I believe the arrest and incarnation of Mrs. Kim Davis was a historic event that may well mark the beginning of open Christian persecution in what was once the land of the free.

The problem is that government officials are using judicial tyranny to deny Christians their God-given, 1st Amendment right to exercise their religion, i.e. their faith.

First we’ll take a look at some relevant facts:

“In a free society, people do not require constitutional authority to act, Government does.”

This means that before anyone in government can act, there must be a Constitutional law that authorizes their action. Any action taken that is not based on law is called TYRANNY.

So under what law was clerk Kim Davis arrested and put in jail for Thursday?

Show me the law! What specific law did Mrs. Davis violate?

Where is the law?????

What law mandates Mrs. Davis to issue a marriage license to people of the same sex?

THERE IS NO SUCH LAW!

TEST IT TO SEE:

1. Is any “so-called” law Constitutional?

First of all:

Is it in agreement with your state’s Constitution?

Most people don’t know that their own state Constitution trumps any federal law. The only exception is federally-owned ports, docks, magazines, federal buildings, etc.

2. Does it agree with or violate the organic Constitution “for” “these” United States?

3. Was it properly ratified and enacted by Congress who makes laws?

4. Is it, moral, righteous, right and truthful?

5. Does it go against biblical precepts or your conscience?

The Kentucky governor, district attorney, judges, and lawyers are acting as if the recent Supreme Court decision on same-sex marriage gives them authority to enforce it as if it were law. They are clandestinely trying to teach us that what the Supreme Court says is the law of the land. WRONG!

Just think about that. It would put 9 people in total control of all of us and over everything if it were so.

Supreme Court “decisions” ARE NOT LAW!

Neither Judges nor Justices can lawfully make a law! No court decisions are law! They are binding only to those who are parties to a case and concern only the particulars of that case. Judges and Justices who reject this fact are operating outside the law which makes them OUTLAWS. [Actually, Kim Davis was the one keeping the law and those who jailed her were breaking it.]

“In the ordinary use of language, it will hardly be contended that the decisions of Courts constitute laws. They are, at most, only evidence of what the laws are; AND NOT OF THEM-SELVES LAWS, Swift v. Tyson [16 Peter 1, 18 (1842)].”

Justice Story stated this when speaking for the unanimous SCOTUS.

Can a policy, rule, or law be made that will turn a Supreme Court decision into a law?

NO! Not without a Constitutional Amendment.

Article 1, Section 1:

All legislative powers herein shall be vested in the Congress of the United States…

“Where rights secured by the Constitution are involved, there can be no rule making or legislation which would abrogate them.”

Miranda vs. Arizona, 384 US 436, 491 (1966).

But how can government officials still act when there is no law to support their actions. They use their title of authority to validate their unjust and unconstitutional edicts.

It is not holding title of authority that makes authority legitimate or lawful. What makes it lawful is how it is administered. A tyrant’s authority may be undeniable, but it is never legitimate when he uses it apart from the law, usually to oppress people. The law keeps us free. When we permit tyrants to break it, we are oppressed.

So if a government official cannot Show Us the Law, we do not have to obey their edicts.

And if they have find a law that seems to support their action but the law is unjust, we do not have to obey it!

Any “law” that is immoral, unjust, or unconstitutional is NOT LAW and is therefore null and void.

All laws that are repugnant to the Constitution are null and void.

SCOTUS 1803 Marbury vs. Madison

An unconstitutional act is not law; it confers no rights, imposes no duties, affords no protection, it creates no office, it is in legal contemplation as inoperative as if it had never been passed.

Norton vs. Shelby County,118 US 425, p.442

No one is bound to obey an unconstitutional law and no court is bound to enforce it.

Mrs. Kim Davis was arrested and put in jail for exercising her 1st Amendment, God-given right to exercise her religion. Was that lawful? NO! She made the statement that she obeyed God rather than man and was being persecuted for it.

“The claim and exercise of a constitutional right cannot be converted into a crime.”

Miller vs. U.S., 230 F. Supp. 486, 489 (1956)]

“There can be no sanction or penalty imposed upon one because of his exercise of constitutional rights.”

“Mrs. Davis’s decision brought down the wrath of militant LGBT activists and their supporters. ‘They told my husband they were going to burn us down while we slept in our home’, she said. ‘He’s been told that he would be beaten up and tied up and made to watch them rape me. “The mainstream media and the activists have been ruthless. They’ve portrayed her as a monster – a right-wing, homophobic hypocrite. She’s been smeared by tabloid-style reports on her checkered past. They’ve written extensively about her failed marriages.

“’I’m just a vessel God has chosen for this time and this place’, she said. ‘I’m no different than any other Christian. It was my appointed time to stand, and their time will come.’”

