCTION, INC. of the provisions of Louisiana R.S. 37: 2158 (A) of the State of Louisiana Contractors’ Licensing Law, and in particular Paragraph 9, problems relating to the ability of the contractor, its qualifying party, or any of its principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience and Louisiana R.S. 37:2158 (A) Paragraph 10, disqualification or debarment by any public entity.

Mrs. Bobbie Hughes read the allegations against JAROY CONSTRUCTION, INC. then asked if a representative of JAROY CONSTRUCTION, INC. was present. Mr. Lloyd Shields, Attorney representing Jaroy Construction, Inc. was present.

Attorney Shields came to the stand and introduced himself.

Judge White asked Attorney Shield if there will be any witnesses testifying?

Attorney Shield responded there will be.

Mrs. Hughes gave a brief summary regarding complaints they had received regarding this company.

Mr. Hawthorne called Mr. Brent Templet to the stand, he was sworn in.

Attorney Shields objected to people being here, stated they should give their statement now, don’t want to waive their rights.

Judge White responded to Attorney Shields.

Attorney Shields then gave his statement.

Mr. Talbot stated to Attorney Shields before you go any further as you saying you would prefer coming back next month, you would have more time then?

Attorney Shields responded yes sir that’s exactly what they requested.

Mr. Lambert questioned Attorney Shields what happens to all the jobs while another month goes by?

Attorney Shields responded Mr. Lambert Jaroy is operating, to give you two (2) examples, he’s looking at a letter dated March 15 which was written by another lawyer for Jaroy for this gentlemen who Mr. McGoy had spoken to Mr. Templet, who they just met and Mr. McGoy recounts back to Mr. Templet that telephone conversation, because Mr. McGoy who is a fine lawyer, fine gentlemen ask Mr. Templet what this is about, because Jaroy only had general allegations. Mr. Templet told Mr. McGoy the following

First – this is Mr. McGoy talking about to Mr. Templet you stated there’s been a debarment procedure in Jefferson Parish against Jaroy.

Mr. Talbot asked Mr. Hawthorne to come forward, to visit with him a second.

Mr. Weston stated Mr. Chairman, not to cut Mr. Shields short, good seeing you, but he would like to give you the thirty (30) days requested. . .

Attorney Shields stated to Judge White about the Administrative Procedures Act.

Mr. Talbot stated to Attorney Shields you said you needed thirty (30) days, now your saying you need something else?

Attorney Shields stated yes sir they would like to be in compliance with the Administrative Procedures Act, he’s sorry but he’s taking the opportunity, if you want him to sit down and go away he will. But while they are here, they would like the compliance with the Act so they will be better prepared in thirty (30) days to do this.

Judge White asked Attorney Shields to site the statute to the Act he was referring to then Judge White stated he has the Act. Attorney Shields responded ye sir that would be that would be RS 49 (Section 955,B), then Attorney Shields read that information to the Board Members, audience and staff.

Judge White then responded back to Attorney Shields, read the statute then asking Attorney Shields if they are making applications

Attorney Shields responded they sought it in written several days ago.

Judge White continues to read the statute. Then Judge White asked Attorney Shields if he is alleging the statement in the Agenda today is not a more definite statement.

Attorney Shields responded to Judge White.

Mr. Lambert stated to Mr. Talbot that he was asking that question because a lot of jobs are shut down somewhere or cease and desist orders on them, are the jobs safe for this outcome. We’ve already voted.

Mr. Talbot stated to Mr. Lambert he understood,

Mr. Lambert stated they had already voted,

Mr. Talbot responded good discussion, good question, after talking with Mr. Hawthorne he thought it would be appropriate to give them another thirty (30) days.

Mr. Lambert responded that’s fine.

Mr. Talbot responded being that their attorney asked for the thirty (30) days.

Mr. Lambert responded it’s the public’s work out there that is being halted another thirty (30) days.

Attorney Shields responded to Mr. Lambert saying that would be happy to meet with the Board’s staff, with the Board’s inspectors because there is a lot of disinformation which they are prepared to prove today, but they’ll be happy to meet with them right now or any other day.

