|Vendor Requirements |

The Alberta Farmers Market Regulations state that preference must be granted to Alberta producers who make, bake, or grow their products. Seba Beach Farmers' Market will have limited space available for commercial products as they are not a priority of this market.

Non-Alberta producers who make, bake or grow their products as well as those who offer resale items may supplement the market mix with those products not available in Alberta. These vendors fall into the 20% category. Markets may choose to limit or prohibit out-of-province products.

➢ Vendors reselling products that directly compete with products sold by Alberta producers are only allowed if the Alberta producers cannot meet customer demand.

Out-of-province products must be clearly labelled as to the province and country of their origin.

Vendor Selection decisions are made by a committee made up of Board Members, Vendors and the Market Manager.

Bookings for long weekends and The Regatta weekend are reserved for regular vendors and vendors who have attended 5 or more regular markets.

Table assignment is at the sole discretion of the Market Manager. Every attempt will be made to assign returning vendors to an area as close as possible to their table location in previous years. However table assignment will be decided based on market mix and space available on a per market basis.

Food Vendors must attach a copy of the following:

1. Alberta Food Safety and Handling Certification or the Alberta Farmers’ Market Home Study Course on food safety available through AHS. Proof of course completion must be displayed at the market and a copy of the certificate must be kept by the manager and accessible to Alberta Health.

2. Provide a copy of Certificate Liability Insurance which must be available by the vendor at each market and a copy kept by the market manager.

I have read the market rules provided to me with this application form and agree to follow all rules described therein as well as to make every effort to be in full compliance with all applicable federal and provincial legislation. Full-time and Group 1 and 2 vendors may pay the full amount of fees upon being approved or pay ½ of the fees at approval time and the remaining 1/2 by July 18th.

New, Part-time and Casual vendors may pay the full amount of fees upon being approved or pay ½ of the fees at approval time and the remaining 1/2 by July 18th.

Last minute vendor fees should etransfer their fees at time of approval and if you can’t etransfer then the fees must be paid prior to setting up on Market day.

Seba Beach Farmers’ Market Rules

The Seba Beach Farmers’ Market rules are concrete and enforceable. The rules address common issues and controversies that may arise in the day-to-day activities of the Seba Beach Farmers’ Market. The rules must be followed by all vendors and will be enforced by the Seba Beach Market Manager and Board of Directors.

As per Alberta Approved Farmers’ Market Program Guidelines the market rules are reviewed annually and updated as needed.

➢ Market rules are distributed to all returning vendors prior to the market season and to all new vendors prior to selling at the market.

➢ Market rules can not violate any portion of the Alberta Farmers’ Market guidelines or legislation.

The Seba Beach Farmers' Market supports the growing demand for environmentally sustainable practices by encouraging customers to bring their own shopping bags or by encouraging shoppers to use cloth bags.

The Seba Beach Farmers' Market runs under the guidelines established by the Alberta Agriculture and Food Regulations of the Public Health Act, and the Alberta Health Regulations and Standards of Cleanliness.

Vendors who have complaints concerning the market, its operation or rules shall put a complaint in writing and submit it by email or give it to the Market Manager or a Member of the Board of Directors. If it needs to dealt with immediately then talk to the Market Manager or a Member of the Board of Directors, but remember this is a very busy market and we only have two hours in which to sell our goods.

Vendors are asked to conduct themselves in a professional manner and to take responsibility for the stall you rent and area around it, to keep it clean and orderly, and to ensure that your area is cleaned and free of garbage at the end of each market.

No Smoking Rule – According to the Province of Alberta -Subject to section 5, no person shall smoke (a) in a public place, (b) in a workplace, (b.1) in a vehicle in which a minor is present, (c) in a public vehicle, or (d) within a prescribed distance from a doorway, window or air intake of a public place or workplace. A smoking area will be assigned for vendors and customers by the Seba Beach Seniors and we ask that you restrict smoking to the allotted area.

Failure to maintain your responsibilities or abide by the rules may result in, a Verbal Warning, a Written Warning or Seasonal Suspension.

SEBA BEACH FARMERS' MARKET RULES

1. Seba Beach Farmers’ Market is held each Saturday starting the 2nd Saturday in May (Mother’s Day) and ending the Saturday after the August long weeken, at the Seba Beach Senior Center running from 10:30 to 12:30 rain or shine.

Farmers Markets Vendors: All products sold must meet or exceed the Alberta Agriculture guidelines where 80% of the vendors are Albertans selling Alberta products which they, an immediate family member, a staff member of a producer owned cooperative or their staff have made, baked, grown or raised.

Commercial Venders: out-of-province vendors, resellers or vendors selling commercially available products which fall into the 20% category. Markets may choose to limit or prohibit out-of-province and out of country products. Vendors reselling products that directly compete with products sold by Alberta producers are only allowed if the Alberta producers cannot meet customer demand. Out-of-province/Country products must be clearly labelled as to their province/country of origin.

2. What may and may not be sold: (Alberta Approved Farmers Market Program Guidelines)

Markets must maintain an annual average vendor split of 80/20 where 80% of the vendors are Albertans selling Alberta products which they, an immediate family member, a staff member or a member of a producer-owned cooperative or their staff have made, baked or grown. The remaining 20% of the vendors can be made up of out-of-province vendors, resellers or vendors selling commercially available products.

o Discouraged products: Out of country products, franchises, distributorships and home-based businesses which vend products not made, baked or grown in Alberta.

o Prohibited vendor products (products not allowed at ANY time): Used, antique or flea market items, live animals, whether for sale or customer interaction, Uninspected meat or meat products for human AND/OR animal consumption, Raw milk or raw milk products for human AND/OR animal consumption with the exception of cheese made from unpasteurized milk that meets federal standards, Hatching eggs, E-cigarettes or vapor cigarettes

o Vendors selling Homemade Soaps and Cosmetics products must notify Health Canada about the homemade soaps and cosmetic by filling out the Cosmetic Notification Form prior to selling at the Seba Beach Farmers’ Market.

Seba Beach Village council has asked that we do not allow hot food vendors (hot dogs, hamburger, Taco in a bag etc.) at the Farmers Market. If you wish to sell hot food in Seba Beach please contact the Seba Beach Village office to find out what is required.

3. All products and vendors must comply with all regulations of the Alberta Agriculture, Alberta Health, and the Seba Beach Farmers' Market Rules.

4. Market fee payments for full time and half time table/stall rentals are due upon application approval and can paid by etransfer, or check. A vendor cannot setup at the market until the market fees are paid.

5. All NFS checks are subject to a fee of $40 and no future checks will be accepted and the vendor will not be allowed to attend the market until the NFS check and charges are paid.

6. If you are unable to attend a market (even if you have paid for the season) you must contact Market Manager (Shauna) 780-231-9215 by Wednesday prior to market giving the Market Manager a chance to re-assign the space. If proper cancellation notice is not provided it will be taken into consideration for future bookings. There are no refunds offered for cancellations. No future market booking are permitted to vendors who don’t show and have not given notice of cancellation or if a vendor is in violation and is asked to leave the market.

7. Vendors may not loan or give or sublease the table(s) or spot(s) assigned to them.

8. The Senior Center opens at 8:30 for setup and the vendors must be setup and ready to sell by 10:15. If you arrive after 10:00 you will not be allowed to setup as the parking lot (vendor tent area) will be closed to traffic. The market will be open to the public at 10:30, which will be announced by the market manager, at which point selling can begin. Vendors must remain setup until the market officially ends at 12:30.

9. Vendors can use the main parking lot to unload their goods and then move their vehicles to the allotted parking areas. Please be considerate of others that need to unload, unload quickly allowing for others to use the loading areas.

10. All products sold at the market must be listed on the application form and approved by the market manager. If you attempt to sell an item not preapproved you may be asked to remove the item from your table (space). Under-pricing is discouraged and if a complaint is brought forth the issue will be addressed by the Market Manager and the Board of Directors.

11. Table selection and assignment is at the sole discretion of the Market Manager. Every attempt will be made to create continuity and place vendors in the same space they had in the previous year and from week to week. However, assignments will be decided based on the market mix as well as other factors such as vendor attendance, customer traffic, special events etc.

12. Vendors using tents and/or canopies must ensure that all 4 corners are staked and sufficient weights are used to secure the structure. You are responsible for any damage done to those around you if your tent blows and/or canopy blows over.

13. Vendors are required to provide their own setups and table covers. Table covers must be 2 inches above the floor and not dragging on the flour. Table racks can’t exceed 3 feet in height.

14. All food vendors must complete the Alberta Food Safety Coarse or the Alberta Farmers Market Home Study Course and have a copy of the Certificate available at all time. A copy of the certificate must also be provided along with the Seba Beach Farmers' Market Application Form. Vendors must adhere to the Food and Drug Act, the Alberta Public Health Act and the labelling regulations as per the Canadian Food Inspection Agency. Guideline and information can be obtained by contacting the Alberta Health Services Public Health Authority at 403-341-2100.

15. All prepared foods must be wrapped and covered. Dairy Products such as whipping cream, cream or custard pies are not allowed unless accompanied by appropriate documentation from Alberta Health, which must be displayed each week.

16. All vendors must display their product names and prices, ensuring that all products meet minimum labelling requirements as laid out in legislation. Vendors must label all items for sale with contact information, list of ingredients and quantity (exempt are fresh fruit and vegetables items).

17. All eggs must be refrigerated as per Alberta Health regulations and labelled uninspected if applicable.

18. All samples must be covered and have toothpicks on them or be served by the vendor. Vendors giving samples must have rubber gloves, supply a disinfectant, paper towels and a garbage for disposal and must be located and easily visible to the customers.

19. Seba Beach Farmers’ Market reserves the right to inspect the premises of the operation to verify compliance with the market rules.

20. Seba Beach Farmers’ Markets secures market liability insurance of $5 million as recommended by the Government of Alberta Risk Management and Insurance. Food vendors must also secure sufficient liability insurance as the market liability insurance does not cover vendor liability.

21. Vendors are responsible for all damages and losses incurred at the market. If a vendor causes damages to another vendors property or products, the Senior Center or part of the grounds they are responsible for the all costs and repairs.

22. Vendors should be neat and clean in appearance, and must conduct themselves in a professional manner at all times. Any complaints received concerning unprofessional conduct, including the use of profane language, smoking, cleanliness of the vendor or vendors’ product, etc., may be considered grounds for dismissal from the market. Insubordination, the consumption of alcohol or drugs, and fighting during the market will be cause for immediate dismissal. No warnings are required nor are refunds given.” [pic]
