Standard Operating Procedure

Correcting Lost Consideration

Occasionally through administrative error or a law or regulatory violation, an applicant will either 1) lose employment consideration due to a selection made from an erroneous certificate, or 2) lose consideration due to being ranked incorrectly or left off a certificate. When one or the other circumstances results in the person not receiving proper consideration for appointment and another individual is selected, the applicant who lost consideration is entitled to priority consideration.

Priority consideration means placing the individual at the top of the next certificate for any equivalent position (same grade, and tenure) within the agency and location for which the applicant is qualified.

Entitlement to priority consideration ends when either the applicant is selected for an equivalent position or when another individual is selected from the same certificate on which the applicant’s name was referred with priority status. Entitlement to priority consideration does not end if the certificate was not used.

The following will apply only if the certificate cannot be corrected or updated & ensure proper consideration

FIRES Program Office (FPO) Responsibility

• Notify Servicing Personnel Office (SPO)

• Establish a Priority Consideration (PC) folder

• Prepare cover sheet for each application of person entitled to PC to include:

✓ Brief explanation of reason for priority consideration

✓ Announcement case file which PC originated

✓ Title, Series & Grade

✓ Agency & Location (City, State / Refuge or Park)

✓ Record of priority consideration efforts

• Place applications of persons entitled to PC in the folder by agency and location

• Notify applicant

• Announcement Case File Documents:

✓ Lost consideration information (i.e., applicant notification)

✓ Documentation addressing corrective action/measures instituted to preclude recurrence of the problem (From SPO either or FPO as appropriate)

• Provide the following information to the SPO to include in local announcement case file:

✓ Lost consideration information

✓ Applicant notification information

✓ Corrective action/measures information

• Check PC folder every time a recruitment request is received to ensure proper consideration is provided to impacted applicant(s)

1. When there is an application from an individual entitled to PC:

• Send a copy of the vacancy announcement and the information regarding the application process.

• Send a cover letter inviting him/her to apply and minimally include:

o Consequences of not applying – lose of PC

o Date application must be received

• No application from individual

o He/she loses entitlement to PC for this examination and any future ones.

o Annotate the cover sheet and notify SPO

• Application received from individual

o Application, along with any other PC applicants, will be referred prior to any other applicants who applied to the announcement.

o Annotate the cover sheet of referral and appropriate disposition of applicant (i.e., selected, declined)

o Additional applicants will be referred after the PC applicant has been properly cleared

2. When the certificate is returned:

• If a selection has been made, entitlement to PC has been satisfied, whether the PC candidate or some other candidate has been selected

o Annotate the cover sheet

o Notify SPO

• If no selection has been made, entitlement to PC has not been satisfied

o Annotate the cover sheet accordingly

o Return the application to the PC folder for continuing consideration

o Notify SPO

3. For audit purposes, applications, status cover sheets, and notification letters will be retained in the announcement case file and the PC folder, even after priority consideration entitlement has been satisfied.

Servicing Personnel Office’s (SPO) Responsibility

• Place copy of applicant notification and lost consideration information in local announcement case file

• Establish local PC folder, keep copy of information provided by the FPO
