TERMS OF REFERENCELegal Advisor in Support of two Information Campaigns on Internal Migration implemented by International Organization for Migration in MongoliaAugust 2020BackgroundThe International Organization for Migration, Mission to Mongolia (IOM) has carried out a pilot project funded by the Swiss Agency for Development and Cooperation to support the Government of Mongolia to strengthen the management of internal migration. During this pilot phase, two research studies were completed: “Mongolia: Internal Migration Study” and “Urban Migrant Vulnerability Assessment”.Based on both studies and findings from the activities in the pilot phase, “Understanding and Managing Internal Migration in Mongolia” project was designed and is currently under implementation. It is a four-year project that partners with the Ministry of Labour and Social Protection, Municipality of Ulaanbaatar, National Statistics Office of Mongolia, General Authority for State Registration, Ulaanbaatar Emergency Management Agency, rural local governments and civil society organizations. The project comprises three outcomes related to 1) Internal Migration Data; 2) Internal Migration Governance; and 3) Targeted Interventions. These outcomes will contribute to the objective of improving socio-economic well-being of internal migrants in Mongolia through evidence-based, migration inclusive policies and concrete interventions on the ground aimed at enhanced access to information and services.The first outcome on internal migration data will bridge the existing gap in up-to-date data and analysis to inform policies and actions on internal migration. The second outcome of the programme seeks to consistently integrate a migration perspective and the needs of internal migrants into policies and programmes in a comprehensive and coordinated way to promote inclusive internal migration governance that contributes to Mongolia’s development. By providing stakeholders with a broader knowledge base on internal migration and developing an Action Plan with tailored recommendations regarding short, medium, and long-term policy responses, the Government of Mongolia will be able to design and implement interventions to better respond to the needs of internal migrants and mainstream internal migration into policy planning and response. The third outcome will reduce vulnerabilities of internal migrants through improved access to information, services and targeted interventions. Targeted efforts will be undertaken to enhance capacities of Municipality of Ulaanbaatar and NGOs to deliver migration related information and services to internal migrants on a regular basis. Thus, training handbooks with information and guidance related to internal migration will be developed specifically to support khoroo officials including Integrated Public Service Centres as well as NGOs in Ulaanbaatar and rural aimags. Related capacity building activities will be also implemented.Under the same Outcome 3, and in close collaboration with government authorities at the national and local level, including the Municipality of Ulaanbaatar, as well as civil society organizations, two information campaigns are planned to enable urban migrants in Ulaanbaatar and prospective internal migrants in rural areas to make informed decisions about migration: 1) the Urban Migrant Information Campaign, and 2) the Prospective Internal Migrant Information Campaign. The information at the basis of this campaigns might include but will not be limited to: opportunities and risks associated with internal migration, implications of the migration restriction, eligibility and access points for advice and services, available settlement areas, risks associated with labour exploitation and land tenure, available grievance redressal mechanisms, potential destinations other than Ulaanbaatar, government incentive programmes supporting return migration and settlement in rural areas. Objective of the AssignmentUnder the overall supervision of the Chief of Mission (COM) based in Beijing, China, direct supervision of the Programme Manager and in coordination with the Communications Consultant based in Ulaanbaatar, the legal advisor will be assigned to map comprehensively the existing legal framework on internal migration, focusing especially on mapping the rights and obligations of the internal migrants with a special reference to the registration status, and produce information materials to be used in the information campaigns under implementation by IOM. The legal advisor will be provided with relevant information and researches that IOM has collected and produced. Responsibilities and AccountabilitiesAnalyse existing legal framework and synthesize in detail the residency registration procedure (both in Ulaanbaatar and in aimags)Work closely with the General Authority for State Registration to reflect the legislation in force as well as all the relevant regulations, by-laws, internal orders etc. as well as to anticipate possible legal changes and adapt the content of the information materials to those possible changesConsult public administration representatives on the ground to identify any significant inconsistencies between the legal provisions and real-life implementation on the ground.