Mr. Lambert responded no later, he thinks it would be a good idea to bring the staff up-to-date what they are gonna do in this interim period time, so they know the jobs that people have are being properly manned or the buildings are safe or it is not going to deteriorate for the thirty (30) days.

Attorney Shields responded to Mr. Lambert, yes sir they will do that.

Administrative Hearing – Consider an alleged violation by Batten & Shaw, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Batten & Shaw, Inc., entered into a contract with an unlicensed contractor to perform work on the New Addition Teche Regional Clinic project in Morgan City, Louisiana in an amount in excess of $50,000.00.

Mrs. Bobbie Hughes stated that items F and G were related and could be heard together then Mrs. Hughes read the allegations against BATTEN & SHAW, INC. and NRC then asked if a representative of BATTEN & SHAW, INC. and NRC were present.

Mr. Adam Clune representing Batten & Shaw, Inc. and Mr. Danny Shaw and Mr. Mike Ralston representing NRC were all present.

Mr. Clune, Mr. Shaw and Mr. Ralston all came to the stand, each was sworn in.

This hearing is being called for reason that on information and belief, NRC, acted as a contractor to perform work on the New Addition Teche Regional Clinic project in Morgan City, Louisiana in the amount of $214,886.00 without possessing a Louisiana state contractor’s license.

Mrs. Bobbie Hughes stated that items F and G were related and could be heard together then Mrs. Hughes read the allegations against BATTEN & SHAW, INC. and NRC then asked if a representative of BATTEN & SHAW, INC. and NRC were present.

Mr. Adam Clune representing Batten & Shaw, Inc. and Mr. Danny Shaw and Mr. Mike Ralston representing NRC were all present.

Administrative Hearing – Consider an alleged violation by EPCO CONSTRUCTION, INC. of the provisions of Louisiana R.S. 37: 2158 (A) of the State of Louisiana Contractors’ Licensing Law, and in particular Paragraph 9, problems relating to the ability of the contractor, its qualifying party, or any of its principal owners or principal shareholders to engage in the business of contracting, as demonstrated by their prior contracting business experience.

Mrs. Bobbie Hughes read the allegations against EPCO CONSTRUCTION, INC. then Mrs. Hughes asked if a representative of EPCO CONSTRUCTION, INC. was present. Mr. David Epperley was present.

Mrs. Hughes stated as a little bit of background, field staff has received numerous complaints against this particular company and based upon those complaints and other problems through an investigation they felt like we needed to present this information to the Board based upon his contracting experience.

Mr. Epperley came to the stand, was sworn in then introduced himself as David Epperley of Epco Construction, Owner and Qualifying Party.

Judge White asked Mr. Epperley how he was pleading? Mr. Epperley stated Deny (Not Guilty).

Mr. Hawthorne stated, Mr. Chairman in the way of orientation, Epco has a Commercial and a Residential License. The matters about which the investigation was about were all residential matters, but because of the great number it was determined by the staff to bring this matter here today.

Mr. Talbot asked if they had met – I’m sorry, your last name.

Mr. Epperley responded Epperley.

Mr. Talbot asked did we meet before, have you been up here before?

Mr. Epperley responded yes sir.

Mr. Talbot asked like a couple months ago?

Mr. Epperley responded a couple months ago they had – had a judgment on a supplier that was rendered and they’ve taken care of that.

Mr. Talbot responded ok, he’s sorry Mr. Hawthorne.

Mr. Hawthorne responded no problem . . . then stated the staff, the Board would like to call Lynwood Allemore to the stand.

Mr. Allemore came to the stand he was sworn in then Mr. Allemore introduced himself and told his title.

Then Mr. Hawthorne asked Mr. Allemore with regard to his job duties, did he have an opportunity to investigate and look into complaints about Epco Construction, Inc.

Mr. Allemore stated correct.

Mr. Hawthorne then began to review the EPCO Construction, Inc. exhibit packet with Mr. Allemore and asked him to identify certain exhibits in it.

Mr. Allemore responded.

Mr. Hawthorne stated that there are nine (9) separate investigations or complaints that you considered.

Mr. Allemore stated that’s nine (9) of them, right.

