Guidelines Specific to Town Homes

(Effective 12/31/04)

Addendum to Southern Village HOA ARB Guidelines

As part of an on-going effort to make Southern Village a better place to live and raise children, the Board of Directors for the Southern Village HOA has tasked the Management Company with conducting drive through inspections, twice per month. More details regarding the inspections can be found in the main copy of ARB guidelines. These guidelines are to be used in addition to the main set of ARB guidelines and covenants that have been established for the entire membership of Southern Village HOA. CLOTHESLINES

Permanent exterior clotheslines are prohibited.

PARKING

No industrial or commercial type vehicles, boats, recreation vehicles, campers, motorcycles, tractors, trucks (other than one pick-up truck rated at one-half ton or less), trailers or inoperable vehicles may be regularly parked on a lot or common property.

STORAGE

1. Storing garbage containers in front or at side of a unit is prohibited. All garbage cans must be screened by adequate improvements so as to screen them from view from the street and adjoining Lots.

2. No trade materials or construction debris may be stored upon lots or common property.

3. Temporary storage of materials for approved or permitted projects must be placed in an out of the way location and maintained in an orderly manner.

Clutter:

Defined as a collection of various items strewn about a yard or stored, haphazardly, in the open. The Covenants provide that a property owner must take care to ensure that they keep their property in a reasonable and neat condition.

BASKETBALL GOALS

Basketball goals, either attached to a unit or freestanding, are prohibited.

PETS. PET HOUSES AND PENS

No animals, exotic animals, livestock or poultry of any kind shall be raised, bred or kept on any lot except as follows:

1. Dogs, cats or other household pets may be kept, provided they are not bred or maintained for commercial purposes or are not a public nuisance or annoyance.

2. Homeowners are required to prevent their pets from misusing lots and common property as a latrine and, if mishaps occur, to pick up feces for disposal.

3. Pet owners are also expected to abide by any city or county ordinance concerning their pets.

EXTERIOR PAINTING

1. Exterior painting of units is the responsibility of the Homeowners Association.

2. Changes to existing exterior colors are prohibited.

Exterior painting of the doors is the responsibility of the homeowner. All based on guidance from the Architectural Board.

ATTIC FANS

Attic fans require homeowner to submit to ARB. They must be located on the roof facing the back of the lot.

SKYLIGHTS

Because the roofs are common property, the installation of a skylight would need approval of the abutting townhome owners.

SWIMMING POOLS

Swimming pools are prohibited.

HOT TUBS

Hot tubs, Jacuzzi tubs or other similar structures need ARB approval.

SOLAR COLLECTORS

Solar collectors are prohibited.

RADIO/TV ANTENNAS AND SATELLITE DISHES

Follow Guidelines for SVHOA ARB 12/31/04.

ADDITIONS AND STRUCTURAL CHANGES TO TOWNHOMES OR CONDOS

ACTIONS NOT REQUIRING APPROVAL

Normal maintenance, whether homeowner or association responsibility, does not require submittal

to the ARB. Repair and maintenance of items under HOA responsibility will be dealt with through the Management Company and Board of Directors.

ITEMS REQUIRING APPROVAL

All proposed additions or structural changes to the exterior of a town home require homeowner to submit an ARB Request

• Fences must be submitted to the ARB

• Painting of ones front door.

• Any other change, not part of original construction also needs ARB approval.

LANDSCAPING

ACTIONS PROHIBITED

1. Adding, removing or changing any landscaping in the common areas.

2. Planting any shrub or tree within existing drainage channels or changing the location, contour or slope of the channels on homeowner’s lots or common areas.

3. Hedges or screen plantings closer to the front lot line than the front of the town home.

4. Adding, removing or changing the shape of any sod or mulched area in front of the

Town home.

LANDSCAPING REQUIRING Approval

1. Adding, removing or changing the location of any tree on homeowner's lot. If a tree should die and pose an imminent danger to persons or property, emergency action should be taken and HRW, Inc., a Board or Committee Member notified as soon as possible,

Retaining walls, terracing or other actions that change the contour of the homeowner's lot, whether or not drainage is affected.

3. Removing or adding shrubs or changing their location in the landscaped area in front of a town home or on the side of an end unit

4. Any major landscaping in the backyard including, but not limited to, planting ground- cover on the hilly section of a Lot, addition of trees, large shrubs, or large bedding areas.

LANDSCAPING NOT REQUIRING APPROVAL

1. In the back yard of a unit, planting sod, creating naturalized (mulched) areas and planting flowers, small trees and shrubs.

MAINTENANCE/REPAIR:

Homeowners should be alert to the overall condition of their own and common property and

Report appropriate items to the Management Company. Irrespective of maintenance responsibility, homeowners pay for all maintenance either directly or through Association funds. Therefore, prevention and quick repairs help minimize overall expense. The following areas should be reviewed regularly; Shrubs, Trees and Lawns, Driveways and Sidewalks, Decks, Roofing Exterior Paint and Caulking.

Owners are responsible for the maintenance of the decks, screens, screen doors, exterior doors, windows and window fixtures. Approval is not required to apply a clear waterproofing product to decks. Stain or waterproofing with color added is prohibited.

RENTAL OF YOUR TOWN HOME

Landlord owners bear responsibility for ensuring that their tenants comply with these guidelines, the general SVHOA ARB guidelines and all applicable master and supplemental covenants. Town home owners are urged, therefore, to make such compliance a condition of leases or other rental agreements, because they will be held strictly accountable.

Home Owner Association Responsibility:

The Association will be responsible for maintenance and/or repair of:

1. Roofs gutters, downspouts, exterior paint and trim.

2. Repair of moldings, masonry and other structural items on the buildings as part of original construction.

3. Trees, shrubs, flowers, grass and mulch as part of original landscape plan.

4. Excluded are all services, utilities, sidewalks and road surfaces under the jurisdiction of local utilities and municipalities.

Unit Owner Responsibility:

The owners are responsible for the care, maintenance and upkeep of:

1. Any additions not part of original construction or design of building.

2. Exterior window glass and fixtures and other hardware on a lot.

3. General care of landscaping (Watering).

4. Care and maintenance of all utility fixtures and connections i.e., electrical, plumbing, cable, telephone, gas; located inside the exterior walls of a building.

Responsibility for maintenance and repair may be more thoroughly discussed in your specific set of Supplemental Covenants. The omission of any items, condition, state, location, color, description, type or size of anything noted in this document will not cause it to be automatically approved by any sitting ARB. The board reserves the right, under the authority of the Master Covenants and any amendments, to amend any or all parts of these supplemental ARB guidelines.
