TERMS AND CONDITIONS

1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents. Entrants under the age of 18 must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

4. Promotion commences 5:30am AEDST on 03/12/18 and closes 11:59pm AEDST on 07/12/18 (“Promotional Period”).

5. To enter, eligible entrants must, during the Promotional Period, visit .au, locate the promotional entry form, complete all requested details including full name, contact number, a valid and current email address, postcode, and an answer to the question “Tell us in 25 words or less why you or someone you know deserves to win a cruise?”, and submit the completed form.

6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

7. Incomplete or indecipherable entries will be deemed invalid.

8. Only one (1) entry permitted per person.

9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

10. The judging will take place at 24 Artarmon Road, Willoughby NSW 2068 on 10/12/18 at 10:00am AEDST. The judges may select additional reserve entries that they determine to be the next best, and record them in order of merit, in case of an invalid entry or ineligible entrant. The winners will be notified by telephone and email.

11. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit of the answer to the promotional question provided by each entrant.

12. The Promoter’s decision is final and no correspondence will be entered into.

13. The best five (5) valid entries, as determined by the judges, will each win an Ovation of the Seas family cruise for four (4) people (including at least one person aged 18 or over) to New Zealand. Each entrant will be awarded a different cruise as follows:

a) First prize: 9 nights departing Sydney, NSW on 20/10/19 valued at up to AU$8,716.00 depending on point of departure.

b) Second prize: 12 nights departing Sydney, NSW on 29/10/19 valued at up to AU$11,116.00 depending on point of departure.

c) Third prize: 10 nights departing Sydney, NSW on 13/11/19 valued at up to AU$9,476.00 depending on point of departure.

d) Fourth prize: 11 nights departing Sydney, NSW on 23/11/19 valued at up to AU$10,236.00 depending on point of departure.

e) Fifth prize: 12 nights departing Sydney, NSW on 04/12/19 valued at up to AU$11,236.00 depending on point of departure.

14. Each prize value is based on the quad share Oceanview Stateroom grade cabin and any upgrades are unavailable. Prizes are not transferrable to any other ship, cruise or date than that which is specified above. Each prize includes:

• Four (4) economy class return airfares from winner’s nearest capital city to Sydney, NSW (if required);

• Return group transfers from Sydney Airport to Overseas Passenger Terminal (if required);

• Complimentary onboard experiences and activities which may include (subject to availability, age, height and weight restrictions and terms & conditions) FlowRider® surf simulator, RipCord® by iFLY®, North Star®, SeaPlex® including bumper cars and roller-skating, rock-climbing wall, sports court, adults-only solarium, fitness centre, poolside movies, Splashaway Bay℠ kids’ water park, Theatre entertainment, award-winning Adventure Ocean® Youth Programme (kids club); and

• Complimentary food and beverage venues (breakfast, lunch and dinner plus snacks, a la cart dining, pizza and soft serve ice cream). Venues include Windjammer Café, Sorrento’s Pizza, SeaPlex® Dog House, Main Dining Room, Café@Two70, Café Promenade. Fees apply for specialty dining and beverage packages.

15. The winner and their travelling companions are responsible for all other expenses not listed above including but not limited to: any other travel or onboard costs/expenditure, pre or post cruise accommodation, spending money, meals (other than those specified), drinks (other than those specified), mini-bar, incidentals, laundry, room service, phone calls, gratuities, optional activities and excursions, freight, excess baggage, ground transport, taxes (excluding departure and any other flights associated taxes included within the prize), energy surcharges, service charges, passports, visas, travel insurance, and all transfers, including travel costs to and from their closest capital city airport if the winner is from a regional area. The winner is responsible for ensuring that they and their travelling companion are fit to travel and have received appropriate immunisations and/or health checks prior to taking the prize.

16. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas which meet the requirements of immigration and other government authorities at the destinations. Any fines, penalties, payments of expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller.

17. All prize travel will be subject to the carrier’s General Conditions of Carriage. The Prize Supplier and carrier make no representations as to the safety, conditions or other issues that may exist at any destination. By entering this Competition, and by collecting the Prize, the Winner acknowledges and accepts that driving, travel and any other activities comprising the Prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses.

18. The Prize Supplier strongly recommends that all Winners take out travel insurance and consult the .au website prior to travelling.

19. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

20. Prizes cannot be transferred, exchanged or redeemed for cash.

21. Each winner and their companions must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Each winner may be required to present their credit card at time of accommodation check in.

