STATE BOARD OF EXAMINERS MINUTES – July 21, 2020 – 8:55 a.m.State Capitol, Lincoln Auditorium WW02700 W Jefferson St., Boise, Idaho The regular meeting of the State Board of Examiners was called to order pursuant to Idaho Code §67-2002 and by the order of the chair 9:03 a.m.The following board members were present: Governor Brad Little, Attorney General Lawrence Wasden, Secretary of State Lawerence Denney and State Controller Brandon Woolf. Also presenter were Alex Adam, Division of Financial Management; Sherri Ybarra, Superintendent of Public Instruction and Debbie Critchfield, Chairman of State Board of Education.State Controller Woolf introduced the consent agenda items. Attorney General Wasden then moved to approve the consent agenda. Secretary Denney seconded the motion. The motion passed on a unanimous voice vote.State Controller Woolf introduced the regular agenda item. Discussion: Mr. Adams stated that the budget situation has changed since it was set back in March. The most recent revenue forecast shows a revenue shortfall of 350 – 590 million. He stated that the Governor has asked each state agency to do a 5% general fund holdback. Mr. Adams stated that this was a consensus plan that was worked on by Division of Financial Management, Office of the Governor, Superintendent of Public Instruction and the Idaho State Board of Education, and other stakeholders across the state. They carefully considered the impact to the students and personnel. Mr. Adams stated that they are being very mindful of using federal funds to backfill where they can. To date they have leverages 91 million of federal funds to partially offset these cuts. They have plans to take out additional federal funds at the end of the week. Mr. Adams also noted that they are purposing 2 amendments. The amendments do not change the amounts. The original request strikes what was shown in 33-1004 and 33-1005. Out of abundance of transparency they wanted to set clear expectations on what the governor was going to be looking at during the next legislative session.General Wasden asked Mr. Adams what investigation he has taken to arrive at these totals. Mr. Adams responded that they have done a couple things. First they have determined that the revenue will be short the amount of appropriations that have been set by the legislature, which they are forecasting that state will fall between 8.6% and 14.4% short of its general fund revenue forecast for the coming year, on which the budget was based. He also stated that it translates to a $350 million to $595 million budget shortfall. Mr. Adams continued that the holdback of 5% from all agencies will cut about $200 million from the state budget, which will mean they still have a budget shortfall. However, they are proposing to use rainy-day funds as well as federal funds to close that gap. Mr. Adams then stated that coming to this proposal was a collaborative effort. They worked closely with Sherri Ybarra and Education Stakeholders. This is a consensus plan to minimize impact on the students. The Governor sent out a letter to school districts on May 8th outlining this plan. General Wasden then asked if the materials provided was the report that is required by statute. Mr. Adams responded yes. Secretary Denney then asked if removing the two sections if that would remove the possibilities for an automatic property tax increase. Mr. Adams responded that they are trying to constitutional balance the budget as required as well as make sure these cuts are not simply transferred to the Public Education Stabilization fund. This action would make sure that they don’t have to use the Public Education Stabilization fund. Those items that are statutorily required will still take legislative action to complete. The Division of Financial Management does intend to bring legislation during the next legislative session. General Wasden then asked if he could hear from Chairman Critchfield as well as Sherri Ybarra on whether they consent to this reduction. Ms. Critchfield then stated that the board had a conversation about that and they discussed the implications, and why they thought the plan moving forward was appropriate considering the conditions, and that they do consent. Superintendent Ybarra stated that she does support this and she noted that a lot of work went into the plan, and that she does consent to the changes and the direction that they are going.Attorney General Wasden then moved to approve the regular agenda with. Secretary Denney seconded the motion. The motion passed on a unanimous voice vote.State Controller Woolf introduced the informational agenda items.Attorney General Wasden moved to adjourn the meeting. Idaho Association of Public Health District Directors Distribution of the State Appropriation for Fiscal Year 2021. State general fund and millennium fund appropriations to the Public Health Fund has been distributed by the formula developed by the Board of Trustees pursuant to Idaho Code §39-425. 7. Office of the Attorney General Notification that Deputy Attorney General Edith Pacillo is permitted to accept additional outside employment at the University of Idaho College of Law in Boise (University) in an educational program conducted under the supervision of the State Board of Education. Ms. Pacillo will serve as a faculty member, teaching a lawyering process course during the coming 12 months. Notification that Anthony Valdez of the firm of Valdez Law Office, PLLC has been appointed pursuant to Idaho Code §67-1409 as a Special Deputy Attorney General for the purpose of representing the State of Idaho, Industrial Special Indemnity Fund in the matter of Austin Tanner, IC# 2015-030649; ISIF# 2020-2407. Notification that Tyler H.