Mr. Hawthorne asked Mr. Allemore if he had investigated these complaints about the performance of Epco on these contracts?

Mr. Allemore stated correct.

Mr. Hawthorne asked Mr. Allemore what he found during his investigation?

Mr. Allemore responded what he found during their investigation– at each home listed in this exhibit packet.

Mr. Allemore requested that Mr. Charlie Ullo came forward to the stand then asked Judge White to swear Mr. Ullo in and asked him to identify himself.

Mr. Ullo stated Charles Ullo, Investigator for the Contractor’s Board. Then Mr. Ullo stated what he found, what work was done and/or who he spoke to during his investigation into the homeowner’s complaints involving Epco Construction.

Mr. Talbot asked Mr. Ullo if this was the same lady that paid the hundred thousand dollars?

Mr. Ullo responded a hundred and five thousand, a year ago.

Mr. Talbot stated he needed some help from the Judge, they said, he said, we said, then asked if there are any judgment against him or is this, what are we gonna talk about today?

Mr. Ullo stated it has been a year the homeowner paid them the entire cost of the job up front and put it with them to take care of it. In that eleven and a half (11 ½) months, like he said 23rd of next months makes a year that the homeowner gave them the check and approximately the dollar amount of work that Epco performed.

Mr. Hawthorne stated to Mr. Talbot if he could address your question, there are no judgments that will go into evidence today, what we have is seven (7) separate complaints by homeowners against this particular contractor.

Mr. Lambert asked Mr. Chairman, we are charged with evaluating whether this man is . . .

Mr. Meredith stated performing as a contractor.

Mr. Lambert stated performing as a legitimate contractor with all the principals and good character and honor and we have last month, he was before us with about three (3) or four (4) judgment, whether they got paid or not he doesn’t know, but his license was to be revoked if those judgments weren’t taken care of by thirty (30) days and then at that time we didn’t take this up, because it wasn’t the charge, but now it is the charge and all this is the rate on whether or not he is a competent contractor.

Mr. Talbot asked do we know if all those judgments have been handled, Mr. Hawthorne?

Mr. Hawthorne stated he does not know that, that’s not part of what was set for hearing today.

Mr. Talbot then stated his question is . . .

Mr. Lambert stated we can asked if a witness, we can asked

Mr. Talbot stated he would rather ask someone on our end of the business.

Mr. Lambert stated he is under oath if he don’t tell the truth to us . . .

Mr. Talbot asked if Mr. Epperley had paid all the judgments.

Mr. Epperley responded yes sir.

Mr. Talbot asked have they all been handled.

Mr. Epperley responded yes sir.

Mr. Talbot asked is there is a chance that one (1) of them is still out there?

Mr. Epperley responded no sir, there were only two (2) and they were for very small amounts, he took care of them immediately, soon as he got done here.

Mr. Lambert asked Mr. Epperley if he had submitted that proof to us?

Mr. Talbot asked Mr. Epperley did he submit something or someone?

Mr. Epperley responded yes sir.

Judge White stated to Mr. Epperley. . . satisfy of Judgment that you can provide?

Mr. Epperley stated that’s right, he forwarded it on to the Board by email and copies and he did receive Mrs. Deborah Irwin had sent him a message that she did receive and everything was fine.

Mr. Talbot said ok

Mr. Allemore asked Mr. Chairman, can he say something?

Mr. Talbot stated to hold on a second, hold on a second, he just wants to make sure the Board was listening to what the inspectors were saying and again . . .

Mr. Meredith stated he has a question for his gentlemen.

Mr. Talbot asked Mr. Allemore if he was finished or did he need to continue?

Mr. Allemore stated they have more cases, you questioned if we have any judgments against him, these people that hired Epco they don’t have any money to hire any lawyers, they went to the Attorney General’s Office and the Attorney General’s Office sent them to us to investigate and we did. They have lawsuits against him, he has Mr. Gregory Carter and in December of 2008, 2008, we’re in 2010 now. . .

Mr. Talbot commented what these folks are here for and didn’t know where Mr. Allemore was going with his testimony.

