CMCRHandbook(August 2020)IntroductionAt the conclusion of every trial, the last Judge on the record for the case will send an electronic CMCR, no later than COB the next duty day after conclusion of the trial or COB the next duty day following the Judge's return to his/her duty station. Judges do that by accessing ACMIS (Army Courts-Martial Information System), a secure, web-based management tool on the JAGCNET developed to give the Clerk of Court and trial judges theability to monitor, track, and document every step required to maintain official CMCRs-from case initiation through case review to final outcome. After the Judge captures the required CMCR information, the Judge will submit the CMCR for approval to the Clerk of Court, where personnel will approve or reject it (notifying the submitting Judge by e-mail of their action on the submitted CMCR). If the Clerk of Court rejects the CMCR, the Judge must edit the rejected CMCR and resubmit that CMCR for subsequent approval. ACMIS also lets the Judge create a charge and a specification, as well as view the change log and edit rejected CMCR(s). ACMIS can be accessed under the applications portal on JAGCNET using the CAC.The CMCR is of vital importance to our military justice system. The CMCR is the document that triggers the Army's tracking system for post-trial processing; Judges must be diligent in meeting the deadlines above. Additionally, the information contained in the CMCR are important statistical indicators. Accordingly, accuracy and completeness are critical to the mon CMCR ErrorsUsing “The” for The Charge or The Specification in the “Charge Number” field. Use Arabic numeral “1” instead.Using Roman numerals when numbering charges and specifications. Use Arabic numerals instead.If there is only one additional charge, that charge should be entered as “AC” in the Charge Number field. If entering more than one, then it should be “A1”, “A2”, etc.Misinterpretation regarding the definition of the “Earliest Restraint” field. Earliest restraint includes pretrial restraint as a result of restriction, arrest in quarters, or confinement.Failure to enter a number (even 0 when none) in the “39(a) Hours”, “Trial Hours”, and “Prep Hours” fields.Not utilizing the RC/NG codes in the “Military Classification” field.Entering the sentence in accordance with the terms of the Pre-Trial Agreement. The sentence is the sentence adjudged at court-martial. The convening authority's action will take care of the PTA.Misuse of desertion and AWOL codes. There are several codes for both of these. Judges should ensure they pick the one that best fits the specification. E.g., AWOL for more than 30 days and terminated by apprehension has its own code. The same situation without being terminated by apprehension has another. There is also one for less than 30 days, etc.Failure to add to the second military judge in the “Additional Judges” section.Misuse of victim codes. Specifically, the “F” code is frequently misused. This code is used for a servicemember of forces other than the US (including allied or enemy forces). As an example, some judges are using FFA for a female, American soldier, when they should be using SFA instead. If the “Plea Specification” or “Finding Specification” is withdrawn (“W”), dismissed (“D”), finding not required (“X”), or not guilty (“N”) there is no need to make an entry in the Plea or Finding Article 77-8,80-2 fields.If you enter either “W” or “D” in the plea field, then the findings field should be “X” for finding not required.Not entering the proper court-martial category. A new CMCR automatically defaults to “G” for general court-martial. If the case is a BCD-Special, the military judge should select “B” from the dropdown mon Reasons for CMCR RejectionLeaving the following fields blank without an explanation in the “Judge’s Comments to CMCR Approver” field (applies mainly to “Original Trial” CMCRs):Any field in the “Accused Data” section except “Middle Initial” and “Suffix” fields. “GT Score” can be blank for officers.. For many of the fields in this section “Unknown” is an option, please select it if the information is not available as opposed to leaving the field blank. Any field in the “Trial Data” section. Most common field left blank in this section is the “Pre-Trial Agreement Condition” field. Select “NO” as opposed to leaving the field blank if there is no pretrial agreement.Any field in the “Key Dates” section except the “Earliest Restraint” field. “Offense Country”, “Referred Specification”, “Plea Specification”, or “Finding Specification” in the “Specifications” section.Selecting guilty plea (“YN”) in the “Plea Category” field while also selecting not guilty (“N”) for every “Plea Specification” field in the “Specifications” section.Entries in the “Key Dates” section being out of order.
