ELEVENTH JUDICIAL CIRCUIT JUDICIAL WEBPAGEUNIFIED CHILDREN’S COURT DIVISION COVID-19 VIRTUAL/REMOTE JUDICIAL CALENDAR AND HEARING INSTRUCTIONSBased on public health advisories, to help prevent the possible transmission of the Coronavirus Disease COVID-19, at the direction of the Florida Supreme Court and the Chief Judge of the Eleventh Judicial Circuit, through May 29, 2020, and until further notice, while the Unified Children’s Court (UCC) Judges’ divisions remain open and they and their staff are working and available, the Miami-Dade Children’s Courthouse (MDCC) is temporarily CLOSED to the public for in person appearances,. The following specified Mission Critical Matters are continuing to be heard remotely, and handled per below:Juvenile Delinquency Detention Hearings,Juvenile Dependency Shelter Hearings,Juvenile Marchman Hearings, Noticed Emergency Hearings, Emergency Motions to be filed with the Clerk’s Office, Juvenile Marchman Act Petitions to be filed with the Clerk’s Office, andDrug Testing required by Court Order.Virtual/Remote ZOOM Court HearingsAll above-referenced hearings will be held remotely, using the ZOOM video or telephonic conferencing platform. It is FREE to you. You will receive an email from the Court if we are proceeding with your hearing with the information you need to connect. To participate by video, you must click on the weblink you received in the email invitation at the time your hearing is scheduled or call the phone number listed in the invitation to participate by phone. You do not need to download anything or set up an account in order for you to participate in a ZOOM hearing. Video appearance is required for any participant whose testimony is necessary so that the Judge can administer the oath. For instructions on the utilization and access to ZOOM video conferencing, please visit the Eleventh Judicial Circuit webpage, at jud11.. You may also visit the ZOOM training page for ZOOM Video Tutorials at all hearings conducted via ZOOM video conferencing, it is the responsibility of all parties, including self-represented litigants, to join the conference as scheduled. If the hearing is to be conducted with telephone conferencing, it is the responsibility of the parties and self-represented litigants to call the Judicial Assistant immediately prior to the scheduled hearing time to be transferred into the courtroom, if you have not received the remote appearance information to participate. Beginning on April 13, 2020 through May 29, 2020, and until further notice, specific non-essential/Mission Critical court hearings (not including trials) will be heard remotely via ZOOM, without in-person court appearances. You will receive an email from the Court if we are proceeding with your hearing with the information you need to connect. Agreed Orders Agreed Orders may be submitted to the Judicial Assistant in Word format without the need for a hearing. All parties and self-represented litigants must be included in the email transmission of the Agreed Order. You must include the Motion and Order. Notwithstanding the agreement of the parties, or submission of an agreed order, no party may cancel any hearing without the Court’s express permission. Future Hearing Dates/NoticeFuture hearing date(s) will be announced by the Court Clerk during the remote hearing in Dependency and Delinquency cases. Counsel should notice all Family cases for hearing in which the parties are represented, otherwise the Judicial Assistant will notice cases involving self-represented litigants. For Domestic Violence Injunction cases, you will receive notice of all future hearings and all applicable Temporary Injunction extension paperwork from the Court. Other Responsibilities Specific to Self-Represented Litigants All self-represented litigants will need to follow statutory deadlines for filings, follow all rules of the court, maintain and provide updated valid contact information, and appear remotely as noticed. Other Responsibilities Specific to AttorneysAttorneys are responsible for providing up-to-date, valid contact information for themselves, their clients, and witnesses, including a valid email address and working telephone number, in advance of the hearing. Attorneys are to advise and communicate with their clients and witnesses regarding the remote appearance for any and all scheduled court hearings, filing all pleadings, motions or documents within the statutory timeframes, or, if no statutory deadlines are applicable, no later than 24 hours before the scheduled hearing. Court InterpretersInterpretation will be conducted consecutively by Certified Court Interpreters, not simultaneously, during the ZOOM video conference hearing. Note: Special language Interpreter requests must be made by attorneys with as much advance notice as possible to ensure a vendor Interpreter may be secured in time for the hearing. Regular procedures for these requests should be followed. Orders for MediationUntil further notice, in all cases where an Order for Mediation has been entered by a Unified Children’s Court Division Judge, all parties may appear remotely to participate, in order to continue to progress cases to the greatest extent possible during this time.? The Mediation Division will coordinate remote appearances with all parties.? It is imperative when an Order for Mediation is entered in open court by a UCC Division Judge, that all counsel and parties to be present at the mediation session provide their updated contact information, including emails, telephone numbers, and addresses, to be included in the court order so that the Mediation Division may schedule and conduct remote mediations. If this information is not included, the mediation may not be scheduled, and the Mediation Division may send the matter back to the presiding Judge. Revised 4/9/20 ................