Mr. Allemore said ok then stated he has homeowner’s here

Mr. Talbot responded ok and against that is just a statement that was made

Mr. Allemore stated the reason why they don’t have any judgment, because they don’t have any monies to hire a lawyer, they have to go to special services.

Mr. Talbot asked if there was anything else the Board Member wanted to hear from Mr. Allemore or Mr. Ullo.

Mr. Meredith stated not from them, he has questions for this gentleman.

Mr. Talbot stated to hold their thoughts a second

Mr. Talbot then instructed Mr. Meredith to go ahead

Mr. Meredith asked Mr. Epperley how much work, let’s say you work on houses, how many houses are you participating in at the present time either have a contract with the owner, have a job, maybe even without a written contract, got work on-going, jobs that you are gonna do, anything under contracting, anything that you are involved in?

Mr. Epperley stated he has approximately . . .

Mr. Meredith stated unfinished . . .

Mr. Epperley stated unfinished, contracts in hand as well, that haven’t even started yet

Mr. Meredith well this is contract or whether this is . . . .

Mr. Epperley responded fifty-five (55) or sixty (60)

Mr. Meredith asked Mr. Epperley if he was in the process of fifty-five (55) projects, we have six (6) or eight (8) complaints here but there is fifty –five (55) projects out there you are involved in.

Mr. Epperley responded yes sir and if he may add something in the last four and a half (4 ½) – five (5) years, they have completed between four (4) and five (5) hundred homes. Between renovations and new builds, he has don’t in excess of fifteen (15) hundred roofs, small projects and each homeowner, each contract, each home are all different situations. You have obviously different building methods, but you have different funding sources, you have different ways of obviously the individuals, the homeowners that they’ve dealt with, each one of these cases and complaints to the individuals behind him . . . he has filed suite. He has an argument for each and every thing that they’ve done, but he does believe that at the end of the day they have always been willing to. . . to care and find a way to get through with their projects.

One (1) of the complaints in here, is from a lady, Mrs. Connor and it was a difficult project, they change their minds quite a bit, but they got through it, we got a letter of recommendation, we still go back, if she needs a light bulb changed, we go take care of it for her and they are on this complaint, but actually they have a letter of recommendation that he did send to the Board. Now they do have several projects that do have challenges and they are always willing to work those out and if. . .

Mr. Talbot asked Mr. Meredith did you get the point?

Mr. Meredith responded he got it a long time ago.

Mr. Talbot asked any other questions, Mr. Lambert

Mr. Lambert responded let us continue and put our case on and any of the witnesses.

Mr. Talbot asked Mr. Hawthorne if he wanted to a hear

Mr. Hawthorne stated and we were talking about the Candy Carroll case, a hundred, five thousand dollar

Mr. Allemore responded yes . .

Then Mr. Hawthorne continued to review the Epco Construction exhibit packet with Mr. Allemore and had him identify certain items.

Then Mr. Hawthorne requested that the Epco Construction, Inc. exhibit packet be entered into the record. Judge White asked Mr. Epperley if he objected to anything in the exhibit packet? Mr. Epperley responded no then Judge White stated this item was accepted into the record.

Mr. Talbot made a statement to Mr. Allemore.

Mr. Allemore stated there were homeowners present today to make a statement, if the Board would allow them to speak

Mr. Hawthorne asked Mr. Allemore if he had investigated these complaints?

Mr. Allemore said yes.

Mr. Hawthorne said to Judge White, at the point, they would offer and file into the record, Exhibit 1-10.

Judge White asked Mr. Epperley if he had any legal objection to the introduction of this document into evidence, to be considered by the Board? Mr. Epperley responded no sir. Judge White stated it would be admitted.

Mr. Hawthorne stated they would tender the witness.

Judge White asked Mr. Epperley if he had any questions he wanted to ask either of the investigators?

Mr. Epperley responded not at this time.

Mr. Talbot asked what are the wishes of the Board?

Mr. Allemore asked if he could add something? They also have two (2) new complaints that came in last week, he has three (3) of them that came in two (2) weeks ago, he never got a chance to investigate them, he has some homeowners here that would like to make a brief statement, if you want to hear, we would appreciate it, they came all the way from New Orleans to be here, they have been waiting for two (2) years or three (3) years to get some kind of satisfaction from some agency in the State of Louisiana.

