The solicitation documents state that you are looking for 90 gallon bins? Is that a type-o? If it is not a type-o, will the government accept the industry standard 96 gallon bins?RESPONSE: Yes, it is a typographical error 96 Gallon containers are currently being used.2) Will the government accept on-site services versus the off-site option?RESPONSE - On site shredding service will be accepted versus off-site option.3) We would also like to know the current contract amount and the vendor please.RESPONSE – Infoshred, LLC, $26,000.00 (One Year).4) P.5 - General: The documents to be destroyed are described as “classified” on five CLINs (0001,1001, 2001, 3001, 4001), as well as on pages 5-6. In other descriptions the material is describedas “confidential”. Please confirm whether there will be classified material in your documents asthis level of destruction will affect our performance requirements and therefore our pricing.If the solicitation contains the term “Classified”, Classified information is sensitiveinformation to which access is restricted by law or regulation to particular classes ofpeople. A formal security clearance is required to handle classified documents or accessClassified data.If material is “Classified” this means it is assigned a National Security Clearancelevel code of something such as Secret or Top-Secret, etc.4a) I don’t think this is what you want, is it?RESPONSE: No material is Classified, materiel is considered to be confidential.4b) I think you want it to say “Confidential”, which is a much lower standard. If you do want it to be considered “Classified”, It will add a lot of expense to your contract, not to mention PHI is NOT “Classified”. Scope of Work: “off-site shredding” is called for here rather than on-site destruction or on-site interim destruction with final destruction off-site. Have you indicated anywhere in thesolicitation a desire for on-site interim shredding, and if so where is it mentioned? RESPONSE: No, materiel to be shredded is to be considered as Confidential, on-site shredding is acceptable.4c) Alternately please confirm that you are indeed requesting all documents be carried off the properties to be destructed in a different location ? RESPONSE : On-site shredding is acceptable.5) P.6“g” The ability to “use shredded paper for recycling purposes” hinges on whether your materialis classified or confidential. If the latter, recycling is our standard method of disposal. If it isClassified material, the destruction follows different parameters, which results in a materialthat cannot be recycled.“j” Inspection of the equipment and vehicles is not a problem, but the COR should understandthat while in operation the truck box cannot be opened for inspection.That would be a HUGE security and NAID AAA Certification violation.“l” Please note that VA Directive 6371 outlines the process for destroying temporary sensitiverecords, stating that they must be “destroyed to a degree that definitively ensures that theyare not readable or reconstructable to any degree.” Yet in another reference to Directive 6371,on page 8 of the solicitation, it is indicated in quote marks (as though quoting from theDirective), that the destruction process should reduce the material to particles “1x5 millimetersin size”. Unfortunately nowhere in Directive 6371 are millimeters (or any other particle size)mentioned. Also, as it relates to the “Recycling” issue referenced above, 1 x 5 MM particleshred size is equivalent to dust and therefore cannot be recycled.VA Directive 6371 specifically does not reference a particle size to avoid this very issue. As long as the process renders the material not reconstructable or readable, that is all that is required.We are subject matter experts on the secure destruction of our client’s temporary paper records. If your Privacy or Security Officers would like to speak with us and receive a detailed explanation on how our process works, we would be happy to do so. As an FYI, 1 x 5 MM particle size shredding is only required for NSA Level 7 security Destruction (i.e. National Security, CIA, DOD, and other Top-Secret records). It is totally unnecessary for PHI information. It also is very difficult to accomplish, is very slow, very expensive, and very environmentally hazardous. It produces a tremendous amount of dust subject to spontaneous combustion risks (i.e. It is a tremendous fire hazard), and requires very expensive equipment to perform this work. There are virtually no companies in the U.S. capable of performing the work. If they say they can, then you better make them prove it by requiring them to demonstrate their process to you. Finally, just because the 1 x 5 MM particle size is mentioned in NIST 800-88, and VA Directive 6371 cites the NIST document as a reference, this does not mean it is incorporated into the Directive.5a) For these aforementioned reasons, we would ask you to make a modification to remove this reference on page 8, and any other reference to millimeter size, and only reference VA Directive 6371?RESPONSE: The contractor shall follow VA guidelines that are defined in the VA directive 6371.6) Areas of Consideration: Please let us know how many buildings are being serviced at each location so that we may be able to provide accurate pricing?RESPONSE There is one pick up location at each campus (Newington & West Haven). All other locations have one