Sealed bids will be received and opened in the Office of the First Selectman, Town Hall, 2 Renshaw Road, Darien, CT 06820 on Thursday, October 8, 2020 at 3:00 PM, at which time and place all bids will be publicly opened and read aloud for supplying the Town of Darien with the following:

One Unmarked Administrator Police Vehicle

Full bid information is available on the Town of Darien website bids. Plans and specifications are also on file in the Office of the Chief of Police, Hecker Avenue, Darien, CT. Copies may be obtained upon request

UNMARKED POLICE VEHICLE

1. GENERAL:

1.1 Bid documents shall be enclosed in an envelope, sealed and clearly marked Bid No. 2021-07, Unmarked Police Vehicle and showing the name of bidder.

1.2 The Contractor offers and agrees to assign to the public purchasing body all right, title and interest in all causes of action it may have under Section 4 of the Clayton Act, 15 U.S.C. or under Chapter 624 of the General Statutes of Connecticut, arising out of the purchase contract of services, property, or intangibles of any kind pursuant to a public purchasing contract of subcontracting. This assignment shall be made and become effective at the time the public purchasing body awards or accepts such contracts without further acknowledgment by the parties.

1.3 Any item not supplied in accordance with these specifications or of inferior quality must be corrected in a satisfactory manner at the Contractor's expense.

1.4 Delivery must be scheduled in coordination with a ranking officer of the Police Department of the Town of Darien being supplied.

1.5 If the Contractor wishes to claim that any instructions given him in connection with a specific order for items purchased hereunder requires cost above and beyond what the specifications and instructions contained herein provide, he shall, within five (5) days after receipt of such instructions, and in any event before proceeding to make delivery, submit his protest thereto in writing to the Purchasing Agent of the Town of Darien stating clearly and in detail, the basis of his objection. No such claim shall be considered valid unless so made.

2. SCOPE AND TERMS OF PURCHASE:

To provide the Town of Darien with:

2.1 One 2021 Ford Explorer XLT/4WD or equivalent, to be used as an unmarked police vehicle.

3. NON-EXCLUSIVITY: The Town of Darien shall not be prevented by this bid or any contract expressed or implied by it or purchases made pursuant to it from purchasing the item(s) referred to herein from another contractor or vendor. This bid shall not establish an exclusive contract for the Contractor selected hereby.

4. SPECIFICATIONS FOR FORD EXPLORER XLT/4WD

The vehicle being bid shall conform to the following specifications: 4.1 BID PRICE TO INCLUDE ALL STANDARD FEATURES IDENTIFIED

FOR THIS VEHICLE. 4.2 EXTERIOR COLOR: Carbonized Gray (M7). 4.3 INTERIOR COLOR: Charcoal Black Leather. 4.4 DRIVE TRAIN: Four Wheel Drive. 4.5 ENGINE: 3.3L V6 direct injection FFV engine, 10 speed, automatic

transmission. CODE 99B/44U. 4.6 FLOOR COVERINGS: Ford All Weather Floor Mats. 4.7 KEYS: Two (2) fobs and six (6) keys to be provided. 4.8 SEATS: Charcoal Black Leather.

5. OPTIONAL EQUIPMENT 5.1 Equipment Group 202A. 5.2 XLT Technology Feature Bundle (Navigation, Blind Spot Information System). 5.3 Ford All Weather Floor Mats.

UNMARKED POLICE VEHICLE One (1) set of authorized factory Repair Manual and Electrical System Wiring Diagram shall be supplied by the dealer prior to delivery of the vehicle.

6. WARRANTY: 6.1 Three-year or 36,000 mile bumper-to-bumper limited warranty. Five-year or

60,000 powertrain limited warranty. No deductibles. 7. GENERAL CONDITIONS:

7.1 The Darien Police Department may require any bidder to provide any proposed vehicle for viewing prior to award of bid.

7.2 All equipment must be factory installed unless otherwise noted. 7.3 Award shall be made to the lowest responsible bidder (whose bid meets Town

specifications). 7.4 Bidder shall specify E.P.A. gas mileage on equipment that is bid on and trade-in

value of vehicle at the end of one year. 7.5 Bidder shall furnish a manufacturer's brochure containing specifications for each

model of vehicle being bid.

The undersigned hereby agrees to furnish the Town of Darien with one 4-wheel drive vehicle meeting the specifications and conditions of the Town of Darien, as stated in the bid documents.

The undersigned is aware that the Town of Darien may reject any and all bids; that the award will be based on the combination of items that will best serve the interest of the Town; that the bid price does not include any taxes for which the town is not liable; and that acceptance of the bid will establish no exclusive contract by which the Town of Darien will be required to purchase from the undersigned.

The undersigned claims without reservation that his/her bid is made without collusion with any other person, individual or corporation.