Mr. Talbot responded to Mr. Allemore that he doesn’t mean to cut him off, but they need to get through these hearings then asked what were the wishes of the Board?

Mr. Lambert asked Mr. Talbot is they were finished with their case?

Mr. Talbot said yes

Mr. Lambert stated he thinks the Board should let each one have a brief statement. And we’ll take action.

Mr. Talbot stated to the homeowners to please – please make your statement as brief as possible and direct.

HOMEOWNER #1

Mr. Ernest Thibodeaux, house at 4744 Feliciana Drive, Gentilly, LA. Mr. Thibodeaux came to the stand, was sworn in then he introduced himself then stated he entered into a contract with Epco in May of last year (2009). The told what was going on with the construction of his house.

Mr. Thibodeaux spoke about liens placed on his property, relating to Epco not paying their subcontractors.

Mr. Talbot asked Mr. Thibodeaux you paid him? Mr. Thibodeaux responded he paid him that’s correct.

Mr. Talbot asked how much do you pay him? Mr. Thibodeaux responded two hundred and thirty-four thousand dollars.

Mr. Graham asked Mr. Thibodeaux if that was the whole amount? Mr. Thibodeaux responded no that is not the whole amount, the whole amount of $312.

Mr. Graham asked Mr. Thibodeaux who was approving the payments to you, whose telling you – you owe what when you get ready to pay him or are you just taking his word or is some body?

Mr. Thibodeaux responded based on draws, when the framing and HV and the plumbing and all that was done it was all roughed in, but the people was never paid.

Mr. Talbot stated the subcontractor. Mr. Thibodeaux responded the subcontractor – that’s correct and he knew nothing of the liens or whatever.

Mr. Fenet asked Mr. Thibodeaux if the draws were for certain things, such. Mr. Thibodeaux responded that’s correct. Mr. Fenet said now you are finding out that these people that did your plumbing – basically subcontractor has not been paid. Mr. Thibodeaux responded that’s correct.

Mr. Fenet asked Mr. Thibodeaux if the plumbing was done ok to his satisfaction? Mr. Thibodeaux stated well it is roughed in – that’s all it is.

Mr. Fenet asked Mr. Thibodeaux if there were any problems with the work? Mr. Thibodeaux that it was not completed neither is the HVAC or none of that other stuff.

Mr. Dupuy stated that this might be misappropriation of funds law and there is a civil penalty for that.

Mr. Hawthorne instructed Judge White that there was another witness that needed to be sworn in.

Mr. Epperley asked if he could interrupt? Mr. Talbot said no you can’t interrupt, you had a say. . .

Judge White stated that Mr. Epperley was asking for a time for him to confront these witnesses, Mr. Chairman, with all due respect I think he does get an opportunity to ask them questions.

Judge White then instructed homeowner #2 to go ahead.

HOMEOWNER #2

Mr. Joey May, house at 1320 Hickory Avenue, Harahan, LA. Mr. May came to the stand, was sworn in then he introduced himself then stated him and his wife signed a contract with Epco Construction for the amount of $260,000.00. We

have since given him $114,000.00. Along the way they found out the started building the house with the wrong set of plans. It was suppose to be a block pour, instead it went monotypic pour. They didn’t even rough in the plumbing before they started the foundation, so now he’s gonna have to do the plumbing on it. Since, he guesses once he (Mr. Epperley) found out they were coming up here he (Mr. Epperley) has now filed a suit against Mr. May’s wife for defamation, slander and lose of revenue to keep her from talking, that’s why she isn’t up here talking right now. Because she has to go to court for that. Also, they have given him $114 and once Mr. May found out that he (Mr. Epperley) had threaten liens he fired him, told him to get off the property. He owes my framer, my AC man he owes the guy that did the front porch. Then he wrote a bad check to Door-To-Door, for four (4) months that check was bad, six (6) months, finally the Attorney General was on his butt and he just went in and made the check good just recently and that was a bad check that even wasn’t just done, so Door-To-Door has been on their behinds for a while. AC man has called Mr. May daily wanting his money, the frame calls Mr. May daily wanting his money. You got over $20,000.00 that wasn’t been paid and he gonna say that’s because Mr. May fired him. That’s way he’s not finishing the job there is not way Mr. May was gonna let him continue to work. After he had experts go in there and see the shoddy work, he is glad he did fire him.

