Commonwealth of Virginia – Tax Filing Deadlines and Extension Information

Va. Code § 58.1-112 grants the Tax Commissioner the authority to waive penalties and grant extensions of time to file a return or pay a tax to any class of taxpayers when the normal due date would cause undue hardship to the taxpayers because of a natural disaster or other reason. Pursuant to this authority, the Department of Taxation will provide a thirty day filing and payment extension to certain individuals affected by the crash. This extension will apply to taxpayers who are unable to meet their filing obligations because the financial books and records they need to file their taxes are located in the Mayfair Mews apartment complex where the crash occurred.

To request the special extension, taxpayers should write “Mayfair Mews” at the top of their paper returns. Generally, only taxpayers with a tax due need to apply for the extension. Taxpayers who do not owe any taxes and file within the six-month automatic extension period will not be penalized.

Taxpayers who request the extension will be allowed an additional thirty days to file individual income tax returns and make tax payments that have a due date of May 1, 2012. The Department will then abate interest and any late filing or late payment penalties that would otherwise apply.

Additional extensions or penalty waivers may be granted in hardship cases. Written requests should be e-mailed to TaxIndReturns@tax., or directed to:

Affected taxpayers with business tax inquiries can request extensions on their business taxes by submitting a request to TaxBusQuestions@tax. or by writing to the above address.

The Department will work with taxpayers in the affected area to minimize the impact of any collection enforcement activities that may be initiated between April 6, 2012 and May 1, 2012. Taxpayers notified of pending actions should contact the Department at (804) 367-8045 to discuss relief from actions that would create additional hardship in their recovery from the effects of the plane crash. The suspension of enforcement actions, however, will not stop the accrual of interest on delinquent accounts.
