This case arises from an employment agreement between the parties, Allen G. Nettleton and Canyon Outdoor Media, LLC, and specifically raises issues regarding Nettleton's entitlement to compensation following his resignation. Nettleton sued Canyon Outdoor Media under the Idaho Wage Claim Act and for a breach of contract after his demand for payment of commission wages was rejected. Following discovery, the district court granted summary judgment in favor of Nettleton and awarded him damages for commission wages on client contracts that he procured prior to his resignation. This decision rested in the district court's finding that the employment agreement did not contain a requirement for Nettleton to service accounts in order to receive his commission wages. In turn, the district court also denied Canyon Outdoor Media's motion for summary judgment, and thereafter denied Canyon Outdoor Media's motion for reconsideration of the decisions on summary judgment. The district court awarded attorney's fees and costs to Nettleton. Canyon Outdoor Media now appeals the district court's rulings on the three motions and the award of attorney's fees and costs.
