1. What does the law say about student records: Access Vs Rights? Who is allowed to view and/or to have access?

2. How long is the school/district legally required to hold on to a student's records?

3. What do I do if I am told "no records exist" for the student when I know the youth attended that school?

4. What if records have errors or missing information?

Privacy Rights Act: FERPA

Four Basic Rights given regarding student records:

1. Right to access and to release records to others

2. Right to challenge the content of records under the following conditions (34 CFR ? 99.31)

3. Right to disclose records without consent to certain parties

4. Right to personal inspection of a record

There are new exceptions: added after the FERPA Law was begun. USA amends FERPA and is an exception to FERPA

2 Amendments to FERPA

The Uninterrupted Scholars Act (USA) amended FERPA in 2013, allowing access by

Social workers, probation officers, and other representatives of State or local child welfare Agencies

SB233 2017- further amended and clarified access for:

Caregivers, group home staff, foster parents with an "educational interest" and a legal responsibility for the care and education of the youth.
