TO AMEND SECTION 1-11-730, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PERSONS ELIGIBLE TO PARTICIPATE IN THE STATE HEALTH AND DENTAL INSURANCE PLANS AND THE COST OF PARTICIPATION IN THESE PLANS, SO AS TO PROVIDE FOR STATE-PAID PREMIUMS FOR PLAN PARTICIPANTS UPON APPROVAL FOR DISABILITY RETIREMENT UNDER THE SOUTH CAROLINA RETIREMENT SYSTEM OR THE SOUTH CAROLINA POLICE OFFICERS RETIREMENT SYSTEM IF THE DETERMINATION OF DISABILITY IS THE RESULT OF AN INJURY ARISING OUT OF AND IN THE COURSE OF THE PERFORMANCE OF OFFICIAL DUTIES DURING STATE-COVERED ENTITY SERVICE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 1-11-730 of the 1976 Code, as last amended by Act 387 of 2000, is further amended by adding an appropriately lettered subsection at the end to read:

“( ) A person covered by the plans pursuant to state-covered entity service who is approved for disability retirement under Section 9-1-1540 or Section 9-11-80 is eligible to participate in the plans with state-paid premiums, regardless of length of service, if the disability is the result of an injury arising out of and in the course of the performance of the person’s official duties during his state-covered entity service.”

SECTION 2. This act takes effect upon approval by the Governor and applies for eligible persons approved for disability retirement after May 29, 2002.