building.7) P.7 Specific Requirements7a) Please provide what state licensing credentials you are requiring and where to find those for review?RESPONSE: Deleted. Please explain the standards of State of Connecticut-certified shredding services and the other quality assurance criteria.RESPONSE: Worker Compensation and Employer's Liability: Contractors are required to comply with applicable Federal and State Workers Compensation and Occupational Disease Statutes. State certified shredding services requirements have been deleted from the SOW. 7c) Please explain exactly what you mean by “When full, they shall be brought to a pick up location by VA staff.” Will this location be one spot within each building? Or brought to a dock? To our truck?RESPONSE: The VA staff empties the small containers into the larger ones for the contractor to pick up at a centralized location at the West Haven campus as well as the Newington campus.7d) Does this mean you DO NOT expect us to walk the buildings to gather the material? Thatyou will be bringing it to us? “Full containers to be changed out with empties as needed”: We typically will be emptying ALL the containers on our service calls, at which point the same container can be returned to your pick up location for the VA staff to distribute as appropriate. There won’t be any need to change out containers.RESPONSE : The contractor will go to a centralized location at each campus and pick up the full containers.8)p.10-22 Price/Cost Schedule It isn’t clear how you would like us to fill out this schedule. 8a) Would you prefer that we put a total price for 12 months next to the lead item (e.g. 0001)?RESPONSE: No, Line Item 0001 shall not be completed. RESPONSE: No, the requirement for Slim Jims has been deleted from the SOW.9c) Who will empty them? RESPONSE: The contents of the Slim Jim containers will be emptied into the secure shredding containers by VA employees that the contractor is being paid to service. 9d) Where will the material residing in those go – in other words will the Slim Jimmaterial become part of what we need to shred?RESPONSE: The material in the containers will need to be shredded.9e) If the VA wants to have these containers and expects us to provide them, and also emptythem, then WE WILL charge for this service. If the VA only wants to have thesecontainers for their employees’ use, and then have them empty the contents in thesecure shredding containers we are being paid to service, this would be acceptable. Additional buildings, structures and other real property/locations as identified by the Government and considered as on-site and off-site locations may be added/and or removed throughout the life of the award and shall be considered within scope and modified accordingly by a warranted Contracting Officer.Required quantities are subject to change throughout the life of award and any adjustment that would result in a change in time or money must be approved by the warranted Contracting Officer and shall be modified accordingly.Pick-Up schedule is provided as an attachment and shall be used in conjunction with the work requirements for this award. Special pickups may include non recyclable paper products such as floppy drives, CD/DVD ROMs, VHS Tapes, plasticize film from thermal transfer printers and fax machines, and other media that contents sensitive data.GENERAL REOUIRMENTSa.The items for the disposal of shredding shall include and not be limited to records, Personal Identity Verification (PIV) Cards, records containing carbon, binders, folders, types and colors of paper as well as staples and fasteners, other non-paper materials to include sensitive and non sensitive information. Throughout the life of the award various items for shredding may be added and removed accordingly and shall be considered to be within scope.b.The contractor shall provide all labor and equipment to include collection bins and shall be responsible for disposing of shredded materials throughout medical center campuses and CBOC's. Shredding may be witnessed by a VA employee authorized to witness destruction of sensitive material. All collection bins shall be securely locked configured to not allow user access paper through opening.c.Contractor is responsible for maintaining liability insurance for the duration of the award, and for following all pertinent federal and state regulations with regards to destruction of classified medical documentation.d.While on VA property for both on-site and off-site locations, contractor employees will wear a company uniform and a visible identification badge which contains a photograph of the employee. All contractor vehicles and collection bins will be clearly identified with the company's name.e.The contractor will provide the service identified in this award between the hours of 8:00 a.m. and 4:30 p.m., Monday through Friday.f.The contractor will provide for inspection, upon request by a VA representative, of the contractor's facilities where the records are processed and final destruction takes place.g.The contractor must use shredded paper for recycling purposes, but not sell it as packaging material. Transferring contents of collection containers is not authorized.h.Contractor will ensure an acceptable alternative method of destruction for facility records when shredders are not operational. Alternative methods for destruction should be described