Judge White asked Mr. Hawthorne if he had any questions for Mr. May? Mr. Hawthorne stated no.

Judge White instructed Mr. Epperley to keep it brief then asked him if he wanted to question Mr. May?

Mr. Epperley asked Mr. May for your knowledge who set the payment schedule for his home?

Mr. May stated excuse him.

Mr. Epperley asked Mr. May again, do you know who set the payment schedule for his home?

Mr. May responded yes they were on the repeative loss program, Solution did.

Mr. Epperley asked Mr. May, at the time when you released Epco Construction had a $47,000.00 draw been approved from Solutions to Epco?

Mr. May responded yes, because they continue to work just to keep you on the job, it had been approved. Mr. Epperley asked Mr. May didn’t Walton and Solution both approve that they had reached a satisfactory completion point to get that draw?

Mr. May responded they may have said that just to continue the draws, but after them themselves went in and investigated you can see in the report what was done.

Mr. Epperley asked and the report was completed after they had been fired and been off the property.

Mr. May responded that’s correct, so they didn’t do any more after that, so what their report is you see the report.

Mr. Epperley asked Mr. May the check that they wrote to Door-To-Door did you notice that on the check it was an agreement based on receiving payment that they would deposit the check after they (Epco) had received payment, not just merely a check. Did you ever see that, the documentation on that?

Mr. May responded no, he just knows you wrote a bad check.

Judge White asked Mr. Epperley if there was anything else?

Judge White instructed Mr. May to step down then asked Mr. Epperley if he wanted to ask any questions of Mr. Thibodeaux?

Judge White called Mr. Thibodeaux back to the stand and instructed him he was still under oath then instructed Mr. Epperley to keep it brief.

Mr. Epperley asked Mr. Thbodeaux how many contractors did you have on your project before they arrived?

Mr. Thibodeaux responded one (1).

Mr. Epperley asked Mr. Thibodeaux have, can you recall any of the stop work order that they had, based on the original bill that they had nothing to do with what Mr. Thibodeaux observed of that?

Mr. Thibodeaux responded he called one (1) stop order, which was eight (8) days.

Mr. Epperley asked Mr. Thibodeaux, eight (8) days? Mr. Thibodeaux responded that’s correct.

Mr. Epperley asked Mr. Thibodeaux per the contract, it states that he is suppose to supply and hold builders risks throughout the entire project because this was a project that another builder had been on before them. Then Mr. Epperley asked Mr. Thibodeaux if he had that builder’s risk policy?

Mr. Thibodeaux stated no he does not that Mr. Epperley never mentioned anything about a builder risk policy until he approaches Mr. Epperley about the four (4) liens on his property then you decided to pick up something in the contact that you could use against Mr. Thibodeaux. You never approached Mr. Thibodeaux anything about the builder risk policy before this, before the last couple of weeks.

Mr. Epperley stated they knew one (1) of the liens was provided from the mechanical contractor that did the plumbing and the HVAC. Then asked Mr. Thibodeaux if he saw the report that Mr. Epperley submitted to Mr. Thibodeaux from a third party showing what the HVAC contractor had done through the work he had performed?

Mr. Thibodeaux responded he saw something that Mr. Epperley drew up, Mr. Thibodeaux didn’t know who made this report.

Mr. Epperley through the report and picture that you see, would you agree that much of that work was not satisfactory?

Mr. Thibodeaux responded no he does not

Mr. Epperley asked if he would say that – that work would be satisfactory?

Mr. Thibodeaux responded no he didn’t say it was satisfactory either, all he saw was the report that Mr. Epperley made up. He doesn’t know where it came from or who it came from. He spoke to the HVAC people, they said to this point you have not given them anything. They have been trying to get in touch with you for seven (7) months and you have been ignoring them.

Mr. Epperley stated that was all, no further questions of Mr. Thibodeaux.

