Mulva: Oil Companies Make ‘Only About 10 Cents” a Gallon

As high gasoline prices made history this summer, James Mulva, in an appearance on ABC’s Good Morning America, blamed the price of oil for high gas prices “not companies’ greed. (ABC News Good Morning America Web site, “Big Oil CEO: Blame Oil Prices, Not Us,” May 8, 2006, )

Mulva, like many of his other contemporaries contend that just because gas prices were high and oil company’s profits were larger than ever, the companies really only reaped a small reward:

“If you look at reinvestment over the last 10 years, our industry has essentially reinvested all of its earnings back into adding to oil and gas production as well as refining capacity. In the case of our own company in the first quarter of this year we earned $3.3 billion but we reinvested $4.6 billion into adding to production and capacity of our refineries.” (ABC News Good Morning America Web site, “Big Oil CEO: Blame Oil Prices, Not Us,” May 8, 2006, )

At the same time, Mulva warned that the ethanol market would not be solid enough to ensure energy security and that efforts to continue in the exploration and production of known energy sources, oil, must continue.

ConocoPhillips Made $14 Billion Profit in 2005; $8.5 Billion in First Two Quarters of 2006

Millions spent on Settlements, Environmental Violations

In 2005, ConocoPhillips was ordered to spend $525 million to come into compliance with environmental standards by installing new pollution control technology in nine oil refineries in seven states. Residents in Contra Costa County, who live near the oil refinery owned by ConocoPhillips, have said they are concerned for their health and that of their children as a result of toxic releases coming from the plant.

ConocoPhillips Paid $900,000 to Settle EPA Suit

As part of series of sweeping investigations of U.S. oil refineries by the EPA, owners of some of the country’s largest refineries were ordered to spend millions to mitigate future air pollution incidents as well as pay up for past violations. Largest Fine in State to be Paid by ConocoPhillips

ConocoPhillips was ordered to pay $560,000 to Washington state related to an oil spill off the state’s coast covering 21 miles of shoreline. But some are calling the fine miniscule. The $560,000 fine is the “maximum amount allowed by state law” for a spill to occur in salt water. State officials entered into negotiations with the company to secure $2.2 million for cleanup costs. “The settlement with the Washington state Department of Ecology reflects our commitment to good corporate stewardship,” said the company’s spokesperson. ConocoPhillips Paid $14 Million to Federal Lobbyists (1998-2006)

Million of dollars geared toward lobbying federally elected officials have allowed oil companies to spirit their agenda to drill for more and more oil despite calls by federal officials to invest in alternative fuels. The money spent has effectively paved the way towards billions in subsidies and tax breaks and chipped away at decade old federal moratoria and environmental laws.

Between 1998 and 2005 ConocoPhillips paid their lobbyists $340,000. During the same period their lobbyists spent a total $13,846,275.85 on pursing federal officials and legislation.

Oil executives have argued that one of the most threatening obstacles to new oil production is the federal government and policies restricting access to known oil resources. A number of major sources for new exploration have been identified: the Arctic National Wildlife Refuge (ANWR), the outer continental shelf (OCS) in the Pacific and Atlantic oceans and the Gulf of Mexico.

From 1998 to 2005 five major oil companies – ExxonMobil, Chevron, Shell, Occidental and ConocoPhillips – paid federal lobbyists $28.8 million. Those same lobbyists spent $153.7 million to woo federally elected officials.

ConocoPhillips Guilty of Underreported Royalties

ConocoPhillips Cheated State Out of Millions

In 1996, the U.S. federal government began to investigate oil companies on the premises that the oil industry had been bilking California, and other oil producing states, out of hundreds of millions of dollars owed to them for education, infrastructure and recreation projects.

The United States Department of the Interior’s Minerals Management Services announced that it would audit California royalty records dating back to 1980 when officials found that oil companies, had “received gross proceeds higher than the posted prices used as the bases for calculating royalties.” (United States Department of the Interior’s Minerals Management Services Web site, “MMS on Schedule with Auditing California Oil Companies: Bills Issued for $345.5 Million,” August 11, 1997)

Along with the new findings and as a result of audit, the MMS estimated that California had been underpaid “by as much as $422 million.” (Congressional Testimony of Cynthia Quarterman, Director Minerals Management Service, Department of Interior, “Prepared for the Subcommittee on Government Management, Information and Technology Committee on Government Reform and Oversight, U.S. House of Representatives,” June 17, 1996.)

Oil refinery operators in Contra Costa County routinely contest their property tax assessments, often at the expense the community. In 2004 and 2005 Chevron, Equilon (owned by Shell) and Tosco (owned by ConocoPhillips) appealed 63 of their property tax assessments.

represents the value the county assessor placed on the refinery land and improvements. The “Applicant Total Value” column indicates the amount the oil companies placed on their land and improvements:
