I. CALL TO ORDER AND ESTABLISHMENT OF QUORUM

Mr. Viehweg called the meeting to order at 9:17 a.m. in Room W064 of the Indiana Government Center South, 402 West Washington Street, Indianapolis, Indiana, and declared a quorum in accordance with Indiana Code § 15-5-1.1-6(c).

Adoption of the minutes from the January 22, 2018, March 12, 2018, and May 14, 2018 meetings of the Board is tabled until July 23, 2018.

Re: IUPUC Proposed Curriculum Updates

Dr. Carr appeared before the Board with Dr. Scifres to discuss the IUPUC curriculum to better cover dual licensure for mental health counseling and addiction counseling. The Board recommended they do not drop G598 Seminar in Professional Issues, as it covers Contextual Dimensions of Counseling and Foundations of Mental Health Counseling which are two course content areas that will still need to be covered. It was pointed out that G598 is an elective course. The Board asked if these two areas were covered in different classes. The addiction section of the board suggested they add a course description for psychopharmacology instead of only describing it in the course syllabi.

Mr. Cambridge appeared before the Board, as requested, regarding his ongoing probationary status. Mr. Cambridge stated that there have been no changes since his last appearance. Mr. Cambridge reported that he has learned a great deal about boundary issues and social media since being placed on probation. He stated he is more careful now because he knows social media is convenient, but can also be dangerous. The Board advised Mr. Cambridge that once he completes all of his requirements for probation, he could petition for withdrawal of probation. Mr. Cambridge is lacking a supervisory report from his record.

2. David Moore, L.C.S.W., License No. 34007612A

Mr. Moore appeared before the Board, as requested, regarding his ongoing probationary status. Mr. Moore stated he feels he has met all requirements of probation and intended to submit a written request to the Board to withdraw probation. Mr. Moore reported that he is currently having some family issues. Mr. Moore stated that since his last appearance, he has been charged with Domestic Battery in Grant County, Indiana.

3. David S. Stombaugh, L.M.F.T., L.C.S.W.

Mr. Stombaugh appeared before the Board, as requested, regarding his ongoing probationary status. Mr. Stombaugh stated he has had a change of address since his last appearance. Mr. Stombaugh was reminded that when he changes his address he must report it directly to the Board, per his order, not only changing the address online. The Board requested signed employer and supervisor reports. Mr. Stombaugh stated that he has copies of his performance appraisals, letters from his psychotherapist, and a copy of completion of six (6) hours of mental health law. The Board stated that Mr. Stombaugh could petition for withdrawal of probation in August for a hearing in September if he is up to date on his reports. Ms. Sembroski stated that if need be, the Board could subpoena Mr. Stombaugh’s employer and supervisor and require them to report to the Board.

4. Vickie Washington, L.S.W., License No. 33008600A

Ms. Washington appeared before the Board, as requested, regarding her ongoing probationary status. This is Ms. Washington’s first personal appearance since being placed on probation. Ms. Washington reported there have been no changes since she last met with the board. Ms. Washington stated that she is not currently employed. She did explain that she was employed, but accepted another position. However, when she went to start her new position, they saw her license was on probation and did not move forward with her employment offer. Ms. Washington stated she is having difficulty with interviewing for positions with the probation status on her license. She is next scheduled to appear 12/3/2018. She can submit a request for withdrawal of probation after the December meeting

B. Renewal

There were no renewal appearances before the Board.

C. Reinstatement

1. Lisa Renee Pacheco, L.M.H.C., L.C.A.C.

Ms. Pacheco appeared before the Board, as requested, regarding the reinstatement of her expired mental health and clinical addiction counselor licenses. Ms. Pacheco’s licenses expired April 1, 2018. Ms. Pacheco answered yes to the question on the application that asks “Since you last renewed, and except for minor violations of traffic laws resulting in fines and arrests or convictions that have been expunged by a court, have you been arrested, entered into a diversion agreement, been convicted of, pled guilty to, or pled nolo contendere to any offense, misdemeanor, or felony in any state?” Ms. Pacheco explained that on December 24, 2016, she was arrested and charged with Operating a Vehicle While Intoxicated Endangering a Person in Hendricks County, Indiana. On March 8, 2017, Ms. Pacheco entered into a plea agreement requiring her to complete 363 days of probation and pay court costs and fines. On February 12, 2018, the case was reopened due to a violation of probation. The court revoked Ms. Pacheco’s probation and on April 12, 2018 charged her with Operating a Vehicle While Intoxicated Endangering a Person in Hendricks County, Indiana sentencing her to home detention effective April 12, 2018. Ms. Pacheco is due to be released from the current probation in October 2019. Ms. Pacheco stated she waited to renew her licenses until she had appeared in court for the second charge. The Board showed concern with Ms. Pacheco’s positive response.

Board action: A motion was made and seconded to grant the reinstatement of Ms. Pacheco’s mental health counselor and clinical addiction counselor licenses on Indefinite Probation with the following terms and conditions:

• Respondent may not petition for withdrawal of probation until after she is released from criminal probation.

• Respondent shall remain on probation until the Board withdraws the probation after a hearing.

• Respondent shall keep the Board informed of any change in her home address, telephone number, email address, place of employment, or occupation title.

• Respondent shall make quarterly personal appearances before the Board.

• Respondent shall attend at least three (3) twelve-step meetings per week, and shall submit documentation of attendance prior to her quarterly appearances.

• Respondent shall continue in individual therapy as recommend by her therapist, and shall submit quarterly reports form her therapist describing Respondent’s attendance and progress in therapy.

• Prior to petition for withdrawal of probation, Respondent shall submit report of a recent psychiatric evaluation and a letter from her twelve-step sponsor.

• Respondent shall immediately notify the Board of any arrest or substance abuse relapse.

• Respondent shall not violate any laws regulating the practice of mental health counseling or clinical addiction counseling.

• Failure of Respondent to comply with these terms may subject her to a show cause hearing and the imposition of further sanctions.

D. Applications

1. Nafis M. Anowar (LSW)

Mr. Anowar appeared before the Board, as requested, regarding his application for social work licensure by examination. Mr. Anowar did not answer affirmatively to any questions on the application for licensure. However, there was a record found on his criminal background check. Mr. Anowar explained that on or around December 11, 2017, he was arrested and charged with Operating a Vehicle While Intoxicated Endangering a Person, Operating a Vehicle with Schedule I or II Controlled Substance (or its Metabolite) in Person’s Body, Operation a Vehicle While Intoxicated, and Public Intoxication – Endangers His/Her Life. Mr. Anowar stated that at his May 14, 2018 hearing, the Court placed him on one (1) year probation and required him to pay court costs and fines. On June 18, 2018, Mr. Anowar had his probation transferred from Boone County to Hamilton County. Hamilton County placed additional stipulations on his probation requiring him to complete a certified court administered alcohol and drug program and attend a victim impact panel.

Board action: A motion was made and seconded to grant Mr. Anowar permission to take the ASWB Master level examination, but require Mr. Anowar to make a personal appearance before the Board prior to the issuance of his social work license.

2. Gina Braun (LBSW)

Ms. Braun appeared before the Board, as requested, regarding her application for bachelor social work licensure by examination. Ms. Braun did not answer yes to any questions on the application. However, there was a record found on her criminal background check. Ms. Braun explained that on March 15, 2015 she was arrested and charged with Obstructing Official Business, Criminal Trespass, and Disorderly Conduct after she ran from a police officer trying to question her whereabouts. After appearing before the judge, the charges were dismissed with prejudice and she was required to pay court costs. Ms. Braun stated she thought the charges had been expunged from her record as the charges did not show up on her employment background check.

Board action: A motion was made and seconded to approve Ms. Braun’s positive response and to grant Ms. Braun permission to take the ASWB Bachelor level examination.

3. Melody Burnett (LMHCA)

Ms. Burnett appeared before the Board, as requested, regarding her application for mental health counselor associate licensure. Ms. Burnett answered yes to the question on the application for licensure that asks ““Except for minor violations of traffic laws resulting in fines, and arrests or convictions that have been expunged by a court, have you ever been arrested; have you ever entered into a prosecutorial diversion or deferment agreement regarding any offense, misdemeanor, or felony in any state; have you ever been convicted of any offense, misdemeanor, or felony in any state; have you ever pled guilty to any offense, misdemeanor, or felony in any state; or have you ever pled nolo contendere to any offense, misdemeanor, or felony in any state?” Ms. Burnett explained that in 1992 and 1994 she was arrested and charged with check deception.

Board action: A motion was made and seconded to approve Ms. Burnett’s positive response and to grant her permission to take the NBCC NCE examination.

4. Dana M. Fedorchak (LSW)

Ms. Fedorchak appeared before the Board, as requested, regarding her application for social work licensure by examination. Ms. Fedorchak had appeared before the Board on June 26, 2017 due to a positive response on her application for licensure. The Board approved Ms. Fedorchak to take the ASWB Master level examination, but requested she obtain a fitness for duty evaluation from a psychiatrist and make another personal appearance before the Board once she passes the examination and prior to her social work license being issued. Ms. Fedorchak successfully passed the examination on April 17, 2018. Dr. Michael Frampton submitted a favorable fitness for duty evaluation.

Board action: A motion was made and seconded to grant Ms. Fedorchak a social work license.

5. Laurence R. Grant (LMHCA)

Mr. Grant appeared before the Board, as requested, regarding his application for mental health counselor associate licensure by examination. Mr. Grant did not answer affirmatively to any questions on the application for licensure. However, there was a record found on his criminal background check. Mr. Grant explained that on July 3, 2002, he was arrested and charged with False Informing, a Class B Misdemeanor, in Vincennes, Indiana. Mr. Grant explained that he pled guilty to this charge on July 16, 2002 and there have been no other charges since that time.

Board action: A motion was made and seconded to approve Mr. Grant’s positive response and to grant Mr. Grant permission to take the NBCC NCE examination.

6. Bridget Hampton (LBSW)

Ms. Hampton appeared before the Board, as requested, regarding her application for bachelor social work licensure by examination. Ms. Hampton answered affirmatively to the question on the application that asks “Except for minor violations of traffic laws resulting in fines, and arrests or convictions that have been expunged by a court, have you ever been arrested; have you ever entered into a prosecutorial diversion or deferment agreement regarding any offense, misdemeanor, or felony in any state; have you ever been convicted of any offense, misdemeanor, or felony in any state; have you ever pled guilty to any offense, misdemeanor, or felony in any state; or have you ever pled nolo contendere to any offense, misdemeanor, or felony in any state?” Ms. Hampton explained that on February 13, 2008, she was arrested and charged with five (5) counts of Dealing in a Controlled Substance, Class B Felonies, after it was found she was distributing controlled substances to co-workers. Ms. Hampton stated she was ultimately charged with two (2) Class B Felonies, with the court requiring her to complete one (1) year of house arrest and five (5) years of probation. Ms. Hampton completed all court requirements before obtaining her bachelor of social work degree.

Board action: A motion was made and seconded to approve Ms. Hampton’s positive response and to grant Ms. Hampton permission to take the ASWB Bachelor examination.

7. Jennifer R. Ludwig (LMHCA)

Ms. Ludwig appeared before the Board, as requested, regarding her application for mental health counselor licensure by examination. Ms. Ludwig answered affirmatively to the questions on the application that ask “Has disciplinary action ever been taken regarding any health license, certificate, registration or permit that you hold or have held?”; “Do you have any condition or impairment (including a history of alcohol or substance abuse) that currently interferes, or if left untreated may interfere, with your ability to practice in a competent and professional manner?”; and “Have you ever been admonished, censured, reprimanded or requested to withdraw, resign or retire from any hospital or health care facility in which you have trained, held staff membership or privileges or acted as a consultant?” Ms. Ludwig explained that she has a history of opioid use disorder and post-traumatic stress disorder. These issues caused her to be terminated from her position as a registered nurse at the Carlisle Regional Medical Center in Carlisle, Pennsylvania in April 2007. As a result of this termination and history of abuse, she was required to enter into a consent agreement with the Pennsylvania State Board of Nursing. Ms. Ludwig stated she has been sober since 2008 and was released from the consent agreement in 2012. Ms. Ludwig reported that she currently works as a therapist with Centerstone of Indiana and has served on the Owen County Drug Court. Mr. Brenner reviewed her evaluation and found it to be sufficient. Mr. Richardson reviewed her application for licensure. He states she submitted a course to cover Foundations of Mental Health Counseling and Contextual Dimensions called Counseling in Community Settings. This course covered the ACA ethical guidelines, community counseling information as well as an introduction of the profession itself. Mr. Richardson stated he would accept that course to cover those particular content areas.

Board action: A motion was made and seconded to approve Ms. Ludwig’s positive response and to approve Ms. Ludwig to take the NBCC NCMHCE examination.

8. Leslie Scott Leach (LCSW)

Mr. Leach appeared before the Board, as requested, regarding his application for clinical social work licensure by reciprocity. Mr. Leach did not answer yes to any questions on the application for licensure. However, there were records found on his criminal background check. Mr. Leach explained that on or around February 21, 2007, he was arrested and charged with Criminal Trespass, a Class A Misdemeanor, in Vanderburgh County, Indiana after being caught on University of Southern Indiana property after being told he was to stay off said property; and on April 4, 2009, he was arrested and charged with Trespass, a Class A Misdemeanor, in Vanderburgh County, Indiana after entering a casino that he had a voluntary lifetime ban from entering their property. In 2007, he entered into a pre-trial diversion program and successfully completed all court requirements. In 2009, he pled guilty and paid fines. Mr. Leach also disclosed to the Board that he is currently being treated for bipolar disorder and has been seeing a physician for this since 2009. Mr. Leach stated he feels this disorder was the cause of his legal issues and states his doctor has this under control now with medication.

Board action: A motion was made and seconded to grant Mr. Leach a clinical social work license by reciprocity upon successful completion of the Indiana jurisprudence examination.

9. Joseph Smith (LCSW)

Mr. Smith appeared before the Board, as requested, regarding his application for clinical social work licensure. Mr. Smith did not answer yes to any questions on the application for licensure. However, there was a record found on his criminal background check. Mr. Smith explained that on February 3, 2012, he was arrested and charged with Domestic Battery – Physical, a Class A Misdemeanor, in Cook County, Illinois after a verbal dispute with his estranged ex-partner; and on April 14, 2014, he was charged with Permit Unauthorized Person to Drive in Cook County, Illinois after allowing his nephew to drive a rental car that he could not produce a contract for when pulled over by police. Mr. Smith stated that he and his ex-partner are successfully co-parenting their daughter and that the Domestic Battery charge was an isolated incident.

Board action: A motion was made and seconded to approve Mr. Smith’s positive response and to approve Mr. Smith to take the ASWB Clinical examination.

Ms. Aghimien did not appear as requested. Ms. Vaught stated that Ms. Aghimien will not be rescheduled to appear until she submits a request.

2. Halie Lauren Davis (LSW)

Ms. Davis appeared before the Board, as requested, regarding her unsuccessful attempts at taking the ASWB Master level examination. Ms. Davis stated that she has reached out to the dean of social work at her university and Indiana State University to better prepare for the examination. She has also attended Dr. Sophia Dziegielewski's preparatory course and feels she did better on the next attempt after completing the course. Ms. Davis stated she also has test anxiety. The Board advised she do meditation to relax and to make sure she is not going back through the examination and changing answers.

Board action: A motion was made and seconded to grant Ms. Davis permission to take the ASWB Clinical level examination for the fourth time.

3. Jennifer Wilson (LSW)

Ms. Wilson appeared before the Board, as requested, regarding her request for permission to take the ASWB Master level examination for the fourth time. Ms. Wilson stated that she has purchased the One Test Prep and meets with a group each Tuesday to study. She has also completed the Social Work to Social Work program and does group prep on Fridays. Ms. Wilson also stated she has submitted a request for a special accommodation due to having dyslexia and ADHD.

Board action:  A motion was made and seconded to grant Ms. Wilson permission to take the ASWB Master level examination for the fourth time.

Case Summary On or around December 3, 2012, the Board placed Respondent’s clinical social work license on Indefinite Probation with terms and conditions. Respondent stated that he feels he has met all of the terms and conditions on his probation. Respondent entered Exhibits 1, 2, and 3; copies of continuing education certificates. Respondent stated he has recently resigned his position as Executive Director at Home with Hope to move to North Carolina. Respondent testified that he met with Rick Gustafson for monthly supervision. Respondent also testified that he feels Dr. Grant helped mentor him with the boundary issues, but doesn’t feel like he was the strongest person to fill this role. Respondent stated he plans to continue attending AA meetings in North Carolina, and has in fact already attended one in Asheville. Respondent stated he intends to seek licensure in North Carolina. The State indicated they have no objection to the withdrawal of probation in this matter.

Case Summary: On or around October 5, 2017, the State filed an Amended Administrative Complaint alleging Respondent had violated Ind. Code 25-1-9-4(a)(1)(A) in that Respondent has engaged in or knowingly cooperated in fraud or material deception in order to obtain a license to practice by failing to disclose her two (2) previous licensure denials on her applications submitted to IPLA; has violated Ind. Code 25-23.6-1(4) in that Respondent engaged in the unlawful practice when she used letters and/or abbreviations to indicate or imply that Respondent was a licensed clinical social worker when Respondent was not licensed as a social worker or clinical social worker when she signed her email as “T-LCSW” from February 8, 2016 until August 15, 2016, after her temporary permit had expired on February 6, 2016; has violated Ind. Code 25-1-9-4(a)(3) in that Respondent as a practitioner has knowingly violated any state statute or rule, or federal statute or regulation, regulating the profession by violating Ind. Code 16-39-1-1(c)-(d) that states on written request and reasonable notice, a provider shall supply to a patient or the patient’s designee the health records possessed by their provider concerning the patient; has violated Ind. Code 25-1-9-4(a)(4)(B) in that Respondent has failed to keep abreast of current professional theory or practice as required under 839 IAC 1-3-4(b) in that Respondent violated the ethical standard 3.06 of the NASW Code of Ethics when she failed to consult with both the client’s current treating therapist and the client prior to offering or engaging in services with the client; and has violated Ind. Code 25-1-9-4(a)(4)(B) in that Respondent has failed to keep abreast of current professional theory or practice as required under 839 IAC 1-3-4(b)(6) in that Respondent exploited a relationship with a client for personal gain. On or around May 11, 2018, the State filed a Proposed Settlement Agreement that would place Respondent’s clinical social work license on Indefinite Probation for a period of not less than one (1) year from the date of the Final Order with the following terms and conditions:

• Respondent shall keep the Board informed of her residential address and telephone number at all times.

• Respondent shall keep the Board informed of her employer(s) name, address, and telephone numbers at all times.

• Respondent shall appear quarterly and in person at board meetings following adoption of the Proposed Settlement Agreement.

• Respondent shall complete and submit to the Board proof of completion of ten (10) units of continuing education in Professional Boundaries with Dual Treatment and/or Ethics, to be completed in-person and not online.

• Respondent shall not violated any statutes or rules regulating the practice of clinical social work.

• Respondent shall pay a fee of five dollars ($5.00) to be deposited into the Health Records and Personal Identifying Information Protection Trust Fund.

Board action: A motion was made and seconded to accept the Proposed Settlement Agreement as presented by the State in the matter of Ms. Jacobs’ clinical social work license.

Case Summary: The State indicated they have participated in a pre-hearing settlement with Respondent. The State asks the Board for a continuance in this matter as they are working on a Settlement Agreement. The Board continued the hearing until September.

IX. DISCUSSION

A. SEA 224

Re: Virtual Supervision Defined

Meredith Lizza discussed with the Board what they feel will meet the requirements of virtual supervision in regards to Senate Enrolled Act 224. The Board feels that virtual supervision must be done visually electronic, face to face, and will most definitely have to be done over a secured network using an encrypted program. The Board determined they will make up a rules committee to help promulgate the rule regarding this change.

B. Licensure Notice

The Board discussed the previously crafted licensure notice created by the Board. The Board would like this to be posted on their website for public view, as well as being disseminated to the respective professional associations, all community mental health centers, and hospital associations.

X. APPLICATION REVIEW

There were no applications reviewed by the full Board.

XI. PROBATION REVIEW

There were no probation files reviewed by the Board.

XII. FORMAL ADOPTION OF APPLICATION REVIEWS

A motion was made and seconded to approve the recommendations made by each section of the Board for the licensure application reviews conducted from 8:00 a.m. to 9:00 a.m., and at any other time since the previous board meeting.

XIII. CONTINUING EDUCATION SPONSOR APPLICATION REVIEW

There were no continuing education sponsor applications for review by the Board.

XVI. OLD/NEW BUSINESS

- The Board created a Rules Committee to begin the process of rule promulgation for virtual supervision, supervision hours, BSW language, and any other necessary rules clean up. The rules committee will consist of Andrew Harner, Kimble Richardson, Barbara Riggs, and Carla Gaff-Clark.

XV. ADMINISTRATOR’S REPORT

Ms. Vaught reminded the Board that renewal personal appearances will be scheduled for the next meeting.

XVI. ADJOURNMENT

There being no further business, and having completed its duties, the meeting of the Behavioral Health and Human Services Licensing Board adjourned at 3:56 p.m.
