APPLICATION FOR REZONING PETITION

INSTRUCTIONS FOR FILING ORDINANCE FOR REZONING PROPOERTY LOCATED IN THE UNINCORPORATED AREAS OF VIGO COUNTY, INDIANA

The process for filing rezoning petitions begins with the Area Planning Office located in the County Annex Building. A sample packet is available to illustrate the format needed to submit a zoning ordinance amendment. The following information should be obtained from the Area Planning Department to complete your ordinance:

1. Copy of zone map for your property.

2. Present zoning of your property.

3. Zoning Classification needed for the intended land use.

4. Copy of deadline dates and meeting dated.

Rezoning of property requires that the following items be completed in detail as shown on sample, TYPED ON 8 ½ BY 11 INCH PAPER WITH A 2 INCH MINIMUM TOP AND BOTTOM BORDER AND A 1 INCH MINIMUM LEFT AND RIGHT MARGIN.

1. The application sheet.

2. The ordinance.

3. The petition.

4. The site plan.

5. Copy of zone map highlighting property.

6. Photocopy of deed of property.

7. Affidavit of ownership.

Once the above copies are typed and proofread, the “Application for Rezoning Petition: and the “Special Zoning Ordinance” must be signed by a member of the Board of the Legislative body at the appropriate position, i.e. County Commissioner, at the Sponsor and Presented By positions, and the typed name added as noted on the examples. These pages are now the ORIGINALS. The property owner(s) should now sign the document where noted on the examples and have the necessary public notary. ALL SIGNATURES MUST BE IN BLACK INK.

Five (5) copies plus the original are needed for items 1 thru 5. One (1) original copy of item 6 and 7. The copies should be stapled together in the order listed above, all originals stapled and identified in one packet.

PLEASE CHECK LEGAL DESCRIPTIONS CLOSELY: ERRORS MEAN DELAYS

After the packets have been prepared and stapled, they should be returned to the Area Planning Department for filing. A fee of $100.00 is payable at this time. The Area Planning Department will check the original for errors or omissions and advise of corrections, if necessary.

It is important that the owner’s representative be present at ALL meetings that the ordinance is scheduled on the Agenda. A letter will be issued by the Area Planning Department to notify of the meeting dates and times.

If the legislative body passes the amendment, the original must be recorded and advertised for the rezoning to be in effect. If there are any questions concerning the documents or further questions, please contact the Area Planning Department at (812) 462-3354.

An ordinance amending the UNIFIED ZONING ORDINANCE FOR VIGO COUNTY, INDIANA.
