AMENDMENT TO THE AGENDA

RESOLUTION #R 13- 207

RESOLVED, that the Town Board add the following amendment to the agenda:

AUTHORIZE SUPERVISOR TO SIGN TEAMSTER CONTRACT

RESOLUTION #R 13- 208

WHEREAS Local 456, International Brotherhood of Teamsters (the “Union”) is the recognized collective bargaining representative for all Highway Department and Lake Peekskill Improvement District Employees; and

WHEREAS a Collective Bargaining Agreement between the Town and the Union expired on December 31, 2010; and

WHEREAS the Town and the Union have been engaged in negotiations, mediation, and fact-finding procedures, directly and through the New York State Public Employee Relations Board, since that time in an effort to agree on new contract terms; and

WHEREAS the Town and the Union have reached Agreement on terms for a new contract for a term commencing January 1, 2011 and ending December 31, 2014; and

WHEREAS said contract, last revised May 19, 2013, has been reviewed by the members of the Town Board and found to be acceptable;

NOW THEREFORE BE IT RESOLVED that the Town Supervisor be and is hereby authorized to execute the renewal contract specified above.

AUTHORIZE SUPERVISOR TO SIGN CSEA CONTRACT

RESOLUTION #R 13- 209

WHEREAS the Civil Service Employee Association (“CSEA”)Local 1000, AFSCME,AFL-CIO (the “Union”) is the recognized collective bargaining representative for those job titles specified in a Collective Bargaining Agreement whose term expired on December 31, 2012; and

WHEREAS the Town and the Union have been engaged in negotiation since that time in an effort to agree on new contract terms; and

WHEREAS the Town and the Union have reached Agreement on terms for a new contract for a term commencing January 1, 2013 and ending December 31, 2016; and

WHEREAS subject to the modifications contained in the Memorandum of Agreement annexed hereto, the Collective Bargaining Agreement which expired on December 31, 2012 will be renewed for a term ending December 31, 2016; and

WHEREAS the previously – expired contract and the Memorandum of Agreement annexed hereto have been reviewed by the Members of the Town Board and found to be acceptable;

NOW THEREFORE BE IT RESOLVED that the Town Supervisor be and is hereby authorized to execute the Memorandum of Agreement annexed hereto.

APPOINT LAKE PEEKSKILL SEASONAL LABORER-J. SCHULTZ

RESOLUTION #R 13- 210

RESOLVED that the Town Board appoint Jonathan Schulz as a temporary, seasonal laborer for

for the Lake Peekskill Improvement District at the rate of $11.44 per hour with no benefits,

Effective May 22, 2013 and end September 27, 2013.

Seconded by Councilwoman Whetsel, unanimously carried.

DISCUSS PROPOSED LOCAL LAW TO AMEND CHAPTER 8 OF THE PUTNAM VALLEY TOWN CODE SO AS TO REMOVE FROM THE PARKS AND RECREATION COMMISSION THE RULEMAKING AUTHORITY-DOG PARK AND SET PUBLIC HEARING DATE

Discussion

Town Counsel Zutt explained to the Town Board that the present Chapter 8 puts the rule making authority and the imposition of fines onto the Parks and Recreation Commission. This proposed amendment to Chapter 8 will move the power from the Parks and Recreation Commission to the Town Board and it would cover any of the Parks and Recreation property.

Councilwoman Whetsel is concerned how the residents would know what the rules are for the dog park.

Town Counsel Zutt replied that there will be a public hearing. Also, when a resident comes to get a dog park tag, the rules will be attached and the resident would sign off that they received such rules.

RESOLUTION #R 13- 211

RESOLVED that the Town Board set the public hearing date as July 10, 2013 at 6:00 p.m. to hear public comments on a proposed local law to amend Chapter 8 of the Putnam Valley Town Code so as to remove from the Parks and Recreation Commission the rulemaking authority-dog park.

Seconded by Councilman Luongo, unanimously carried.

AUTHORIZE FEES TO BE WAIVED FOR EAGLE SCOUT PROJECT-HILLTOP BEACH-K. KELVAS

RESOLUTION #R 13- 212

RESOLVED that the Town Board waive any fees in regard to the Eagles Scout Staircase Project at Hilltop Beach being done by Scout Kyle Kelvas.