in the request for proposal.i.Contractor must describe how material that is not shredded to VA specifications is to be recycled (e.g. pulverized, bleached , pulped) and how it will be protected until such time that the final recycle process in completed to protect the material until it is no longer readable and not re? constructible.j.Contractor vehicle(s) used in the performance of this award will be licensed, registered and insured. The VA reserves the right to inspect the Contractor's equipment and vehicles.k. Business Associate Agreement shall be completed by contractor at time of award.l. Contractor shall shred documents in accordance with shredding specifications outlined in most recent VA Directive 6371 guidelines.?Contractor will provide credentials of State licensing for the handling of confidential materials, of a security nature and having private patient records.?Contractor will maintain secure safekeeping of all materials from point of pick-up to shredding and disposal.?Contractor will provide a certificate of insurance for working on a Government installation as follows.Insurance:a) Worker Compensation and Employer's Liability: Contractors are required to comply with applicable Federal and State Workers Compensation and Occupational Disease Statutes.b) General Liability: Contractors are required to have Bodily Injury Liability insurance coverage written on Comprehensive form of policy of at least $500,000.00 per occurrence.c) Property Damage Liability: Contractors are required to have Property Damage Liability insurance to cover at least $500,000.00.?Contractor's services shall meet the standards of State of Connecticut-certified shredding services and meet other quality assurance criteria.?Contractor will provide locked slotted containers to the VA hospital for storage and disposal of confidential materials. When full, they will be brought to a pick up location by VA staff. Full containers to be changed out with empties as needed.?VA to visit Contractor's facilities for an inspection and evaluation. ? The Contractor shall provide a written "Certificate of Destruction" to the GPOC weekly to provide verification of the destruction of the contents of all containers and receptacles referenced.MONITORING OF THE AWARDA delegate on behalf of the VA for the CBOC locations shall be designated the Government Point of Contact to monitor the award and to verify compliance with technical requirements. The Government Point of Contact (GPOC) shall be the VA official responsible for verifying award compliance. The GPOC will be responsible for monitoring the Contractor's performance to ensure all specifications and requirements are fulfilled. The Contractor is advised that only the Contracting Officer has the authority to make changes to the award. After award, any incidents of non-compliance as evidenced by the monitoring procedures shall be forwarded immediately to the Contracting Officer.The contractor shall permit on-site visits by VA personnel and accrediting agencies to assess contracted services, e.g. adequacy, compliance with contract requirements, and record keeping if applicable.The award will be monitored monthly by the GPOC in regard to: l) Timeliness of pick? ups, 2) Licensing of Employees and Vehicles, 3) Billing Errors and 4) Customer Satisfaction.SPECIAL AWARD REQUIREMENTSThe services specified in the Statement of Work and Special Award Requirements may be changed by written modification to this award. The VA Contracting Officer will prepare any modification to this award. Prior to becoming effective, the modification shall be approved by the Contracting Officer.HOURS OF OPERATION:a) Normal Hours: The normal hours of operations at the VA Connecticut HCS and its leased locations are Monday through Friday from 8:00 am to 4:30 pm, excluding holidays. All work and services will be performed during normal hours of coverage and will be during the time period agreed upon with the GPOC. b) If a scheduled day for services falls on a Federal Holiday the contractor will provide services the following day or a day previous agreed upon with the GPOC. CONFIDENTIALITY OF MATERIAL DESTRUCTIONThe award for shredding services and management of document destruction must follow VA Directive 6371 Destruction of Temporary Paper Records, Veterans Health Administration (VHA) programs and facilities must enter into a fully actuated Business Associate Agreement with all records destruction or recycling vendors who complete interim destruction off-site or not under the direct control of VHA personnel.Contractor personnel shall comply with the confidentiality in the destruction of all VACT records. Any contractor personnel found to be reading any of the VACT materials shall be promptly removed from the government premises. The person's involved shall not be allowed to return to the VACT or CBOC's for any further service requests.The procedures in VA Directive 6371 Destruction of Temporary Paper Records must be followed. Specifically, the "shredder device must have a crosscutting capability which produces particles that are 1X5 millimeters in size".a) Privacy Act Documents: The contractor understands and agrees that property obtained under thiscontract may contain records previously maintained as a system of records subject to the Privacy Act.The contractor is subject to the provisions of the Privacy Act and is responsible for