Marital status for the 2020-21 FAFSA is consistent with the Supreme Court decision holding Section 3 of the Defense of Marriage Act (DOMA) unconstitutional. If you, the student, are:

? Married as of the day you signed the 2020-21 FAFSA, you are required to report your and your spouse's financial information.

? Living with a partner and are not married, do not report your partner's financial information unless you have been living together long enough to qualify as a common-law marriage in your state of residence.

? Unsure of your legal marital status, contact us before completing the Marital Status Information form.

Important Distinctions:

1. Married and Remarried statuses do not mean "living together" unless your state of legal residence recognizes your relationship as a common-law marriage.

2. Consistent with the Supreme Court decision holding Section 3 of the Defense of Marriage Act (DOMA) unconstitutional, same-sex couples must report their marital status as married if they were legally married in a state or other jurisdiction (foreign country) without regard to where the couple resides or where the student will be attending school.
