Chapter 5: Human Rights Case Scenario’s

HELP!!! Are these examples of human rights violations? Recall your definition of human rights and the prohibited areas of discrimination, and then examine each of the following letters to determine whether or not they apply to a Human Rights Code violation, or a Charter of Rights violation.

1. If a human rights matter…first establish if it is a Canadian Human Rights issue, or a Provincial Human Rights Code violation. Then, use your textbook pages 115-118 to show the process for:

i. Filing a complaint (using proper terminology),

ii. The role of the Human Rights Commission in dealing with the complaint, and

iii. A likely Remedy that might result from your complaint.

2. If it is not a Human Rights violation…explain what the victim might do instead to remedy the situation.

Case Scenarios:

To whom it may concern,

Last night I was driving home from a late night basketball game and I was pulled over by the police. The officer told me I had to go to the police station with him, but he wouldn’t tell me why. I didn’t get to call anyone – they just held me in a cell overnight and then let me go this morning without an explanation. I had to take a cab to the place where my car had been towed to and pay to get it out of impound. I don’t think this is right. I’m not sure, but I think the police did something wrong here – did they? Can you help me? Please tell me what I should do now, and what the outcome might be.

Sincerely,

To whom it may concern,

I am 17 years old and have decided to move out of my parent’s house and into my own apartment. I have enough money for first and last month’s rent, and I have a job at Tim Horton’s that pays me $700 per month. I went to look at an apartment the other day. The rent on it was $200 per month. The landlord told me that it had just been rented that morning. When I drove by today though, there is still a ‘For Rent’ sign in the window, and no one appears to be living there. I don’t think this is right. I’m not sure, but I think the landlord did something wrong here – did they? Can you help me? Please tell me what I should do now, and what the outcome might be.

Sincerely,

Young and Outta Luck