Christians are posting on their Facebook pages, “Kim Davis should either be fired, impeached, or resign because of her religious convictions.” They believe she is doing something wrong. Kim Davis is standing on the authority of Scripture by declaring that marriage can never be part of a same-sex relationship while her greatest attackers are “Christians” who are siding with their pagan neighbors.

I am disgusted by the cowardly pastors who stand on the sidelines while this brave, recently-converted Christian, Kim Davis, calls this issue a “life and death, heaven and hell” matter to her. These same doctrinal dolts are the ones who teach that Romans 13 commands absolute obedience to the Devil and his law-breaking acolytes who double as elected officials.

Kim Davis is obeying God rather than man, and many Christians have turned against her as if her theology or marriage history was the issue. As we’ll soon see, neither of those nor is accepting gay marriage the issue. What is the REAL ISSUE? Show us the law!

I’m upset that so many Christians aren’t upset! Those of us who are willing to fight the good fight against unlawful edicts are chastised and criticized and marginalized by those who should be joining us. Let’s review the story about David and Eliab in 1 Sam. 17:28-29. Eliab was angry, judgmental, and pompous in attacking David because he exposed Eliab’s lack of faith in the Lord and cowardice for not standing up to Goliath. David was humbly and boldly fighting for truth and righteousness in all he said and did.

I’m upset that most pastors won’t even mention the Satanic, historic, unlawful attacks being freely and viciously slammed against believers here in our own country. Pastors and congregations should be railing against such lawlessness. However, many pastors seem more concerned about jealously protecting their precious pulpits, large church numbers, and wallets than they are about protecting their flocks. Other pastors are afraid to get involved because they could be persecuted as well. And most of them are ignorant about what is lawful and what is unlawful, thus their flocks are just as blind to such biblical truths.

Judicial supremacy is destroying our Republic. Most Christians neither understand nor follow the laws of God. That is why it’s no big deal to them when our government ignores The Constitution and demands that we follow their immoral and unconstitutional “laws”.

People need to know that the words “legal” and “lawful’ are not the same.

Something that is “unlawful” can be called “legal”, and doing so makes people think that it is “lawful.”

But calling it “legal” neither means nor makes it “lawful.”

LEGAL: “(4) Posited by the courts as inference or imputation of the law, as a matter of construction, rather than established by actual law, e.g. ‘legal malice’.”

Black’s Law Dictionary, Fifth Edition

Example: The front side of your money says, “This note is legal tender for all debts public and private.” It is legal but it is not lawful because the Constitution designates only silver and gold coinage as being lawful.

Section 10:

“No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts …”

Many so-called “laws” are unconstitutional and unjust, yet they are still considered to be “legal” by those in government, court judges, lawyers and media when in fact, they should be treated as null and void:

Something LAWFUL is in harmony with Natural Law which is God’s law, however, something LEGAL can be contrary to it.

Any law, code, rule, regulation or statute that goes beyond The Constitution or is contrary to it, is counterfeit, illegitimate, unlawful, and therefore requires no respect or submission.

“An unconstitutional act is not law; it confers no rights, imposes no duties; affords no protection; it creates no office; it is in legal contemplation as inoperative as though it had never been passed.”

So the next time that someone tells you, “It’s the law so you have to obey it, even though it’s not right”, you can say, “Then it can’t possibly be a law so why obey it?”

“Federal Judge David Bunning… decreed that Mrs. Davis was in contempt of Court and ordered her jailed until, like Cool Hand Luke, she got her mind right and bowed to his un-Constitutional edict.

While some may allege that what this judge did was legal, it was certainly not lawful, constitutional, nor just. Even so, some Christians claim that this woman who broke no law and stood firm for her faith and for righteousness was wrong for doing so.

CASE LAW: This is an oxymoron which means that contradictory terms are used in conjunction.

For example, “living death”. Decisions made by judges in court cases are not law. They are decisions that only pertain to the parties of the case and the particular facts of that case. Lawyers and judges have been unconstitutionally using them as a precedent by which to judge cases rather than The Constitution.

THIS IS WRONG! They should be judging each case primarily by the Federal or State Constitutions, otherwise they continually perpetuate unconstitutional, immoral, or unjust decisions made in the past.

Decisions made by judges in a court case are not laws!

Lawyers and judges are not law-makers.

IS IT TOO LATE?

1. It appears that less than one percent of U. S. Christians are executing the spiritual life. Most are distracted either by legalism or emotion. Even here in Chiangmai, Thailand, I have not found one American who understands the spiritual life nor desires to learn it. For example, about five months ago, I heard about a group of mostly American Christians who had lost their pastor, a location not far from me. So, I offered to teach them while they waited for a pastor. I was strongly rejected and almost spat on.

