GENERAL INFORMATION FOR RETAIL GASOLINE DEALERS FROM VARIOUS WEIGHTS & MEASURES LAWS, RULES AND REGULATIONS:

182/183 NOTIFICATION OF USE/SEALING OF APPROVED DEVICES:

1) No person or business shall use any new, used or repaired measuring device or related accessory without first notifying the Dept. of Weights & Measures (585-753-7933).

2) Device must operate as designed and start at zero.

3) When all requirements are met an inspection seal is applied to the face of dispenser and a security seal is applied to the calibration access area. Audit trails are recorded and monitored.

4) All users of commercial use devices must permit the inspection and testing of such devices by the Weights & Measures official and provide assistance with the inspection when requested. If necessary the Weights & Measures official may stop any vendor or dealer till proper inspection and test(s) are completed.

5) Repair of false devices – Must be done in a timely manner, and then called in for a retest.

6) “RED TAGGED” pumps are issued a” STOP USE ORDER”. Prohibiting any use. Permission to cut “red tag” must be received from Monroe County Weights and Measures prior to starting repair(s), and then reapplied by Repair Company till retest is completed by Weights & Measures. Only upon certification by Weights & Measures will the” Stop Use Order” will be lifted.

7) Only a Weights & Measures official may remove the official inspection seal(s).

192.1 – Each meter in the dispenser must have a current W & M inspection seal when in use. A security seal must be in place and intact on each meter calibrator. If service is to be done to the pump, W & M must be notified, permission to break security seal received, repair completed, replacement security seal applied by Repair Company then W & M notified pump ready for retest.

192.5 - Price Signs must be posted on each side of the dispenser and reflect the accurate price which is set in the console and in the meter. Cash, credit and/or debit prices must be clearly posted and easily read.

S.1.6.4.1 (a) - Price per gallon (unit price) must be displayed on the dispenser readout.

S.1.6.5.5 – Total price and quantity must be clearly displayed on the readout.

All totals must be in agreement with unit price.

192.6 – A working air pump capable of inflating automobile tires is required at all stations that have 4 or more gas dispensing meters. The air must be available during all open hours of operation.

220.3 – W & M inspection fee must be paid within 30 days or be subject to a civil penalty.

224.4 – No delivery of product permitted into a storage tank that exceeds 2 inches of water.

224.6 – All retail petroleum sales must be from a price computing device.

224.7 – Retailer must maintain daily records and keep on premises for six months. Retailer must maintain these records for five years and be accessible to Weights & Measure. Records must be kept current.

They must include:

1) Inventory on hand – (daily tank readings, all tanks or battery of tanks)

2) Deliveries – (printed delivery tickets from point of origin)

3) Daily sales or other use

4) Daily losses or gains (deliveries)

5) Bottom water level readings – Daily for each storage tank – Must mark zero (0) if no water

224.8 – Gasoline/alcohol blends (ethanol) must have a sign on each side of dispenser (upper part) stating percentage of alcohol within the blend (Contains 10% ethanol).

Before ethanol blend can be delivered for the first time all water and precipitated materials must be removed from storage tanks.

224.9, 224.10 – Octane (gasoline) rating and cetane (diesel) rating must be posted on all pumps. The ratings must be certified for the rating being sold.

224.13 – Grade of diesel must be labeled 1-D, 2-D or 2-D enhanced.

Kerosene must be identified as 1-K or 2-K.

224.14 – Fill ports to the storage tanks must be color coded to the American Petroleum Institute Standards.

A border must be painted around ethanol containing storage tanks.

Hexagon shape required around E-85 storage tank fills port that must be bronze in color.

ALL PUMPS MUST BE CALIBRATED AS CLOSE TO ZERO AS POSSIBLE. ALL PUMPS SET IN THE OPERATORS FAVOR WILL BE PUT OUT OF SERVICE AND FINED FOR DELIVERING “SHORT VOLUME”.