compliance withits provisions with respect to the handling and disposal of protected information. Additionally, all document destruction and documentation shall be as required by the Health Insurance Portability and Accountability Act (HIPAA).b) HIPAA Compliance: Contractor must adhere to the provisions of Public Law 104-191, HealthInsurance Portability and Accountability Act (HIP AA) of 1996 and the National Standards to Protect the Privacy and Security of Protected Health Information (PHI). As required by HIPAA, the Department of Health and Human Services (HHS) has promulgated rules governing the security and use and disclosure of protected health information by covered entities, including the Department of Veterans Affairs (V A). In accordance with HIP AA, the Contractor shall be required to enter into a Business Associate Agreement (BAA) with VA.c) Document Destruction Reports. Document destruction reports shall be submitted to the GPOC within 48 hours of pickup and shall include the information required to meet HIP AA requirements.At a minimum the report shall include:- Date of document pickup.-Weight/tonnage picked up.- Date of Destruction.- Method of Destruction.- Description of the disposed records: Confidential documents.- Statement that the documents were received secured.- Statement that the documents were destroyed in the normal course of business.- The signature of the individuals supervising and witnessing the destruction.AWARD PERSONNEL SECURITY REQUIREMENTSVA Sensitive Information - the contractor shall review the attached document from VHA Handbook 6500.6 Appendix C & D.VHA Handbook 6500.6 Appendix C & D -VA INFORMATION AND INFORMATION SYSTEM SECURITY/PRNACY LANGUAGE FOR INCLUSION INTO AWARDs, AND AS APPROPRIATE, SHALL TAKE THE TRAINING OUTLINED IN SECTION 9?Contractor Access to TMS Worksheet Template for VA Privacy and Information Security Awareness Training and Rules of Behavior will be provided as an attachment when the award is awarded.The C& A Requirements do not apply and a Security Accreditation Package is not required.Background Investigations and Special Agreement Checks for Position Sensitivity: The position sensitivity will be determined by VA's Human Resources service at time of fingerprinting.All contractor employees are subject to the same level of investigation as VA employees who have access to VA Sensitive Information. The level of background investigation commensurate with the level of access needed to perform the statement of work is: NACJ/LOW RISK. This requirement is applicable to all subcontractor personnel requiring the same access.The contractor shall bear the expense of obtaining background investigations. H the investigation is conducted by the Office of Personnel Management (OPM) through the V the contractor shall reimburse the VA within 30 days. ** The Suitability Determination is provided as an attachment **When receipt of award is presented to the contractor - any contractor employees who have had previously completed background investigations shall contact the VA Security Investigation Center (SIC) indicating which employees may be eligible for reciprocation.Reciprocity will be verified the by VA (SIC), if this can be verified, an email notification will be sent to the Contractor Point of Contact and forwarded to the Contracting Officer.Should the contractor require employees working under the award to undergo a Background Investigation, the award letter issued to the successful offeror will provide instructions and the forms required for this process are attached to this solicitation.AWARD RESPONSIBILITIES FOR SECURITYa.Once the award is awarded, the contractor must email the GPOC the name, address, SSN, date of birth, place of birth (city, state & country), and email address of each individual who will be providing services to the VA under the award.b.The contractor's employees will be required to report to VA's Human Resources service prior to their first day or on the first day they are required to report on station. They must have two forms of ID and may be required to provide such things as their name, address, social security number, etc. They will also be fingerprinted at this time.c.The contractor will then be contacted by the VA Law Enforcement Training Center. The VA Law Enforcement Training Center will advise the contractor as to what is needed to complete the background investigation and where to send all the supporting documentation.d.The contractor, when notified of an unfavorable determination, shall withdraw the employee from consideration from working under the award.e.Failure to comply with the contractor personnel security requirements may result in termination of the award for default.f.Any ID badges the contractor employee receives from VA must be returned to VA upon and completion or contractor's employee term for providing services. If ID badge is not returned contractor will be required to pay VA $500 for each unreturned badge.g. The contractor will have to complete a standard Business Associate Agreement (BAA) in accordance with the Health Insurance Portability and Accountability Act of 1996 (HIPPAA) after award.QUALITY CONTROL: The contractor is responsible for developing and maintaining a quality control program to ensure document destruction. Shredding Services are performed in accordance with commonly accepted commercial practices.