2. Not only are many in our government anti-Semitic, but many Americans outside of government as well and the number is growing.

Some insist that it’s too late to even try to turn things around.

Some say we have sunken so far into degeneracy and the forces of darkness are so overwhelm-mingly powerful that it is impossible to save our beloved country.

Many people ask:

Since the outcome is inevitable, why stick our necks out when they could be chopped off?

Isn’t it the smart move to play it safe and not get involved or draw attention to ourselves?

Just go along to get along?

The problem with taking advice like this or this thinking is that it leaves God out of the picture.

He and only He can save our country. Furthermore, taking this cowardly attitude would require us to disobey and dishonor God’s absolutes. He commands us to stand firm for truth, justice and righteousness even if it is dangerous to do so.

The Bible is the Magna Charta of human freedom. Its laws are absolutes, they do not change, and they are simple, clear and protect us like no man or group of leaders can.

Anything contrary to the Bible is like jello. It is relative, changeable, and depends on man who is fallible and who changes his mind upon every whim, so there can never be freedom or justice apart from the absolute Word of God with which our Constitution is in total agreement.

2 Thessalonians 2:15 …stand firm and hold to the traditions which you were taught…

Ephesians 6:13 Therefore, take up the full armor of God, so that you will be able to resist in the evil day, and having done everything, to stand firm.

1 Corinthians 16:13 Be on the alert, stand firm in the faith, act like men, be strong.

Can we obey this verse while remaining silent or by standing idly by as our Christian brothers and sisters and even our own families are being abused, spied on, treated like criminals, fined, bullied, and imprisoned?

Will we rally behind them, print up and pass out leaflets, meet in football stadiums like they did in Kentucky in an effort to stop the enFORCEment of unconstitutional edicts?

We are to do all things as unto the Lord, so can we do that by going along with evil, immorality and tyranny like some pastors are encouraging their congregations to do?

We are to follow and imitate the Lord Jesus Christ, the Light of the World. How can we do that if we are complying and compromising with darkness?

It’s true that standing for justice and freedom may cause us to suffer or even die, but that sacrifice is never in vain, even if justice and freedom are not secured.

We are responsible for doing what is right, just and moral! God is responsible for the results.

PATRICK HENRY, March 23, 1775:

The root problem for all our ills as well as the solution are spiritual:

Psalm 33:16-22 The king is not saved by a mighty army; a warrior is not delivered by great strength. 17) A horse is a false hope for victory; nor does it deliver anyone by its great strength. 18) Behold, the eye of the LORD is on those who fear Him, on those who hope for His lovingkindness, 19) to deliver their soul from death and to keep them alive in famine. 20) Our soul waits for the LORD; He is our help and our shield. 21) For our heart rejoices in Him, because we trust in His holy name. 22) Let Your lovingkindness, O LORD, be upon us, according as we have hoped in You.

Psalm 44:6-8 For I will not trust in my bow, nor will my sword save me. 7) But You have saved us from our adversaries, and You have put to shame those who hate us. 8) In God we have boasted all day long, and we will give thanks to Your name forever. Selah.

Psalm 46:1 God is our refuge and strength, a very present help in trouble.

Psalm 62:5-8 My soul, wait in silence for God only, for my hope is from Him. 6) He only is my rock and my salvation, my stronghold; I shall not be shaken. 7) On God my salvation and my glory rest; the rock of my strength, my refuge is in God. 8) Trust in Him at all times, O people; pour out your heart before Him; God is a refuge for us. Selah.

Psalm 145:18-19 The LORD is near to all who call upon Him, to all who call upon Him in truth. 19) He will fulfill the desire of those who fear Him; He will also hear their cry and will save them.

So what is the answer to the question,

“WILL AMERICA SURVIVE?”

The only way America will not only survive but regain her greatness is the way nations throughout history have done it. They humbled themselves before the Lord and forsook their wicked ways.

Nations don’t get any worse than Nineveh, but when the Ninevites believed the word of the Lord, changed their mind about their sinful lifestyle and turned to Him, they survived.

Whether the Lord spares our beloved country or not, our course remains the same. We will obey Him, serve Him, and stand for truth, justice, and freedom through His strength. By means of His grace and by His power, we will honor Him and do what is right and what is good until He comes or takes us home.

How do we substantiate an authority as legitimate in areas such as teachers over students, officers over enlisted men, etc., that is, those not specially designated in Scripture?

Officers in the military have a code of conduct and procedures to follow and so do teachers. But more importantly, they have a biblical code of conduct that comes from God which they are required to follow.

You don’t have to be a believer for His code to apply because it applies to every person in every place. It is known as Natural Law or God’s Natural Law.
