Old Towne Bethelview Homeowners Association, Inc. Design Guidelines, Revised Apr. 2010

The Old Towne Bethelview Homeowners Association Design Guidelines has been created to establish minimum design standards and recommendations for all new construction within Old Towne Bethelview. The purpose is to ensure design consistency within the community. It is not the intent to inhibit, or in any way restrict, design creativity. The goal of these guidelines is to achieve a variety of designs, blended together to create a visually pleasing community. These guidelines supplement, but do not modify, replace or limit any provisions of the Declaration of Covenants, Restrictions and Easements for Old Towne Bethelview HOA, Inc. In the case of a conflict between Declaration and these Guidelines, the Declaration shall always control. The Design Guidelines are also subordinate to all state, county, or local building codes. The Architectural Control Committee (ACC) as established by the Declaration, reserves the right to change these design guidelines if deemed necessary. ACC approvals must be in writing, verbal approvals are not acceptable approval communication. All projects must be completed in ninety (90) days, unless otherwise approved.

Decks

➢ All decks must be approved by the ACC prior to installation.

➢ In most cases, decks should not extend past the sides of the house.

➢ Materials must be left natural, stained with an approved color or stained with a clear coat. The painting of decks will not be permitted in Old Towne Bethelview. Decks must be maintained.

➢ Homeowner is responsible for acquiring the necessary permits and following all governmental regulations and building codes.

Fences

➢ All fencing must be approved by the ACC prior to installation. A site plan denoting the location and description of the fence type is required.

➢ Permitted fencing in Old Towne Bethelview is a 4’ high, white, PVC, saddle, picket “OTB/Beazer style.” Country Estates was Beazer’s original fence manufacturer/installer.

➢ Along back wooded areas, black-coated-link fence may be installed.

➢ Fencing must be completed within the property lines of the lot.

➢ Any fencing in a drainage easement must not interfere with the flow of storm water in the easement. County agencies have the right to access along all easements. It is recommended that fencing should not cross easements. Perpetual easements exist along all drainage and sanitary sewer easements. The homeowners association and county agencies have the right to access along all easements.

Storm Doors/Screens

➢ No ACC application is necessary as long as the following stipulations are met

➢ Doors must be metal framed, color to match entry door or trim black or white

➢ Full view style (no middle bar or kick panel)

➢ May have a clear or screen insert (no color etched glass)

➢ Hardware finish to match entry door handle finish (Polished Brass-Antique Brass-Nickel)

➢ May be applied to the front or back doors

➢ Door styles listed below all come with screen inserts. They are suggestions only and at this writing, can be found at Home Depot or Lowe’s.

o Anderson – 2000, 3000, 4000 or EMCO 75 series

o Pella – Royalton, Ashford, Kingston, Worthington, Meadowview, Wellsley

o Larson – Signature series, Charleston, Williamsburg, or Springfield.

➢ Frame-attached retractable screens and frame-attached sliding screens are permitted.

Tents/Gazebos

➢ Placement of temporary event/party tents must be approved by the ACC. Party tents may be erected for up to 10 days unless otherwise stated.

➢ No ACC approval is necessary for outdoor wall tents/temporary gazebos as long as the following guidelines are met: All tents must be neutral in color, cloth type material, and must be maintained. They must be secured in the event of a storm or high winds.

Attached Awnings

➢ All attached awnings must be approved by the ACC prior to installation. Awnings have to be located over the rear cement patio or deck, attached and color coordinated to the house and retracted when not in use. If the awning is not maintained, becomes discolored or needs maintenance, it must be removed.

Garbage Cans

➢ All trash screens must be approved by the ACC prior to installation.

➢ Garbage cans, wood piles and similar items shall be stored from view of adjacent lots and streets.

➢ Trash, rubbish, garbage, debris, or other waste material of any type shall be regularly removed and shall not be allowed to accumulate.

Signage

➢ One for sale sign and flier information will be permitted on any lot at any time. No signs taller than 3 feet above ground level will be permitted. Security company signs placed next to the home are permitted.

➢ Garage sale signs may be posted the weekend of the sale from Thursday until Saturday.

➢ All other signage within the community must have prior written approval of the ACC.

Exterior Maintenance, unsightly conditions

➢ All planting areas should be properly maintained at all times with dead plant material removed. Bermuda grass should be removed from the decorative bedding areas, and lawns should be free of weeds.

➢ All bedding areas must have fresh mulch or pine straw. If the beds have dirt showing through or if the pine straw or mulch is graying in color, it is required that the beds be replaced with fresh covering. River rock and lava rock will be permitted providing that the material is natural in color (red, black, brown, and grey). All other rock must be submitted for ACC approval. All bedding area coverage must be uniform and consistent including the bedding areas shared by 2 lots. Landscaping should relate to the existing terrain and natural features of the lot. Grass clippings must be cleared from sidewalks, driveways, and streets when mowing is complete.

Painting

➢ Homeowners painting the exterior of their home in colors that deviate from the original builder supplied colors or from previously approved colors, whether in sum or individually as to siding, door, trim, etc. must apply for and receive ACC approval.

➢ Homeowners painting the exterior of their home in their existing colors whether in sum or individually as to siding, door, trim, etc. need not apply for approval from the ACC but must submit an ACC request form to the property manager, Crye-Leike, stating their intent to do so.

➢ Downspouts, gutters and garage door need not be painted. Homeowners painting the downspouts, gutters and garage door may do so using the appropriate formulated paint designed to adhere to these items. The color must match the ACC approved trim color or the original white color.

➢ Exterior paint colors must be in conformity and harmony with the existing standards of Old Towne Bethelview.