22. If a winner is under the age of 18 they must be accompanied by a parent/guardian at all times during the prize. Any prize won by a winner aged under 18 will be awarded to the winner’s parent/guardian on their behalf.

23. If for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

24. Where relevant, it is the winners’ and their travel companions’ personal responsibility to ensure that they have valid travel and health documentation. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Winner and their travel companions. The Promoter and the Prize Provider makes no representation as to the safety, conditions or other issues that may exist at any destination.

25. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

26. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

27. Total prize pool value (cruise only) is up to AU$50,780.00. Unless otherwise expressly stated, prize values are based on the recommended retail prices as at 27 November 2018 (inclusive of GST). Prizes, or any unused portion, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

28. It is a condition of accepting a Prize that the Winner and their travel companions must comply with all the Conditions of use of the Prize and the Prize Provider’s requirements (as applicable). Without limitation, Winners and their travel companions will be subject to the booking Terms and Conditions and privacy policy as set out at: .au. It is the responsibility of the Winner to confirm such Conditions and policy with the Prize Provider or other relevant third parties.

29. The cruise prizes are a single event trip for the Winner and their travel companions and cannot be separated into separate trips or components. Winners and their companions must travel together.

30. It is a condition of accepting a cruise Prize that the Winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.

31. The return economy flights must be utilised at the same time, for the same travel dates, to and from the same destination. Flight itinerary may have to be adjusted depending on the airline’s departure city and their current flight schedule. All travel is subject to availability at all times. The Winner and their travel companions are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed.

32. Travel suppliers / airlines and booking time of flights to be chosen at Prize Provider’s discretion. Blackout periods may apply. Frequent flyer points are not available from any airline.

33. The return transfers are determined by the Prize Provider and must be utilised at the same time, for the same travel dates, to and from Sydney Domestic Airport and the Overseas Passenger Terminal. All travel is subject to availability at all times. The Winner and their travel companions are responsible for any amendment fees issued by suppliers once booking is confirmed and ticketed.

34. Where relevant, it is the responsibility of the Winners and their travel companions to ensure they are checked in for their flights and arrive at the airport on the correct date and at the time specified by the relevant airline carrier. The Promoter and the Prize Provider are not responsible for any costs associated with Winners and / or their travel companions missing any of their flights or cruise.

35. The Prize must be taken as offered and is subject to booking and availability. The Prize, or any unused portion of a Prize, is not transferable, exchangeable and cannot be refunded for or redeemed as cash. Prize is not valid in conjunction with any other offer.

36. As a condition of accepting a Prize, Winners and their travel companions:

a) Consent to the Promoter and its related entities using (if any of these parties elect to use) the name, image, likeness and / or voice of each of the Winner and / or their travel companions in any manner and in any media worldwide for an unlimited period of time without remuneration, reference or further notification to the Winners or their travel companions, for the purpose of promoting the Competition (including any outcome); and

b) agree to participate in and co-operate with all reasonable media or editorial requests of the Promoter and its related entities including but not limited to being individually or jointly interviewed, photographed and filmed, and acknowledge that the Promoter, its related entities and any other entities determined by the Promoter in its absolute discretion, may use such interviews, footage and photographs in any media worldwide for an unlimited period of time without remuneration to anyone, reference or further notification to the Winners or their travel companions. The inclusion of any such interviews, footage or photographs (including but not limited to creative control of the feature) will remain with the Promoter, its related entities and / or any other entities determined by the Promoter in its absolute discretion at all times.

37. The Winner acknowledges and accepts that activities that form part of the Prize are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. Some onboard activities attract age, weight and height restrictions that may prevent some Winners from participating.

38. The Promoter and its Prize Provider are not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may take place. The Winner must make his or her own enquiries about local issues and conditions at destinations prior to travel.

39. In the event that a Prize, or part of a Prize, is unavailable (for any reason beyond the Prize Provider’s reasonable control), the Prize Provider reserves the right to substitute the Prize or part of the Prize in its discretion with an alternative Prize or part of the Prize to the same and equal or greater recommended retail value and / or specification, subject to any written directions from the various lottery departments.

40. Each entrant warrants that their entry is an original literary work of the entrant that does not infringe the rights of any third party. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.

41. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

42. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

43. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

44. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

45. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) if any cruise is delayed, postponed, or cancelled for any reason beyond the reasonable control of the Promoter; or (g) use of a prize.

46. Entrants' personal information will be collected by the Promoter. Personal information will be stored on the Promoter's database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at . The Promoter's privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation.
