GENERAL TIMESHARE USE AGREEMENT

This timeshare use agreement (the “Agreement”) is made effective, by and between

Financial Terms

1.1 The renter must make an initial deposit of 50% of the rental fee at the time that the reservation is confirmed. This deposit is nonrefundable.

1.2.1 The remaining 50% of the rental fee plus a $150 security deposit is due 60 days prior to the rental period.

1.2.2 The security deposit will be refunded within 15 days of the rental period upon confirmation from the resort that there are no damages or unpaid expenses for which the renter is responsible.

1.2 Failure on the part of the renter to pay the remaining balance of the rental fee and/or security deposit will be grounds for the owner to terminate this agreement. There will be no refunds made of the initial deposit in such situations.

1.3 The only type of refund that would be allowed is if the this unit  is uninhabitable on or before the date the term starts, by reason of flood, fire, storm, or for any other reason, the owner shall refund the rent forthwith and will thereafter have no further liability to renter.

1.4 If this rental agreement is for a resort located in the State of Hawaii, the renter acknowledges that there will be a local transient occupancy tax assessed at the time of check-in at the resort which is the responsibility of the renter. This nominal fee is charged by all timeshare resorts operating in Hawaii. In 2007, the fee was $11.42 for a studio/one bedroom unit and $31.70 for a two bedroom unit.

Terms of Use

2.1 This agreement is being entered into for the purpose of personal use by the renter and their family. Under no circumstance may this timeshare unit be sublet, occupied or given to another party without express written consent of the owner.

2.2 The renter agrees to not exceed the maximum occupancy for the unit. Failure to comply may result in eviction by the resort. Should this occur, there will be no refund of rental fees to the renter.

2.3 The renter acknowledges and warrants that they will follow all policies and rules of the resort, as notified upon arrival and occupancy of the unit. The renter should pay particular attention to check-out time as many resorts assess a fee for late check-outs.

2.4 Under no circumstance will the renter permit pets of any kind in the unit. Failure to comply with this term of use will result in forfeiture of the security deposit and possible further legal action to remedy any damages incurred including but not limited to carpet cleaning, de-fleaing, and hypo-allergenic treatments.

2.5 As part of most timeshare resort vacations, an inventory of all unit amenities is suggested. The renter agrees to comply with this inventory procedure and upon check-in assure that all items are accounted for. Discrepancies are to be reported to the resort administrative staff in accordance with their procedures.

2.6 The renter accepts all responsibilities for any damages to the unit or resort property during the rental period. This responsibility includes not only the individual renter and family but also any guests. In the event that the security deposit does not cover such damages, the owner may pursue legal remedy.

2.7 Most resorts will require a credit card imprint upon check-in for the purpose of incidental expenses (i.e., local phone, resort services, room service, etc). Renter will be expected to provide their own credit card upon arrival for this purpose.

2.8 The renter must leave the unit in the condition as specified by the resort management. Because all resorts are different, it is difficult to provide an all-inclusive list. Most resorts, however, expect guests to leave the unit clean and free of trash and left over food. The following is a short list of things you should do before departing:

2.8.1 Empty and clean refrigerator.

2.8.2 Empty all trash cans.

2.8.3 Rinse all dishes, put them in the dishwasher and start the dishwasher.

2.8.4 Strip all beds (Resorts have unique directions on what do to with the dirty laundry, to include towels. Please be sure to follow the instructions you are provided at check-in or in your resort orientation materials provided to you when you arrive.)

2.8.5 Be sure all lights and electrical appliances are turned off.

2.8.6 Lock and close all doors.

2.8.7 Return keys and all resort property to the front office/desk.

These three pages represent all understandings and agreements between the parties regarding this timeshare use arrangement. Any subsequent amendments must be made in writing and approved/signed by both parties.