HOMEOWNER #3

Mrs. Rhonda Edmudson, house at 6601 Canal Blvd., New Orleans, LA. Mrs. Edmudson came to the stand, was sworn in then she introduced herself then stated he came in contact with Epco Construction Company one (1) year ago on March 27th at a Home and Garden Show. She has documentation, day by day what has gone on regarding her home/property and a lot of pictures. Her house is at a stand still, she paid the roofer and bought the needed supplies. She lives in Lakeview, she had ten (10) feet of water in her house, it is a three (3) story house, 6,000 square feet.

Mr. Hawthorne questioned Mrs. Edmudson. Mrs. Edmudson responded.

Judge asked Mr. Epperley if he wanted to question Mrs. Edmudson? Mr. Epperley said no, he would wait for a statement.

HOMEOWNER #4

Mr. Gerado Pampin, Jr., house at 612 Orienne Street, Metairie, LA. Mr. Pampin came to the stand, was sworn in then stated he was a retired from the Jefferson Parish Sheriff’s Department, Lieutenant, 30 years and 3 months.

Mr. Hawthorne questioned Mr. Pampin. Mr. Pampin responded.

Mr. David Epperley then gave his statement on each job and what is the status of what work was done and what work was left to do.

Mr. Talbot asked Judge White to move this forward so they could finish.

Judge White asked Mr. Epperley to sum up his statement within 2 minutes.

Mr. Meredith asked Mr. Epperley how many new jobs does he currently have? Mr. Epperley responded about 55-60 jobs on-going.

Mr. Meredith asked to Mr. Epperley if he understands that this Board is here to protect the public. Mr. Epperley said yes sir.

Mr. Meredith stated to Mr. Epperley, the public is sitting here, two (2) things - #1 is your months behind on their projects, you have been pre-paid, there is people out there that you didn’t paid and you have been pre-paid. This Board has to look at these things and your coming up here today saying I’m a good contractor and we’ve got the general public saying not only you behind, not only did you not accomplish the work, but you did shoddy work for the work you did do and they have pictures and testimony to prove it. If you were an airplane pilot, your plane would have already crash, now their question as a contractor’s Board is you’re claiming to be a contractor and your plane has crashed, how are you gonna pick up the pieces. But to staff we’ve got a problem here is the gentlemen tell the Board he has 55 on-going, if we revoke him and put him out of business what about the rest of the general public that he has already Committed to.

Judge White asked Mr. Epperley if he had anything he wanted to say, briefly before the Board acts on this matter.

Mr. Epperley stated oh absolutely, please allow him to go through this and touch on a couple of points then Mr. Epperley proceeded to give his statement on each home.

Mr. Talbot said he would – he would.

Mr. Meredith stated that is a big concern for him.

Mr. Talbot responded to Mr. Meredith, if the Board allows him to continue to operate the way he has been operating, unless there is someone you brought here today that is gonna say you do a good job, are they here, is there someone in the audience?

Mr. Epperley responded no sir.

Mr. Talbot stated he thinks the worst thing the Board could do is allow him to continue in the construction business.

Mr. Meredith asked about what the 55 people he is out there.

Mr. Lambert stated well the Board has to face it sooner or later and it is gonna get worse

Mr. Epperley stated no sir it won’t he can promise the Board he cake made this right.

Judge White told Mr. Epperley to stand by and let the Board have their discussion.

Mr. Lambert stated he feels for all these people, including this guy, but the Board can’t let him go on like this anymore. Just here the witnesses that were here was almost of half million dollars, it seems like you got way over a million dollars worth of exposure out there.

Mr. Epperley responded to Mr. Lambert that they can make the argument, they can show, they can show different parts of it, it is not that cut and dry there is an issue and yes he is embarrassed in that, there should not been an issue and he, we all shouldn’t be doing this today, he has an obligation to take care of his clients.

Mr. Dupuy stated he thinks we are only dealing with his Commercial Building License here, is that right? We’re dealing with the whole thing.

Mr. Weston stated it is residential

Mr. Lambert stated they are in charge of the whole thing

Mr. Dupuy stated to Mr. Epperley he’s gotta tell you man, he’s gotta tell you man, when you’ve got people filing liens against you and your home and your property, that’s as bad as it gets.