APPROVE LOCATION CHANGE-PHOTOVOLTAIC SYSTEM

RESOLUTION #R 13- 213

RESOLVED that the Town Board authorize the location change for the Photovoltaic System. Originally, the system was to be installed on top of the Putnam Valley Volunteer Fire Department roof, but due to membrane that their roof is coated with, their warranty would be null and voided. The new location for this system will be on the roof of the new Town Hall addition, funding for this project will be provided by NYSERDA and the Dormitory Authority State of New York.

DISCUSSION ON LAX CLAIM-SURVEY PROPOSAL

Town Counsel Zutt showed the Town Board members a map showing where the Lax property is located and the town owned cul-de-sac where the discharge should be draining to. Mrs. Lax complaint is that the drainage is discharging onto her property. In order for us to locate the cross drain we would need to do a survey to determine if the cross drain is draining onto Mrs. Lax Property or the town’s property.

RESOLUTION # R13-214

RESOLVED that the Town authorize Badey and Watson to conduct a survey locating the actual traveled way, any culverts and streams running under the road and a survey of the cul-de-sac and an estimated 200 feet of Trail of the Hemlocks to determine the precise boundaries of the road at the cost of $1480.00. This survey is necessary to evaluate the potential liability of the Town of Putnam Valley for stormwater damage alleged by property owner Faith Lax to her property located at Trail of Hemlocks (TM#50.16-1-18) in the Town of Putnam Valley.

DESIGNATE TOWN CLERK AS RECEIVER OF NOTICES OF CLAIM SERVED UPON SECRETARY OF STATE

RESOLUTION #R 13- 215

WHEREAS General Municipal Law, Sect. 53 requires towns to file a certificate with the Secretary of State designating the Secretary of State as an agent for service of a notice of claim; and

WHEREAS General Municipal Law, Sect. 53 requires the certificate to include the applicable time limit for filing the notice of claim and the name, post office address and electronic mail address, if available, of an officer, person, for the transmittal of notices of claim served upon the Secretary as the town’s agent; and

WHERAS pursuant to General Municipal Law, Sect. 50-e(1)(a), the applicable time limit for the filing of a notice of claim upon a town is 90 days after the claim arises, or in the case of a wrongful death action, 90 days from the appointment of a representative of the decedent’s estate;

NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of Putnam Valley, County of Putnam designates Eileen Royael, in her capacity as the Putnam Valley Town Clerk, to receive notices of claims served upon the Secretary of State by mail at Town Hall, 265 Oscawana Lake Road, Putnam Valley, New York 10579 and email at eroyael@

BE IT FURTHER RESOLVED, that the Town Board hereby directs the Town Clerk to file the required certificate with the Secretary of State informing him or her of the town’s designation and applicable time limitation for filing a notice of claim with the town on or before July 14, 2013.

3. Desiree McBride, Lifeguard, @ $11.00 per hour.

4. Jessica Gallagher, Lifeguard Supervisor, @ $700.00 for season.

5. Maria Pagani, Senior Camp Counselor, @ $2226.00 for season.

6. Desiree McBride, Child Center Ass’t., @ $10.00 per hour.

7. Tyler Kroll, Lifeguard @ $10.50 per hour.

REVIEW 6-19-13 AGENDA

Deputy Supervisor Annabi reviewed the 6-19-13 agenda with the Town Board members.

The Town Board questioned if the Building/Zoning Inspector will give them information on the permit fee waiver requested by Cantamessa.

Town Counsel Zutt told the Town Board that he sent the Building/Zoning Inspector an email requesting information for the 6-19-13 meeting.

Deputy Supervisor Annabi reminded the residents of Lake Peekskill to clean up their properties and that the Zoning Inspector will be issuing summons to residents whose properties are not cleaned up.

Deputy Supervisor Annabi added that volunteers are needed for the Lake Peekskill Family Day on August 3rd with the rain date being August 4th. If anyone would like to volunteer, please call Town Hall.

Deputy Supervisor Annabi moved to close the meeting at 6:39 p.m.