Mr. Weston stated let him asked Mr. Chairman, this gentlemen was before us a month or two ago, what for?

Ms. Kris Fitch read responded for a Judgment Hearing and was given Fifteen (15) days to pay and it was on residential and commercial and he has paid both of those.

Mr. Fenet asked Mr. Epperley he has a question on the Carroll House, do you know how many lawsuits are against you right now?

Mr. Epperley responded suits against us?

Mr. Fenet stated lawsuits against your company?

Mr. Epperley responded there were three (3) or four (4).

Mr. Fenet asked Mr. Epperley right now – on-going?

Mr. Epperley said yes sir, right now they have two (2) arbitration cases and three (3) or four (4) suits.

Mr. Fenet asked Mr. Epperley about the Carroll case, 78 year old lady and her husband, in this contact why did you require this lady to pay you in full before you started this job, $105,000.00, a 78 year old lady?

Mr. Epperley responded right – him and his brother discussed it and this is one that she wanted to give them the money – this is gonna sound nuts he knows, because she was afraid her family might need it or someone might need it. They were listed here, to date he has spent $31,000.00 on what they have done. The outside is falling off they are trying to figure out what to do, can they let the volunteers do the outside siding and let Epco move onto the mechanicals, but if they do that, it would not be dried in. Do they want Epco to take some of the money and do the outside siding then see what is left for the mechanicals to finish.

Mr. Weston stated that Mr. Lambert would like to make a motion.

Mr. Weston stated he would like to know specifically Mr. Thibodeaux, we will use you as an example, what happens if the Board pulls this man’s license today, what happens to your

house?

Mr. Thibodeaux responded it won’t get done, he knows that, like he said his house in his opinion is only 50% complete, if the Board pulls his license, he guesses he will have to get a lawyer and sue him.

Mr. Weston asked Mr. Thibodeaux if he was ready for that?

Mr. Thibodeaux responded if he has to, yes

Mr. Weston stated Mr. Lambert‘s got a motion.

Mr. Talbot asked Mr. Thibodeaux if he wanted Mr. Epperley to come back and work at his house?

Mr. Thibodeaux responded really . . . . he wants, he does . . . he’s got Mr. Thibodeaux’s money, he has Mr. Thibodeaux’s money so he is in a bind here, you know.

Mr. Lambert responded they cannot let this guy go on letting him get other people’s money and not doing the work.

Mr. Meredith stated just to offer he is just thinking here, what about some type of restricted probation to where, if the homeowners feel like they need him to come out and finish that project, they have already spent the homeowner’s money . . . with supervised probation.

Mr. Weston stated they (the homeowners in the audience) are all shaking their heads no, including the lady who can’t.

Mr. Lambert stated in his heart, as much as he hates to do this and how many people are gonna get hurt, they are already hurt and this guy is not gonna finish, it is gonna be a worse disaster.

Mr. Joes stated he would like to offer a substitute motion then stated he understands that the staff wanted to bring this directly to the Commercial Board without going through the Residential and the Residential Committee they would have heard all of these cases, one at a time, so they could have flushed it out. His substitute motions Because of the severity of what’s going on and the 55 or more homeowners that could be impacted and millions and millions of dollars for these homeowners is to put this guy on a structured supervision. He thinks they need to call a big meeting of all of these people because it is going to be a major . . . . . .

A SUBSTITUTE MOTION was made by Mr. Jones and seconded by Mr. Meredith to put EPCO CONSTRUCTION, INC. on a structured supervision plan.

Mr. Talbot stated he knows Mr. Jones, he can’t second his motion, he can’t even vote, but he thinks that is not a good idea.

Mr. Lambert stated no, the Board can’t go taking over jobs and supervising this fellow, they would go crazy doing that, then the Board would be liable for what he does wrong.

Mrs. Bobbie Hughes read the allegations against GRADY RICHEY BUILDERS, LLC then asked if a representative of GRADY RICHEY BUILDERS, LLC was present. Mr. Grady and Phyllis Richey were both present.
